Dear Comrades,

With the active co-operation of the members of M.P. Chattisgarh Circle (inclusive of Nagpur) under the able leadership of Sri Vinod Sharma (Vice President ) and Sri Ajit K.G. ( General Secretary ) and Sri Hemant Kumar Ghoshal (Joint Secretary AICEIA) The 3rd Central Executive Committee meeting of AICEIA was held on 31st July & 1st of August 2010 at Indore. Besides regular units Allahabad, Lucknow, Kanpur and Nagpur attended this meeting. Patna , Pune and New Delhi requested for excuse as they could not attend the CEC meeting.

Chief Commissioner of Bhopal Zone Sri Ramprakash and Commissioner, Central Excise, Indore, Sri V.K.Verma inaugurated the open session. Com. T.K.R. Pillai Organising Secretary of Confederation of Central Government employees and workers was among the distinguished guests.

The following issues were discussed in the closed session:

  1. Restructuring & Removal of stagnation.
  2. Fixation of pay of Inspectors who have joined before 01.01.2006 on promotion or by direct recruitment.
  3. Anomaly in fixation of pay of 1992 batch inspectors
  4. Fixation of pre revised pay-scale from 01.01.1996
  5. Grade Pay of Rs. 5400/- to the inspectors who have completed 4 years in the grade pay of 4800/-
  6. Grant of proper equipment and maintenance allowance for three sets of uniforms for personnel in customs and abolition of the same in Central Excise and Service –Tax.
  7. GST.
  8. Meeting Of The Anomaly Committee
  9. Rule 9. Of CCS (RP) rules. Date of next increment
  10. Compassionate Appointment
  11. Organisational Front
  12. Modification Of Constitution
  13. Association Fund
  14. Performance and assessment of the branches/circles:

  17. Organisational action programme on various unresolved points
  18. Central Government Employees Strike Action on 7th of September.
  19. High Handedness of the concerned authorities in different Zones of different part of the Country

Decisions arrived at are given below:

Responding to the Call of the Confederation, Association shall serve its notice for the Strike action likely to be held on 7th of September, 2010. All the circles and branches are hereby requested to organize massive campaign for the strike, simultaneously campaign for our agitation programme shall continue. Where Strike is not possible we may organize demonstrative programme on the date of strike i.e. on 7th of September, 2010.

Association was involved with the case of WPCT 261/2008 from the very first day. We have narrated in our ATR the reasons as to why we were unable to implead ourselves in the case. In fact Authorities in West Bengal tried their level best to lift the stay order but unfortunately the case was heard and as per the out come we have to wait for some more days. The CEC decided to implead in the case in order to modify the stay. However, at this point of time it may not be feasible to implead ourselves in the case as the same is posted for final disposal. Still, as per decision, we shall consult lawyers and shall implead ourselves in the case if situation permits.

CEC decided to go for combined movement with the other Cadre Associations in the Revenue Department and to form a Joint Action Committee along with the Superintendent Association in our department.

CEC applauded the efforts of Sri Hemant Kumar Ghoshal and Sri Ajit Kumar K.G. and M.P. Chattishgarh Circle for considerable contribution and special effort for spreading the Association within the region.

As decided in the meeting we shall write letters to the general secretary’s of different branches and Circles to submit their dues DDO certificates within August 31st and if the time is too short they can be given another months time on request; after this we shall write to Chief Commissioner of that particular zone about the status of the Association running there and for the non-responsive units it will be intimated to the concerned authority that they have no connection with the only recognized Association i.e. AICEIA.

Our Ex President wrote a letter to chairman to derecognize our Association and simultaneously applied for recognition of another Association. He asked Board to give the original name of AICEIA to his Association in case Board derecognizes our Association; this off-putting activity of some of our members is to be stopped immediately because this type of anti Association activities destroys the unity and good name of the Association. It was decided in the Indore CEC meeting that the members who are indulging in this type of conduct should be expelled from the Association after serving a show cause notice within a week of issuance of this circular. The office bearers shall discuss the reply (may be over phone, e-media etc) and after discussion final expulsion from the Association should be effected within not more than one month from the date of this CEC.

From 25th August 2010 we shall start our agitation Programme. On that date we would organize a lunch hour demonstration programme followed by black badge wearing from 30th Aug 2010 to 3rd September 2010, and a lunch hour Dharna Programme on 3rd September in front of Every Chief Commissioner’s office. Massive campaign programme in every Branch / Circle should be conducted from 3rd to 14th of September, a whole day Dharna Programme is to be organized in every Chief Commissioner’s office on 15th of September. Mean while we shall participate in the Strike Programme convened by National JCA & Confederation of Central Government Employees and in those Branches/ circles. Where Strike is not possible a sit –in demonstration can be organized.

Charter of Demand:

  1. Notional fixation of pay of Inspectors of Central Excise in the pre-revised scale of Rs. 6500-10500 with effect from 01.01.1996.
  2. The ongoing cadre restructuring exercise to cater to the aspirations of Group B executive cadres and to be finalized after formal and recorded consultation with the Association. Restructuring should be completed within December 2010.
  3. Inspectors next promotional grade pay should be Rs. 5400/- .
  4. Abolish Control Room duty and Uniform in Central Excise and Service Tax.
  5. Fixation of minimum pay corresponding to pre-revised scale of Rs. 7450-11500 consequent to up-gradation ordered on 13.11.2009.
  6. Anomaly in pay of 1992 batch Inspectors who received ACP prior to 20.04.2004.
  7. The 1% incentive on incremental revenue should be utilized for providing facilities and infrastructure for lower level staff also.
  8. Lift the ban on ICT
  9. J.C.M should be conducted in Board and at local level regularly at periodic intervals.

To strengthen the Association Fund It is decided that a collection @ RS. 100/- will be made towards Associations and is to be submitted to the Association by 15th of September.

The agitation programme is welcome. However, the demand for notional fixation exposes our weakness and lack of determination. It is unfortunate that we are aspiring for notional fixation of higher pay from 1996 instead of actual fixation from 1986. I still feel that legal measures can be taken to win our case as we have got a very strong case.

For abolition of uniform, we need not make any request to the Board. The Central Information Commissioner had categorically stated that there are no written instructions available to require the Executive officers to be in uniform. In the absence of any written instructions/guidelines, why should we bother about the oral instructions. In karnataka, the superintendents Association had categorically informed the Department that the officers should not be required to wear uniform. In some other parts of the country also, bold officers refuse to wear the uniform. The matter is as simple as that and there is no need for any demand. AICEIA should simply inform the Administration that their members will refuse to wear the uniform.

On the issue of not wearing uniforms, when it is categorically reported by the Central Information Commissioner that there is no written instructions to wear uniform. Why the Block Association Bodies, regional association bodies are not writing their respective Chief Commissioner in this regard and motivating/issuing instruction/notifications not wear uniform by all the executive officers. This should be done by all the regional and block association bodies at the earliest.

sir,
in the postal dept the cadre of gp c resturucting committee has been appointed with members( office bearers of staff assn) from the staff side also as members. why not we also demand that staff side be made members of the such committee. this will ensure they can not simply make cadre resturcting for the by irs ,for the irs , benefiting only irs.

There is no point in writing letters, visiting Board's Office, talking to people who are having deaf ears and to people who do not want to do anything. Why can't the association give wide publicity to all our genuine grievances thro' media, press and other means so that atleast the top level Ministers including the prime minister is aware of our problem and try to solve it. What is the point in sending reminders and waiting for action from powerless persons who wish to take care of themselves rather than taking us along with them. If the association is serious about our demands they should think on an agitational option and give wide publicity to all our grievances. otherwise we will get only peanuts or rather not get anything. This is thr right time as once GST is implemented we will not be in a position to get anything. So Think and act. The entire workforce is with the association. Why can't the association take with them the persons in the 2nd association also and tell them to cooperate. Without unity it is very easy for the board to break our cadre and enjoy for themselves.

The suggestions of comrades monkey and manoj are wonderful. Comrade Bharath's view on wearing uniform is also great. The unfortunate situation is that Board has got deaf ears and Association leaders are dumb.

Repeated advertisements in the media, though expensive, would expose our masters. Legal battle is yet another chance for winning our case.

In spite of all these opinions in the Blog, why Association leadership is hesitant to express its views?

Our legitimate demands which are delayed/discarded by the CBEC and Central Govt. without any justification,assining any valid judicious reasons and parity with the Income Tax Deptt., NCB and other such institutions within the same deptt. of Revenue and with the CBI and other such institutions, organizations under the Central Govt. is clearly treating equals differently, treating equals on different parameters which is not permissible under our supreme law THE CONSTITUTION OF INDIA. It should be advertised in all big national dailes and electronic media also. Why should not we call Guinese Book record keepers and Limca Book Record keepers for creating a very big record many ahead of any other cadre in Central Govt. for stagnation in the Inspector Cadre. It should be done very urgently to attract attention of Central Govt. and quick action in this regard. How are u feeling other comrades on above issues?
