UPDATE

In continuation of the meeting chaired by the Secretary (Revenue) on 23.07.2009, a meeting was called by the JS (Per) of Expenditure Ministry. The President and SG attended the meeting. Representatives of the ITEF and Customs Preventive Federation also attended. In the course of the meeting, the Expenditure Authorities conceded that it is not possible to merge the cadres of STA and Inspector due to functional distinction. However they were not ready to commit on the upgradation to Rs. 4600/- and instead they suggested some alternate measures like 2-3- 4 additional increments/ higher start in the pay band/ putting 80% of Inspectors in Rs. 4600/- and the rest in Rs. 4200/- who will move to Rs. 4600/- after 4 years/ clarification that promotion from STA to Inspector would entail FR 22 fixations. We categorically stated that none of the suggestions would solve the problem faces by the cadre. They even suggested that all the Inspectors presently on the rolls can be granted Rs. 4600/- and the subsequent entrant would be in Rs. 4200/- . When we stood to our stand the meeting was prorogued by the JS (P) stating that they would report to the RS and after that the decision would be communicated.

Met the US IFU to pursue the representation against the Dy Controller of Accounts letter regarding Grade Pay on receipt of ACP under the 99 scheme. We breifed him and requested to expedite the matter.

Met Member (P&V) and registered our protest in permitting ICT on spouse joining ground on without loss of seniority principle and expending the order to promotional posts also. The Member agreed to have a relook.

However, we shall continue our agitation program till we receive a positive communication from the Government.

Comrades,
It is very interesting to know the spirit of our Inspectors for achieving their goal, many of our wise members and friends could not understand yet what is the utility of the repeated movement. We have already mentioned that we have to be ready for a sustained struggle only that process of movement we are following; now,Board has warned us not to go for further agitational movement immediately after we launched this second phase of agitation . On 19th August we have received a phone call and a faxed letter from Deputy Secretary-Ad-IIA wherein our association has been once again invited for a second round of negotiation . It was learnt that expenditure officials will be present there. From our side Secy. Genl. and president will participate in the meeting.
We thank one and all for continued support to the association and we hope if we fight as a single body we will be able to achieve our pending demands. However, our agitational programme will continue till further notice.

Sir, Sub: Notice for agitation
Kindly refer to our letter under ref. no. CBEC/119/2009 Dated: 10.07.2009 wherein we have mentioned that the Inspectors of Central Excise are highly aggrieved on the treatment they have received from the Government while implementing the VI Central Pay Commission recommendations and lack of initiative in addressing the acute stagnation faced by the cadre. Sustained persuasion on both the matters have yielded no results.
As per the decision of the CEC meeting of the All India Central Excise Inspectors’ Association held in Chandigarh from 3rd and 4th of July 2009 Inspectors of Central Excise is observing lunch hour demonstration on the following agenda:
1. The non rectification of the anomaly in the pay scale consequent to the merger of 3 pay scales by the CCS (RP) Rules, 2008 thereby placing the feeder cadre of Senior Tax Assistant and the promotional cadre of Inspector in the same grade pay.
2. The denial of notional fixation with effect from 01.01.1996 in the pre-revised scale of Rs. 6500-10500/-. The scale was granted on 21.04.04 in order to restore historical parity of pay scales with Inspectors of CBI & IB.
3. To review the clarification issued by DOE to CBEC denying the non-functional grade pay of Rs. 5400/- after 4 years of service in the grade pay of Rs. 4800/- to ACP recipient Inspectors.
4. Proper measures should be taken to remove acute stagnation of the cadre of Inspector of Central Excise and Inspector cadre organization should be included in the restructuring committee.
5. Inclusion of Inspector cadre organization in the Anomaly committee.
We appreciate the initiative taken by the Revenue Secretary and our Board on 23rd of July 2009 to resolve at least the pay scale issue of Inspectors. In the said meeting Secretary (Revenue) had issued directions to convene another meeting in the 1st week of August 2009 to resolve the issue. I respectfully submit that the proposed meeting has not yet been convened.
I submit that the entire cadre of Inspectors are highly distressed owing to this inaction despite the specific directions of the Secretary (Revenue) and are constrained to intensify our agitation. Hence the cadre of Inspectors are again launching their 2nd phase of agitation programme from 18th of August The proposed action plan is placed underneath.
1. Lunch Hour Dharna along with demonstration in front of Chief Commissioner’s/ Commissioner’s offices through out the country, on 18th of August 2009.
2. 24th to 28th of August 2009-wearing of Black Badges and Lunch hour Dharna in front the above mentioned Offices.
3. Sending of telegram to Secretary (Revenue) and the Chairman CBEC on 28th of August, 2009.
4. Pay boycott on 31st of August, 2009.
5. Whole day Dharna Programme in every offices on 9th of September 2009 and demonstration in solidarity with the ITEF.

On 3rd August, Secretary General, Working President and Joint Secretary (North) visited Delhi. On 4th of August convened a general Body meeting at C.R. Building, New Delhi and highlighted the need for a concerted and sustained struggle to achieve our goals. Requested the general members to organize election at an early date. An interim committee was prepared to look after the day to day affair .On 5th office bearers met Joint Secretary (Admn.) enquired about the next meeting of the revenue Secretary and pursued issuance of clarification on the Deputy Controller of accounts letter on ACP. Enquired the proposed meeting of the Revenue Secretary in the Co-ordination Cell of the Revenue Department, no positive result received yet.Entire cadre of Inspectors is highly distressed owing to this inaction despite the specific directions of the Secretary (Revenue). Hence the need is to intensify our agitation. Therefore the association decided to launch its 2nd phase of agitation programme from 18th of August; The proposed action plan is placed underneath.

All the Central Leadership of the Association, CEC members and office bearers of the Branch and Circle committees are hereby requested to keep build up momentum for the agitation and the message is to be sent to the authority that the entire cadre of Inspector is struggling together to achieve their pending demands. In this context we would like to request all concerned to keep contact with the leadership of ITEF & the Associations of Customs.
Massive poster campaign is to be initiated by the office bearers of the Circle and Branch committees, poster should be sent to the remote places of the concerned jurisdiction.
All the Circle and Branch committees are hereby requested to provide black ribbon and safety pin to the inspectors posted within that circle/ Branch to observe the week long black badge wearing programme, In this week long programme it is advisable to organize rally in the lunch hour in front of Chief Commissioners office. On 28th a meeting should be organized at each and every office and from the meeting the telegram appended below be sent to Chairman & Secretary (Revenue).
All the Circle and Branch committees are further requested to organize massive campaign and to ensure pay boycott for the month of August 2009. It is advisable not to receive cheques on or before 31st AUGUST 2009.
Text of Telegram to Chairman & Secretary (Revenue)::
PLEASE GET THE ISSUE OF
· Grade pay for inspectors settled as per the govt. of India notification.
· Notional fixation (without arrears) with effect from 01.01.1996 in the pre-revised scale of Rs. 6500-10500/- for the Inspectors and Superintendents settled.
· Denial of non-functional grade pay of Rs. 5400/- after 4 years of service in the grade pay of Rs. 4800/- to ACP recipient Inspectors settled by reviewing the detrimental clarification issued
· Acute stagnation in the cadre of Inspector and Superintendent resolved.
PRESIDENT OF THE MEETING
After 9th of September the Association shall review the situation as per the demand of the situation and may go for more intensified action.

Sub – Upgradation of pay scales of Inspectors in CBEC & CBDT – Reg

A kind reference is invited to the meeting of officials of the Department of Expenditure and the staff representatives of CBEC & CBDT, convened by the Secretary (Revenue) on 23.07.2009 with regard to the up gradation of pay scales of Inspectors in CBEC & CBDT. In the said meeting Secretary (Revenue) had issued directions to convene another meeting in the 1st week of August 2009 to resolve the issue. I respectfully submit that the proposed meeting has not yet been convened. I humbly request the Secretary (Revenue) to intervene in the matter so as to settle the issue.
