latest on 5400

The file regarding allowing of 5400 GP to ACP Inspectors after 4 years in 7500 has been referred to expenditure by the board. As on date the file is lying with expenditure.

First the issue has to be decided by DOPT and then only expenditure saction is required. Referreing the matter straitaway to expenditure is equivalent to a stone dropped in the well.

Mr Balaji has rightly said it.If the Government wants to delay or deny an issue, they will constitute a Sectretary Level Committee for analysis and report and the same way, if the Board wants to deny a benefit to its employees, it will refer it to Expenditure. Appreciable Style of functioning.

I think they will send the file to Ministry of Law and Justice to get opinion on filing an SLP against the Hon'ble HC's order. If they are not able to get approval to file SLP then they will seek to file a review petition. If that also fails then they would send to expenditure for their opinion.

It is only the reaction and openion of the members. At least we must feel happy that that some members are able to give their openion within their knoledge.So we must welcome all to give their valuable views and suggestions so that our leaders can take some decision on the issue taking all the views expressed by the members.

Dear MJ,
I have commented on lighter vein only. But it is general knowledge, that whenever Government want file an SLP or a Review Petition, they will and in this case most probably might have referred to Addl. Sol. General for his comments/opinion. No one in government would directly implement a Court's Judgement without trying to seek recourse by way of appeal etc.,

The observation of mani is right. This is the procedure till date we observe in all legitation matter.

why should it be referred to the expenditure by the board, the doe, mof, GOI, vide order dated 29/8/2008 have already given clarification that grade pay of Rs. 5400 should be granted after a periood of four years regular service in the GP of Rs. 4800/-. The Board should only implement the earlier clarification of the MOE

The fact that the issue has been referred to Dept of Exp does not mean that an appeal is not being filed in the Supreme Court. It is obvious that even our legitimate dues will not be granted citing the Dept of Expenditure

We have seen the Board is not abiding by the judgements of Court or Tribunal in the past - Take for example CBI pay scale arrears from 2000-1986/6500-1996 and it is given w.e.f. 2004 even the Cuttack CAT by 180/2006 directed to consider. The Jabalpur CAT by 45/2000 remarked that denial of pay scale of CBI to the Inspectors of Central Excise & Customs from 1986/1996 is violative of Article 14 & 16 of Constitution of India. Even another Jabbalpur CAT order 541/94 directed to pay the Arrears. Chennai High court order is also going to have the same fate like earlier CAT orders in case of 5400 grade pay to ACP Inspectoers. Why the appellant does not go further for contempt of court case against the Under Secretary to Govt. of India?

Our country's economic position have increased manyfolds and now the Deptt. of expenditure can not provide the reason that they are running sort of money and can not give legitimate rights to the ACP Inspectors. We have worked hard and struggled from the day when India's economic position was very bad and was in begging bowls in 1991. Any body can not go for contempt of court case only the appellant has to go further and if he wants some contribution we are ready to provide the same to him to fight for a common and greater interest cause.
