LATEST UPDATE ON 1992 BATCH PAY ANAMOLY

THE CAT HYDERABAD HAS GIVEN ORDER IN FAVOUR OF 7 OFFICERS TO RECTIFY THE PAY ANOMALY VIDE OA NO. 31/2007 . DEPARTMENT HAS FILED A PETITION IN AP HIGH COURT AND OBTAINED STAY VIDE ORDER DATED 4.12.2008. THE OFFICERS HAVE THEN FILED A PETITION FOR VACATION OF STAY AND SUCCEEDED VIDE INTERIM ORDER OF HIGH COURT DATED 22.6.2009.
AFTER LOT OF DELIBERATIONS BY THE BOARD WITH DOP&T AND MINISTRY OF LAW AND JUSTICE, HAS ORDERED FOR RECTIFICATION OF PAY ONLY TO PETITIONER OFFICERS SUBJECT TO OUTCOME OF HIGH COURT VERDICT. ACCORDINGLY ALL THE OFFICERS IN THE PETITION HAVE BEEN GIVEN PAY ANOMALY AND THEIR PAY WAS RE-FIXED.

This is appreciable that the association has taken the matter up.As ever, the department has taken a stand which is not only contrary to the provisions and spirit of the legislature but also to the logic. The copy of interim order of High Court may also be circulated to enable other officers to represent their case.

Please provide the details of stay order, CAT order and application available to my email ide "subhu12341969@gmail.com or subhu1234@rediffmail.com". We the 1992 batch Inspectors in Tamilnadu got favourable order from Commissioner but while the file went to PAO it was rejected by PAO and the Board's clarification disallowing the case also followed. So please send the details for fighting our cause in Tamilnadu.

On behalf of the newly promoted officers I also have a request to the Federation to request the respective CCs to consider posting the officers in the respective Commissionerates/place of work at least till the cadre restructuring which is set to take place in a few months time. Otherwise the next mass batch of officers would be accomodated in the respective places whereas the promotee officers now have to move out of the parent Commissionerates. The CCs could be apprised of this position so that the promotee officers do not face hardship by ways of transfer in this mid of the year.
