SOME IMPORTANT UPDATE

JS(D.O.P&T) completed his presentation on 25.10.11. We have learnt that DOPT perhaps has asked CBEC to give permanent functional justification of  promotional posts of AC+DC approved by Expenditure (temporarily). D.O.P&T raised its query on the issue of review of promotional quota after every 5 years. Further it is gathered that Board is all set to answer these questions. It is expected that the issue would be resolved amicably within the stipulated time frame.
The file containing removal of anomaly on the issue of juniors drawing more pay than seniors has gone past expenditure.
on 19th October AICEIA had a serious discussion with Secretary General of Superintendent's Association on the rectification of pay scale and its arrears issue, At the outset the demand for notional effect from 01.01.1996 was ruled out by Superintendents' Association; AICEIA tried to convince them that to bring all the organisations of Revenue Department together we should remain flexible . When Superintendent Association under the leadership of Ravi Malik expressed their inability to change the issue from 01.01.1986 to 01.01.1996 then AICEIA asked them about joint agitation programme to the tune of Strike action.It was narrated to the Superintendents that AICEIA has already made some VVIP references sucessfully, the need of the our is to take some programme and a joint representation to F.M. in this regard. Though arrear from 01.01.1186 is not achievable yet, for the dream of togetherness and to transform the agitation in a sucessful negotiation AICEIA was agreed to the proposal. AICEIA is all set to go for any kind of agitation to the extent of Strike if Superintendents' Association is able to take a strong stand. We hope your sensible comment shall enlighten the wise leadership of this Cadre ( INspector & Superintendent). Till date no positive reply has been received. All are requested to pursue the matter with Superintendents' Association wherever possible. At this point of time no court case no VVIP reference could help us except a vigorous organisational action programme . Any suggestion in this regard is deeply solicited.

Sub:  amendments proposed in the Customs & Central Excise Group A                                               Services Recruitment Rules… comments regarding

                  Reference is invited to the amendments proposed in the Customs & Central Excise Group A Services Recruitment Rules proposed by the Board. We would like to express our following reservations/suggestions in this regard.
  1. The amendment proposes to revise the ratio of promotion to Grade VI of the service to 13:1:2. While welcoming the change, we wish to point out that unless the ratio is converted into a quota as in a post based roster, a drastic reduction in the representation of officers from the Central Excise stream would ensue, owing to the fact that a Central Excise promotee, in most cases retires within one to two years of induction in to the Group A service and the vacancies would be apportioned to other cadres also. Bringing in such a mechanism is imperative to give effect to the direction of the Apex Court that proportionate ‘representation’ for the three streams is to be ensured.
  2. The march over done by the Customs streams over the years due to the unfair advantage in ratio has created large scale disparities in the matter of promotion of Central Excise Officers vis-à-vis Customs. As a measure to bring in some sort of parity, at the time of implementation of cadre restructuring, the vacancies in the grade of Assistant Commissioners should be filled up by length of Service in Group B by relaxing the provisions of Rule 18, in exercise of the powers under Rule 34.
  3. The percentage of Direct Recruitment in Group ‘A’ should be reduced to 25% as in the case of Indian Postal Service in order to give more promotional opportunities from Group-‘B’ to Group ‘A’ cadre. It may please be recalled that during the 18th January 2011 meeting called by the Chairman for consulting with the Associations on Cadre Restructuring, on this particular demand it was assured that it would be considered separately by delinking from cadre restructuring. Though it was not included in the Draft RR, we hope that this issue will be resolved while finalising the RR s.

  1.           The proposal to reduce the qualifying service for promotion to Group A to 2 years citing the DOPT circular dated 25.05.98 is detrimental to the cadre since it would only widen the disparity in promotion vis-à-vis the Appraisers. It may please be appreciated that the intent of the circular is only to fix the minimum service to move from one scale to another and it is not a fetter on the department to fix a realistic residency period taking into consideration various factors prevailing in the department.

5.        The Grade V service may be made a non-functional one without linking it to vacancies as is in the case of Grade IV and III and the vacancies in both the grades should be taken together for the purpose of promotion.

Transfer policy for Physically Challenged Government Employees

A suggestion has been made that physically handicapped candidates appointed under the Government  should preferably be posted in their native places or at least in their  native district.  The matter has been examined carefully by DOPT and following decision was taken vide OfficeMemorandum NO. A-B 14017/41/90-Estt (RR) dated 10.05.1990
It may not be possible or desirable to lay down that physically handicapped employees belonging to Group-A or Group-B who have all India transfer liability should be posted near their native places.   However, in the case of  holders of Group-C or Group-D posts who have been recruited on regional basis and who are physically handicapped, such persons may be given posting, as far as possible,  subject to administrative constraints, near their  native places within the region.
Requests from physically handicapped employees for transfer to or near their native places may also be given preference.
However, the representations made by various Group A and Group B Officers were later considered by Government and it was decided the same benefit extended to Group C and Group D physically challenged employees will also be applicable to Group A and Group B officers.  This decision was communicated by DOPT in the office memorandum No: AB 14017/16/2002-Estt.(RR) 13.03.2002.  The decision is as follows
It is further clarified that the guideline contained in para 2 of this Department’s O.M. dated 10.5.1990 that requests from physically handicapped employees for transfer  to or near their native places may also be given preference, covers physically handicapped employees in Groups A, B, C and D.
