UPDATE ON THE 18.01.2011 MEETING
Chairman, CBEC convened a meeting of the representatives of all the recognized association on 18.01.2011 at 4 PM. Member (P&V), DG (HRD), ADG (HRD) and other officials from HRD were present. The HRD made a presentation on the main points raised by associations and the response of the administration to it. The issues were categorized as those relating to cadre restructuring being considered favourably; not relating to cadre restructuring being considered favourably and relating to cadre restructuring but not being considered favourably. The major issues that have a bearing on our cadre and discussed in the meeting are the following. 

  1. 1.    Vacancies arising out of CR should be filled up by promotion – Accepted and also considers to extend it beyond one year.
  2. 2.    Creation of separate service for promotion of Group B Executive officers – Under consideration independent of CR
  3. 3.    Promotion of Group B gazetted executive officers directly to STS – Under formulation independent of CR
  4. 4.    DR quota in Inspector cadre to be reduced – Under consideration independent of CR
  5. 5.    Residency period for promotion from Inspector/PO/EO grade should be common to all three cadres – RR would be amended suitably.
  6. 6.    All Inspectors who have completed more than 10 years of service should be promoted as Superintendent – To the extent possible allocation would be done to achieve this end.
  7. 7.      In those zones where no new executive commissionerates have been sanctioned, the normative allocation of staff may render some staff surplus and hence the allocation of posts to audit commissionerates in these zones should be over and above the existing strength – It would be ensured that no staff strength in any grade would be rendered surplus and efforts would be made to bring parity in the rate of promotion among zones.
  8. 8.      Bringing the promotional level of Inspector/PO/EO on par and revising the ratio for promotion to AC level before CR – Matter sub judice and revision under active consideration/parity under examination separately.
The Chairman asked the associations to prefer representation if any before 27th of January so that Board can finalize their proposal and send it to IFU/Expenditure by mid February. Chairman also announced that an in situ scheme for promotion from Inspector to Superintendent and from Superintendent to AC is in the pipeline.

What prompted the Board to think about of in situ promotion now. We have already waited 20 years and nothing shorter than functional promotion is the need of hour.

in situ scheme may be adopted in case of Gr A only and Gr B C & D may please be spared during this CR.

To my knowledge already the MACP/ACP scheme takes care of insitu promotion. I would prefer functional promotion only.

Kindly take up the matter regarding all india seniority and lifting of ict ban positively as there has been no discussion regaring this. we missed a chance again to take up this matter with approproate authorities.

THERE IS NO FUN OF INSITU PROMOTIONS AFTER WAITING FOR TWO TO THREE DECADES IN THE CADRE OF INSPECTORS/SUPERINTENDENTS, UNLESS AND UNTIL THE DISPARITIES IN THE PRMOTIONS OF INSPECTORS/SUPERINTENDENTS OF CENTRAL EXCISE/CUSTOMS/EO/APPRAISERS AND INTER ZONAL DISPARITIES ARE REMOVED AND THE INSITU PROMOTIONS WITH RIGHT TO SENIORITY ON THE BASIS OF LENGTH OF SERVICE ARE IMPLEMENTED.

THE INTENTION OF THE BOARD IN TREATING THE ISSUES OF RATIO FOR PROMOTION TO GROUP A, CREATION OF SEPARATE SERVICE FOR GROUP B OFFICERS, RESIDENCY PERIOD FOR PROMOTION OF INSPECTOR OF CENTRAL EXCISE/CUSTOMS/EOS ETC. AND NOT CONJOINTLY WITH THE CR EXERCISE APPEAR TO BE MALAFIDE. THERE APPEARS TO BE NO LOGIC WHY THESE ISSUES CAN.T BE DEALT WITH CONJOINTLY WITH THE CR.

IT IS HIGH TIME THAT THE ASSOCIATIONS OF INSPECTORSAND SUPERINTENDENTS TAKE UP THIS MATTER OF IMPLEMENTATION OF ALL THESE DEMANDS BEFORE THE IMPLEMENTATION OF THE PRESENT CR; OTHERWISE WE WILL AGAIN MISS THE BUS AND REPENT.

HOPE BETTER SENSE WILL PREVAIL AND GOD WILL SHOWER ENOUGH MAGNANIMITY TO SEE THE THINGS IN CLEAR LIGHT.

Once again the same old story of so much promise, but nothing worth mentioning when it comes to implementation....I think this system of independent of CR should not be accepted or hence v would once again repent this CR also...And one more issue to confuse us is 'in situ promotions'....is there any clarity on this issue

the amendment to RR is of no use i.e reduction in residency period, as already Inspectors of central excise stagnate more than the existing residency period.

See the result of the meeting and the hidden agenda behind the proposals. Once again this elite cadre of Inps/Supdts have been made to bite the earth. The IRS lobby has shown their cleverness.Comrades-one question-What they (IRS) have given us in the last 30 years. One promotion?. Do you all think they would do something in our favour. We are going to be and would be treated as third class citizens or (pigs). So please dont accept anything INDEPENDENT OF CR. Mind- anything which cannot be done now cannot at any cost be done independent of Cadre Restructuring. Friends-----Wake up----and react

I recollect that one of our comrades was elated to see the reciprocal greeting of CBEC Chairman. He was also expressing his optimism. But, what has happened now?

CBEC will accede to our demands, if only the same are not detrimental to the interests of the Examiners and Appraisers. CBEC is nothing but the extended arm of the Federation of Appraisers. CBEC will not allow the Inspectors of Central Excise to grow so as to have controlling power on the direct recruit IRS officers.

Why certain proposals are to be dealt independent of CR? Is it not the ploy to dilute the matter and bury the issue forever? What has happened to the High Power Committee Report? What has happened to Bharadwaj Committee report? What has happened to the recommendation of CBEC and CBDT for pay parity of the Inspectors of Central Excise with that of CBI?

CBEC says that the matter relating to the ratio for promotion to AC level is sub judice. Do you know the fact that CBEC pleaded before the Supreme Court requesting for ONE YEAR TIME to do the simple arithmetic calculation of fixing the ratio, even though HRD recommended for 15/18 for Supdts of CE (currently 12/18), 2/18 for Supdts of Customs (currently 2/18)and 1/18 for Appraisers of Customs(currently 4/18)? Are you able to see the bonanza currently enjoyed by the invading appraisers? It is 4/18 as agaist their actual entitlement of 1/18. That means, enjoyment of the benefits to the extent of 400% of their entitlement!!!!!

Let us celebrate the Excise day. Let us enjoy with family members the free food offered by the Department on the Excise day. Let us happily do the protocol work. Let us perform all the Honorary functions very happily. Let us wear the Uniform very happily, which is not prescribed at all.

Let us continue to salute the junior most invaders from Customs. Let us continue to listen to the music of Shri. PV. Raju in praise of the Association leadership!!!

Has the Association recorded the dissent? CBEC has driven the last nail on our coffin. We cannot dream of better prospects anymore from CBEC; also from the leaders of the Association for Inspectors/Superintendents of Central Excise.

The ideal option available for us now is to stick to our demands. If not considered, we will have to reject the CR proposals in its entirety.

We should also tell the Expenditure department that the projection of about Rs. 500 Crores for promotion of the Inspectors and Superintendents to the next levels is not warranted, if the date of joining is taken into consideration. If the Association points out to Expenditure Department that Government can easily save Rs. 500 Crores on account of the above method, Expenditure Department will reject the case of the Examiners/Appraisers.

he amnner things are moving, it seems that we are cold bloded animal and tolerate everythnig. That is why the britishers ruled over us for 200 years and legacy is carried out by IRS and beaurocrtes and we are ruled by them as per their sweet will. Now Supdts are given adjudication powers they may give powers of filing appeal, in courts and may be even to reivew the orders and the powers of issuing registration is given to A.C. it may even go to JC, or Addl.Division will be headed by JC, even refunds may be sanctioned in future by JC AC. Just see all this but posts of AC will not be increased and it will not be given to us at any cost for this onoy Customs dogs are eligible, irrespective of from whcih stream theycome and how competent they are in the work of even customs where they born and brought up yet evasion cases of customs detected by Central Excise officers. But still we got this treatment and tolerating it.

VERY GOOD MORNING,

First of all I would say that none of us are annoyed with you, but we are annoyed with the approach of CBEC. And what I forewarned that they won’t do anything for us is appearing step by step true. Every point which is beneficial to our cadre is kept out of CR as happened last
time, whether parity or any other matter. And in the face of this how various Association continue in such meetings and listen all this rubbish that is surprising, Why we have to extend co-operation to such authorities, how so ever he may be decent or apologetic to our
problems ( I say so as Shri Majumdar said thrice in Mumbai Seminar as “he is ashamed of that Inspectors are not getting promotions" "not getting proper infrastructure" that his humility and decency or may be fear that in front of large gathering CBEC is stripped of on basic
needs of the department and staff is complaining in front their own cadre officers and he is answerless)but when authority comes to his stride what he did --- again nothing that pinches and my approach to such people is very harsh as they are good for nothing. Regarding
suggestions many people said parity is the only solution for us, I would say a step further that we should demand parity and separation of Board also and agitate over this issue whole heartedly.
Now you ask for satyagrah - on holidays or working days – reasoning for preferring on holidays is there won’t be any action in such situation’ sir, who so ever had given this noble thought or idea is devoid of legal position on this count. To the best of my knowledge and experience as far as application of Conduct Rules are there – there is no holiday - every Govt. Servants conduct is under scanner even on holidays and - any kind of protest is amount to strike and disciplinary action can be invoked. So don’t be under impression that such action will not invite disciplinary proceedings a fear of which is haunting in the minds of those who suggest such measures.
Further, a person who is lying on death bed if you ask him what mode of death you will prefer or would you like to die on holiday or working day – Sir what difference it will make he has to die and after death he is free from all worries. Also remember the fact that we have strength and if we decide that we have to go on agitation no one will stop us to achieve our goals. I would say "KYA YE SAJA KAM HAI KE HUM ISS HAL MEIN BHI JEE RAHE HAI'
My Dear say " HUM TO DARIYA HAI HAMEIN APNA HUNNAR MALUM HAI JSI TARAF BHI CHAL PADE TO RASTA HO JAYEGA" Sir, with this spirit we got done the up-gradation in 1997 and the same spirit is required for agitation and nothing else. And that also, on working days, to affect the institution. If institution does not think about us why we should think - second position otherwise is in our favour only thing how to exploit it and expose, CBEC has no answer to our arrows as this is second restructuring and our problems have not been attended to by
CBEC till date, we are pursuing it since 1994, What they can justify in public or in court of law, You have RTI reply on the matter and see all this can be shown to Minister that they are failed to do anything for us since long then why should we listen to them. But, only thing is required that we all should launch agitation like GADAR of 1857 not a single CEX official be available for work but at the same time not at home also but on the place of agitation that
commitment is required.
SO DEAR ARE YOU READY TO ENSURE IT FOR GET EVERY THING THEY WILL COME DOWN.

It is high time thatall the Central Excise Supdt & Inspectors to wake up and bycott the C.Ex day with all possible manner so as the vengence of the C.Ex "Gr-B" cadre be heard at the corridors of CBEC and PMO.
Let's bycott the Cadre Restr.in toto.The manner of keeping the crucial issues and bottlenecks outof the ambit of CR is only diplomatic division of the hirarchy of CBEC between Central Excise & Customs.

At any cost we must not accept the CR in present form unless our core concerns are adressed.we have to fight it tooth and nail.Let the assn. state the CBEC unless all our issues are accepted we will not accept it.

Dear Comrades,We are not criticising your acts but the sound you hear is the desperate cry of our soul. Inspite, our own Finance Minister himself supporting the cause of Insps/Supdts, it is pathetic to see that how the clever IRS is undermining our legitimate demands by supporting the money powered Appraisers. My request- Please reject CR and immediately and write to FM and PM for a Board (CBEC) manned by IAS Officers. Why we require a bunch of IRS in the Board where only policy decisions are taken at the expense of Appraisers. Kindly take the help from IAS Officer’s Association and openly support their demand that all those Boards under the Government of India should be manned by IAS Officers. We will be more secure under an IAS command. Serve a copy of above said letter (to FM and PM) on Chairman regarding our demand for doing away with a biased Board consisting of Appraisers fed IRS.One word of advice to RAJGURU-Be polite when criticising the comrades. Everyone has his on limitation.

Let us boycott excise day function. Those who does not have self respect and desire to have free food for their family members can attend the excise day function and demonstrate their slavery.

History will record the event on 24.02.2011 that NONE from the cadre of Inspectors and Superintendents of Central Excise attended the function. It will convey the clear message to the Appraisers of Customs and their supporters in the Board that we cannot be duped anymore.

our leaders should see the blog of ministerial association. They have given demand wise result and have the courage to reject the CR. May God give some strength to our leaders to reject the CR in the present form. What is your opinion about the CR in the present form , Mr. Raju. Will you devote some time to enlighten us on CR as you do respond on the blog. If possible spare some time to enlighten us and tell the cadre whether u accept it or not. If yes, then how are we going to be benefited by this CR. I may not be understanding the finer points of the CR. So please explain! Thanking u in anticipation.

The meeting with chairman on CR has again transpired that they are cleverly driving their own way. They are again with money feeder cadre of appraiser and customs. Every issue which may have possitive bearing on carrier of inspectors/superintendent of c. ex. has been put on hold and it will be seen out of CR, why???. Our freinds have rightly suggested that we should not participate in excise day funtions. It is not that we are against the excise day, but it is against the persons who have hijacked its machinery. It should also be resolved by the inspectors/superintendent of c.ex. that we will not do any protocols and other things which we are not legally bound to do because we are not only being humiliated on each occasion but also being treated as slave who has to perform despite all odds and adversities. Our future is being sent to black hole from where nothing could see light again. To show our resolve we should reject the present CR proposal in-toto. Demand should be made to have an independent committee (without IRS officers) to prepare afresh CR proposal.We should not be in hurry to see that CR is getting through immediately unless a gustified proposal is made because it would be better to remain inspectors/superintendent for a few more years as it has been for last twenty years. CBEC should also be freed from biased IRS who think always for himself or for those who cater their personal needs. To show our plight and injustice met out to our cadre, we should have an agitation by way of 'GANDHIGIRI' before FM/PM and every forum.

Though all important matter regarding the upgradation of the officers has been raised in the latest meeting, lifting of ban on ICT has not at all been discussed.
The ban is not at all feasible and association must do their best to get it removed.
Hope to see it discussed in positive vein next time as lot of guys are confined to a particular cadre zone even after being selected on All India Basis.

Like old age saying that "for planning go to Delhi and for implementation go to London." it appears similar with regard to CR, since our beaurocracy is pampered in that fashion only. we,the inspectors are not meant to demand rights or privileges but are trimmed to bend like house wives. we are suffering a lot and still not worth enough to raise demands. dept is meant and gives prosperity to IRS only. The job of Inspector is like a house wife that is preparation of Roti,Rice,dal,sambar,curries and chutneys and the Supdts may add masalas to the food and the job of IRS is to tell the taste of the food like husband tells his wife. who is privileged? husband or wife? the answer is naturaaly the husband! Hence my dear friends wives should listen husbands whether they are right or wrong ! we the silent mourners have no option but stick to husbands only.

If for suffering as wives then what is the need of an Association. Please issue boycott call of Central Excise Day as a first step to honour the lost dignity of the cadre.
