Dear Comrades,

The National Executive of the Confederation met today as scheduled; discussed the steps to be taken to ensure large participation of Central Government employees in the impending strike action of 7^thSeptember, 2010 organised by the joint platform of Central Trade Unions and Federations of employees and took the following decisions.

(1) To organise joint conventions at all State Capitals and other important places under the auspices of the State Units of Confederation, AISGEF and AIDEF. The tentative dates on which the conventions will take place at different places are indicated in the joint communication, copy of which is enclosed;

(2) The charter of demands on which the Strike will be organised is enclosed. (The suggestions made by the participants and accepted at the meeting arte incorporated)

(3) The Confederation will serve the strike notice on 12^th inst. And all affiliates and their units are requested to serve the strike notices on their respective of Heads of Department/Office by 20^th inst. (Copy of the strike notice will be placed at the Website on 13^th.)

(4) The affiliates may add as an annexure described as Part II demands which are department specific and which are pending settlement for a long time.

(5) The State Committees and affiliates will chalk out campaign programme to cover the districts and other regions.

(6) The Confederation CHQ will prepare campaign material in the form of brief note on each of the demands in the charter and place the same on its website.

(7) Demonstrations will be organised at all State Capitals and other regional centres jointly by all participating affiliates on 6^th September, 2010 and the members advised to participate in the joint rally organised on the same day by the Central Trade Unions.

(8) The Confederation and its affiliates will participate in the March to Parliament programmes organised by the Central Trade Unions after the strike in pursuance of the acceptance of the demands by the Government.

(9) Confederation will take independent initiative in organising campaign and action programmes in pursuance of the common issues of the Central Government employees after the strike action.

(10)The Confederation CHQ will ensure that the Dharna programme decided upon earlier to protest against the vindictive actions in the IA & AD Department is staged in those State Capitals, which could not be organised on 5^th. The National leaders will go over to such State Capitals along with the National leaders of the All India audit and Accounts Association.

(11)The affiliates will make the subscription dues pertaining to the F.Y. 2009-10 immediately.

(12)The Nationals Council of the Confederation will be held at Mumbai in December, 2010.

( General Secretary ) and Sri Hemant Kumar Ghoshal (Joint Secretary AICEIA) The 3rd Central Executive Committee meeting of AICEIA was held on 31st July & 1st of August 2010 at Indore. Besides regular units Allahabad, Lucknow, Kanpur and Nagpur attended this meeting. Patna , Pune and New Delhi requested for excuse as they could not attend the CEC meeting. Chief Commissioner of Bhopal Zone Sri Ramprakash and Commissioner, Central Excise, Indore, Sri V.K.Verma inaugurated the open session. Com. T.K.R. The following issues were discussed in the closed session: Restructuring & Removal of stagnation. Fixation of pay of Inspectors who have joined before 01.01.2006 on promotion or by direct recruitment. Anomaly in fixation of pay of 1992 batch inspectors Fixation of pre revised pay-scale from 01.01.1996 Grade Pay of Rs. 5400/- to the inspectors who have completed 4 years in the grade pay of 4800/- Grant of proper equipment and maintenance allowance for three sets of uniforms for personnel in customs and abolition of the same in Central Excise and Service –Tax. Association was involved with the case of WPCT 261/2008 from the very first day. We have narrated in our ATR the reasons as to why we were unable to implead ourselves in the case. In fact Authorities in West Bengal tried their level best to lift the stay order but unfortunately the case was heard and as per the out come we have to wait for some more days. The CEC decided to implead in the case in order to modify the stay. However, at this point of time it may not be feasible to implead ourselves in the case as the same is posted for final disposal. Still, as per decision, we shall consult lawyers and shall implead ourselves in the case if situation permits. CEC decided to go for combined movement with the other Cadre Associations in the Revenue Department and to form a Joint Action Committee along with the Superintendent Association in our department. CEC applauded the efforts of Sri Hemant Kumar Ghoshal and Sri Ajit Kumar K.G. and M.P. Chattishgarh Circle for considerable contribution and special effort for spreading the Association within the region. As decided in the meeting we shall write letters to the general secretary’s of different branches and Circles to submit their dues DDO certificates within August 31st and if the time is too short they can be given another months time on request; after this we shall write to Chief Commissioner of that particular zone about the status of the Association running there and for the non-responsive units it will be intimated to the concerned authority that they have no connection with the only recognized Association i.e. AICEIA. Our Ex President wrote a letter to chairman to derecognize our Association and simultaneously applied for recognition of another Association. He asked Board to give the original name of AICEIA to his Association in case Board derecognizes our Association; this off-putting activity of some of our members is to be stopped immediately because this type of anti Association activities destroys the unity and good name of the Association. It was decided in the Indore CEC meeting that the members who are indulging in this type of conduct should be expelled from the Association after serving a show cause notice within a week of issuance of this circular. The office bearers shall discuss the reply (may be over phone, e-media etc) and after discussion final expulsion from the Association should be effected within not more than one month from the date of this CEC. From 25th August 2010 we shall start our agitation Programme. On that date we would organize a lunch hour demonstration programme followed by black badge wearing from 30th Aug 2010 to 3rd September 2010, and a lunch hour Dharna Programme on 3rd September in front of Every Chief Commissioner’s office. Massive campaign programme in every Branch / Circle should be conducted from 3rd to 14th of September, a whole day Dharna Programme is to be organized in every Chief Commissioner’s office on 15th of September. Mean while we shall participate in the Strike Programme convened by National JCA & Confederation of Central Government Employees and in those Branches/ circles. Where Strike is not possible a sit –in demonstration can be organized.

Charter of Demand: Notional fixation of pay of Inspectors of Central Excise in the pre-revised scale of Rs. 6500-10500 with effect from 01.01.1996. The ongoing cadre restructuring exercise to cater to the aspirations of Group B executive cadres and to be finalized after formal and recorded consultation with the Association. Restructuring should be completed within December 2010. Inspectors next promotional grade pay should be Rs. 5400/- . Abolish Control Room duty and Uniform in Central Excise and Service Tax. Fixation of minimum pay corresponding to pre-revised scale of Rs. 7450-11500 consequent to up-gradation ordered on 13.11.2009. Anomaly in pay of 1992 batch Inspectors who received ACP prior to 20.04.2004. The 1% incentive on incremental revenue should be utilized for providing facilities and infrastructure for lower level staff also. Lift the ban on ICT J.C.M should be conducted in Board and at local level regularly at periodic intervals. To strengthen the Association Fund It is decided that a collection @ RS. 100/- will be made towards Associations and is to be submitted to the Association by 15th of September. The Central Executive Committee meeting of this Association held on 31^st July and 1^st August 2010 at Indore has decided to launch an organizational action programme owing to the inaction of the Board in acceding to the demands of this Association. The Charter of Demands on which the agitation is proposed to be held is as follows:

1. The ongoing cadre restructuring exercise to cater to the aspirations of Group B executive cadres and to be finalized after formal and recorded consultation with the Association.

Kindly take note that the member of this Association would commence the organizational action programme as per the following schedule.

1. 25^th August 2010 : Lunch hour demonstration programme

2. Black badge wearing from 30^th Aug 2010 to 3^rd September 2010,

3. Lunch hour Dharna Programme on 3^rd September in front of every Chief Commissioner’s office.

4. A whole day Dharna Programme is to be organized in every Chief Commissioner’s office on 15^th of September.

In case the demands are not met even after these measures, we would be serving a notice to strike work.

Return visit to Board

While returning back from Indore we met Member C.Ex, as informed by him everything is running very fast, it was informed to us that HRM is likely to complete the resrtucturing proposal by next week, distribution of GST Commissionerates shall be after the restructuring of the department, we have raised the issue of Chandigarh once again infront of him and intimated him that the Association has decided to go all out against the atrocity shown by some of the authorities in some parts of this country.
Immediately after we met the officials of ADG (HRM)'s office nad understood that this report for restructuring is complete from HRM's side waiting for presentation in the Board, it was again assured that inspectors who joined 12 years back have a fair chance of getting their first promotion by this restructuring, it may not be equal in every zone but HRM prepared the report keeping in mind the acute stagnation of Inspector and Superintendent.
We are trying our level best for creation of a JCA, as discussed with Secy Genl of Minsterial Association we are moving forward for the creation of JCA before completion of restructuring process.
We would like to inform our member that FM has not yet gone through thre restruring proposal, even Revenue Secretary has not yet been intimated about the proposal. we have chalked out no of organisational action programme that will be intimated to you shortly

Kolkata High Court Case

CASE NO. 261/2008 LISTED on 30.07.2010 AT SL. NO. 8 IN THE CALCUTTA HIGH COURT DIVISION BENCH- CONSISTING OF JUSTICE PRATAP KUMAR RAY AND MRINAL KANTI SINHA AT 02.52 P.M.

Additional Solicitor General- Pleaded for revocation of Injunction order on ground of submission of Supplementary Affidevit along with revised Roster of Officers.
Judge Shri Pratap Kumar Ray appeared quite impressed and concerned to the points like (i) some of the officers are retiring or going to retire without their due promotion (ii) those whose promotion is due are for no fault harressed due to the delay in promotion on ground of Injunction Order.
But at this point a new lawyer from Samiron Roy & Others side stood up and have put forward two points
1. THE Department is not following the courts order of giving effects of Supreme Court Judgement In R.K.Sabharwal Case From 1995, instead they created a new year 2002 and prepared the Revised Roster.
2. The appellant won this case in Tribunal and in Madras High Court on same Issue.
and completed their Hearing.
At this Juncture The Judge told the ASG to immediately prepare the revised Roster from 1995 and submit within a week and then in that Hearing The Case will be desposed of.

IN OUR INDORE CEC WE HAVE REQUESTED OUR BRANCH AND CIRCLE SECRETARIES TO EXPEDITE THE PREPARATION OF REVISED ROASTER , KOLKATA UNIT SHALL TRY TO APPEAL FOR EARLY SOLUTION OF THE CASE.

AICEIA MET REVENUE SECRETARY AND CHAIRMAN ON29.07.2010

Before reaching to Indore we stopped at New Delhi for a couple of days; these two days emerged as one of our many productive days. On 29th July 2010 at 2.15 P.M. ,met Chairman C.B.E.C. the agenda for discussion is placed underneath:
· Kolkata High Court case and role to be played by the Board
· Restructuring and the Inspectors future
· Fixation of revised pay in the 7450/- pay scale
· MACP for promote officers
Intimated him that we are going to meet Revenue Secretary in the evening at 6.00 to narrate the RTI findings collected and permeated by Pune Genl. Secy.
The discussions held will be intimated to all the delegates of Indore CEC.
In the Evening we met Revenue Secretary Sri Sunil Mitra, at 6.00 ‘o’ clock; initially we were allowed for five ( 5) minutes, but as soon as we have started narrating
· stagnation of the cadre and
· notional fixation
We got good response from Revenue Secretary and the meeting continued for nearly half an hour; we have submitted the findings of the RTI reply on our claim for notional fixation from 01.01.1996 and requested RS to take some personal initiative to resolve this long pending issue. During discussion we repeatedly mentioned that Department of revenue always felt that it is a right demand from our side but this is only department of expenditure who is denying the justice to this most deprived servants of Govt of India.
The most appreciable part of this meeting is the role of Sri Abhay Singh Shekhawat,Joint Secy (North), who rushed to Delhi receiving a single call from S.G. and not only accompanied S.G. but also participated in the discussion with Chairman and with Revenue Secretary. General Secretary Delhi Circle was also present in the delegation which met Chairman.
Possibly it is known to you all that the Kolkata High Court Case is coming up today once again, unfortunately today also our case listed at point no. 8 in the appellate side, let us hope for the best. All the CEC members through out the country are once again requested to come to Indore CEC meeting positively as this is going to be one of the crucial CEC meeting before Convention, restructuring.
