25th August first day of agitation

First day of our agitation was very very successful through out the country, in a word we can say that Inspectors of Central excise participated in the tiffin time demonstration programme through out the country barring a few places. We request all the Inspectors to participate in the next series of programmes so that we shall be able to maintain a pressure on the Government. As information received the restructuring exercise is moving very very fast, hope the Kolkata high court case may also get some solution by the end of this week. PRESS RELEASE

The Inspectors of Central Excise all over the country is embarking on the path of agitation from today under the banner of All India Central Excise Inspectors’ Association, the only recognized association representing the cadre. Notice of the agitation was served on the Chairman, Central Board of Excise & Customs on 9th August 2010. The agitation is being organized due to the apathy of the authorities in addressing grievances of the cadre like

1. lack of promotional avenues, Inspectors’ should get at least three functional promotion in service life while they are getting only one promotion.

2. Notional fixation of pay of Inspectors of Central Excise in the pre-revised scale of Rs. 6500-10500 should be provided with effect from 01.01.1996.

3. Fixation of minimum pay corresponding to pre-revised scale of Rs. 7450-11500 consequent to revision of grade-pay ordered on 13.11.2009.

4. Anomaly in pay of 1992 batch Inspectors who received ACP prior to 21.04.2004.

5. Inspectors’ next promotional Grade Pay should be Rs. 5400/-

6. Lifting of ban on ICT

7. JCM s should be conducted at the Board level and at local level at regular intervals.

8. abolition of control room duties that causes unnecessary drain on manpower

9. The 1% incentive on incremental revenue should be utilized for providing facilities and infrastructure for lower level staffs also.

The agitation would commence with lunch hour demonstrations on 25.08.2010 followed by black badge wearing from 30.08.2010 to 03.09.2010, lunch hour dharna on 03.09.2010 and whole day dharna before all Chief Commissioner’s office on 15.09.2010.

The Association informs that in case the authorities do not heed to the requests even after these programs, the second phase of agitation would be launched culminating in strike of work.

Whether agitation programmes are also for Association members of Rajasthan Circle unit as there is no communication from key post holders of the unit for the Inspectors posted at various places of Rajasthan ?

The constitution of India is supreme to the judiciary. Right to promotion is a fundamental right of every Govt. servant. This view has also been held by the Hon'ble Apex Court in its recent Judgement. There is no point in waiting every friday for the Calcutta High Court to grant relief as every hope has been lost. JUSTICE DELAYED IS JUSTICE DENIED. We THE MEMBERS pray to the Hon'ble CBEC Chairman to please order Ad-hoc promotions in the cadre of Inspectors without waiting for the outcome of the happenings/decisions of Fridays. It will a great morale boost to the stagnating cadre and also it will ensure that the fundamental right enshrined in the constitution is also protected.

Any idea how the verdict of Kolkatta will impact the officers at all levels? Is reservation for promotion is in accordance with the constitution? Reservation for initial appointment is understandable. Is reservation for promotion against Article 14 of the constitution? What is the crux of Supreme Court verdicts on the subject matter? Who can make a scientific study on this issue?

We should all ensure that the law of the land is rightly interpreted.

JUSTICE DELAYED IS JUSTICE DENIED. AFTER ISSUE OF O.M.DATED 10.08.2010 BY THE DOPT AND ALSO WHEN DOPT ITSELF STARTED PROCESS TO IMPLEMENT DECISION IN THE CASE OF SABHARWAL FROM 1995 BY SEEKING ADVICE FROM ATTORNEY .... THERE IS NO SCOPE FOR INTERVENTION BY ANY COURT. .. ALSO OM OF 1988 CLEARLY STATES FOR ADHOC PROMOTIONS DURING INJUCTION/STAY BY COURT IT APPEARS NON-WILLINGNESS OF THE CBEC. FAILURE OF CBEC TO ORDER ADHOC PROMOTION DURING INJUCTION/STAY . OM OF 1988 IS VERY CLEAR.... IT IS MY GREAT INDIA. .. WHERE NO BODY TAKING PAIN FOR INSP./SUPDT. CADRE OF CENTRAL EXCISE. & CUSTOMS... Mr. Koneru Rao Prabhakar of ICESTEA has written atleast two letters one dated 14.6.2010 and another dated 15.7.2010 requesting Hon,ble CBEC Chairman to order Adhoc promotions in view of injunction of Kolkata High Court. There also appears reference to adhoc promotion to the grade of Commissioner as per OM dated 30.3.1988. Fate of these letters is known as no instruction in this regard has been issued by CBEC to field formations.

Can President or SG AICEIA place on blog any letter or communication to CBEC to order adhoc promotions.

Why no such agenda is taken up in the current agitational programme.

Dear Surya and Singh,I am more than convinced that the CBEC is callous,its of no use to request them they are more concerned about the welfare of trade and industry as though we were lesser citizens and that the President and the SG of AICEIA have not taken up this issue in the current agitational proggramme is disgusting indeed.

IF THE KOLKATTA HC LIFTS the STAY IT WOULD BE HUNKY DORY.
OTHERWISE WE/THE NATIONAL ASSOCIATION SHOULD KEEP WRITING TO THE CBEC CHARIMAIN TO ISSUE DIRECTIVES TO ALL CCAs TO ISSUE ADHOC PROMOTION EACH WEEK.

AFTER ALL FATE OF 1000 OF INSPECTORS ALL OVER INDIAN IS AFFECTED AND WAITING FOR EVERY FRIDAY IN THE HOPE OF THE K HC WIIL DISPOSE OFF MATTER and do justice IS REALLY DENTING THE MORALE OF THE OFFICERS WHO HAVE BEEN KEENLY WAITING FOR THEIR FIRST PROMOTION IN THE DEPTT FOR ALMOST 17/22 YEARS.

There should be no comments as shouted by Rajaguru like asking the very fundemental question "Is reservation for promotion is in accordance with the constitution?"

Just go through the Constitution of India and then place your shouts.

Do you mean to say or claim you are more than Hon.Supreme Court, High Court and CAT or more clever than DOPT etc?

It shows your ludicrous understanding of the Constitution of India.

If you require pl tell i will supply all the relavnt documents pertaining to the Reservation matters and i request not to bluff any more rather study the ground situation and post your shout.


Further the Association is for all. All including SC and ST are paying the subscription and also been counted for getting recognition. Do bear that also in your mind.

The need of the hour is to gradually reduce the percentage of reservations and exclude the creamy layer in SC ST at par with OBC to have a self reliant, dynamic, progressive and powerful India.

The gradual reduction in reservations was the original mandate of the makers of constitution. Thats why it is renewed after every ten years.

Lets HOPE that RESERVATIONS WILL END SOME DAY.

Till then, bear the catastrophic dooms of the follies of the caste based politics.

You just have holy dip wherein the caste discrimination will end.

I feel the mandal days being brought back by some Inspectors. Dont be caste based or try to ill-treat the SC/ST officers. If they started to retreat nobody will be anywhere.

Just understand. Creamy layer etc were discussed in length and breadth by our policiticians and judicioury forum.Let our Inspector Community need not talk again about that. If started means it will ruin the working atmosphere and would be abhorrent to the situation.

So do limit your words and suggestions

Your suggestions were defeated during the regim of V.P.Singh itself in the mandal commission report.

Dont try to re-open, of course, you can do nothing.

Why all of you are so adamant or arrogant towards the reserved category?

Let's try to move towards a casteless society where no discrimination can be made on the basis of caste alone, as is being done, on the pretext of Reservation, Religious symbols, Sacred thread, traditional attires for a particular community etc.,. When we want to progress further, we should realise that everyone should earn the same respect which is due to a human being. All this bickering and fight about the caste, reservation etc., is really nauseating..,

Dear friends,

Patience is golden; the stay stands ultimately vacated; the reservations are legal and proper though the mechanism needs some improvements so that only the really deserving benefit from it and not the ones who are affluent among the reserved categories, which is the case now-a-days. However, we must respect the policies as long as they exist in law, and such policies needs be implemented in letter and spirit.

It is true that the depressed classes of our society have been opressed for hundreds and thousands of years; but at the same time, the reverse oppression should be stopped or atleast mitigated as far as possible.

In the Departments, we are all colleagues; no particular category, either general or reserved, have monopoly over merit; rather all virtuous like sincerity, honesty, intelligence, beauty and so on.

So the needs of hour is to stay united; fight for betterment of our cadre.

This is a time to congratulate our colleagues, who were feeling demoralized due to stay on promotion after long and painful stagnation of around 20 years.

Let God bestow the authorities with a sense of magnanimity to remove stagnation in the upcoming restructuring exercise.

DEAR MR RAM
Dont you think that the order dated 10th of August is also incorrect. The Board has issued it against the land of the law, against constitution. In the Saberwal case it has been categorically clarified that the order will have prospective effect from the date of pronouncement of judgement i.e from 1995. But Board after much dilly dallying passed an ambitious order in 1997 wherein it was stated that that the Saberwal case should be followed, NO SPECIFIC DATE WAS MENTIONED. Since the dopt oder was issued on 1997 all the CCA Zones started it to implement from 1997, dont you think the demand from 1995 is justified. WAITING FOR YOU PRECIOUS COMMENTS.
