Dear Comrades,

I take this opportunity to wish you Merry Christmas and a Happy & prosperous New Year 2011.

Let us all pray that the New Year should bring the best for all of us.

Confederation convened a national executive meeting in Mumbai on 1st December 2010 our Vice President (South) and President Chennai Circle attended the meeting. The meeting had discussed of the need to make the Workers march to Parliament programme slated for 23rd Feb. 2011 a grand success by eliciting the participation of large number of employees and workers.   We have to discuss the issue in our C.E.C meeting and have to take the decision to mobilise large number of our members in the march. 
        
 As discussed in Indore CEC the All India Association struggled hard to form a Joint Action committee at the apex level to fight out several atrocities unleashed by the Government as well as our department from time to time.
A meeting of different recognized Associations of CBEC was held in Kolkata on 31.10.2010.  We are sorry to say that, this time also we could not catch hold of Superintendent Associations’ hand inspite of the fact that this Central Excise Gazetted Officers Association decided in their Association to include themselves in the Departmental Joint Action Committee.

         Now, it is well-known to you all that at the behest of Revenue Secretary, a meeting was convened at Member (P&V)’s chamber on 10th of November 2010 and after a brief dithering the cadre restructuring proposal was handed over to the Joint Action Committee and all other cadre associations as well. On 25th of November, 2010 Joint Action Committee submitted its cadre wise reaction on the draft proposal. On 16th of December, 2010 all the Associations of Central Excise met Chairman at New Delhi, wherein it was assured by the Chairman that the cadre Associations will be called again and CBEC is trying to rectify the proposal taking into consideration representations given by the cadre Associations. It was assured to the representatives of our Association that a solution for regional disparity would be arrived and Associations shall get another opportunity to discuss over the subject.

        On 15th instant we met Member (P&V) and discussed over the following:
·        Chennai High Court case on NFSG
·        Cadre Restructuring
·        ICT

We requested Member (P&V) not to go for appeal/ review application. In this regard, it was intimated that the file sent to Expenditure and it will be taken care of as and when it comes back form Expenditure. In the mean time we have enquired about the said subject in Expenditure and apprehension is there that Expenditure may go for S.L.P in Supreme Court. Hence it is decided that the Association would help the individual in filing CAVEAT and shall try to engage senior counsel in this regard. Hence, legal fund is utmost necessary. Accordingly, units are requested to contribute to this legal fund generously and quota for this legal fund would be intimated very soon.

16th Convention of AICEIA could not be held now for (require) indecision of venue & fund (unwillingness from different zones) and for the point raised by various Branches and Circles to extend the tenure of the present committee for few more months as per Article 14 sub clause (i) of our Constitution in order to complete the ensuing cadre restructuring and few more burning issues which are on the card. Hence, All India Association is going to organise its 4th CEC at New Delhi.

The Central Executive Committee of AICEIA is scheduled to meet at Banga Sanksriti Sadan, Muktadhara, New Delhi on On 5th of February 2011, The copy of the notice of the said meeting follows. All Branches and Circles are requested to kindly make it convenient to send delegates/Office Bearers for the meeting.

We sincerely hope that we will be able to make up for the organisational weakness suffered by our cadre for the past few years and meaningfully proceed on matters concerning the cadre and department.

         I request the recipients of this Circular to kindly circulate it widely so that it reaches every one concerned. It is requested that this may kindly be taken as a personal invitation on behalf of the Cadre.

          Units which are not participating in our CEC meetings and not communicating with us regarding their subscription due to the All India Association will be declared non-members after the decision of the CEC, New Delhi.
            All the units have to reach New Delhi by 4th of February 2011 as the meeting will be for a single day from 9.00 A.M. to 6.00 P.M. We express regret for the fact that the cost for food and lodging has to be borne by the individual Associations; we are going to book a Hotel room near the venue and that will be intimated in due time. Units willing to stay with All India Association may intimate us in advance.
           Once again hoping that representatives from all over India will meet at the CEC on 5th of February and take important decisions and implement them in a decisive manner

My dear Secretary General it appears that u have resigned to fate with regard to cadre restructuring which is only being done to promote the existing Commissioner to the rank of Chief Commissioner and the Addl. Commissioners of 18 years service to the rank of Commissioner. This cadre restructuring if done in the present form will push us backward instead of giving any forward movement. Instead of going to the Board with begging Bowl, maintain some diginity and fight for the cause. If u cann't fight then after completion of tenure please step down. Don't sell the interests of the cadre. If u introspect u can visualise what am I writing. We from Chandigarh Zone will try to contribute for the G.P. of 5400 as and when asked by Sh. Subramaniam. But if the association is not having any funds then it means we are wasting the money contributed by the cadre for air travel, luxurious hotels and phone. Please fight for the cause. Atleast show the cadre what have u achieved in your tenure except GP of 4600/-. On all other fronts we as association has failed. Either perform or perish.

Dear Circle Secy. Chandigarh, my question was not intended for u. As a constituent of AICEIA, I have every right to question my leaders, so it would have been better had the Hon'ble Secy General had responded to my query. Because at my first interaction with the Secy Gen. at Chandigarh he informed us that the Supdt. will directly become Deputy Commissioner. What happenned to that proposal. He further promised us that GP of 5400/- will be granted. If in return what we are getting as gift from the Board is this restructuring proposal then I think it is not the Secy Gen. who has done something, he is just keeping mum and the Board is doing whatever suits them. I hope both of u have gone thru the restructuring proposal and even a dumb person can understand that Inspector cadre is being pushed to wall without any silver lining being shown to him. Secy Gen. Kindly spend a few minutes to apprise his cadre the achievements made by u. My dear friend after accepting cadre review proposal in the present form we shall retire as superintendent only. If u feel that it was ur promise and is ur achievement then u cann't rest in peace. Your goodself is betraying the cadre and acting against ur conscience.
I will request the Secy Gen. to respond please.
I shall also try to explain that the views of the Circle Secy Chd. are his views only and not of Chandigarh Zone. He can dismiss my views because the constitution gives him the power. But we all forget that the constitution derives it's strength from it's constituents who in the present case are Inspectors. If there are no constituent there is no constitution and no association. Don't betray the cadre, History will not forgive u

ARE YOU AWARE OF THE FACT THAT
1.CBEC was not inclined to circulate the cadre restructuring proposal report?
2.CBEC wanted one year time to revise the ratio for promotion to Group-A from the three feeder cadres so that all the postys as a result of cadre restructuring proposal would go to Customs Appraisers?
3.Some more back door work is being done to cheat the Central Excise men?
4.The central Excise officials, without any shame, will participate in the Excise Day celebrations?
The central Excise Inspectors and Superintendents will have to salute the Examiner promotees, who will be junior my two decades?

at the outset Merry Christmas and happy new Year.
That is what I want to emphasize. Even for getting a draft copy of the restructuring proposal the association had to approach the Revenue Secretary. It is the grace of the worthy Revenue Secretary that we got the copy the draft proposal. Otherwise the Board does not consider us worthy of seeing the draft proposal. Being Regd. Association isn't it imperative for the Board to solicit it's view, if not then there is no fun of having a regd. association. Most probably one fine morning the Hon'ble Board will announce the implementation of the restructuring proposal which has been done with the concurrence of the Regd. Associations. Then we will be left high and dry.We should not accept the proposal in the present form. Rather restructuring should be done in such a manner that the Inspectors should be promoted against the vacancies arising out of the promotion of Superintendents to Assistant Commissioner. If i have to rot for next 20 years as Superintendent then I don't mind rotting as Inspector for a few more years. Further more the Association must ensure that requisite staff strength is maintained at every post. i.e. if the restructuring proposal envisages that there will be 120 Inspectors in a Commissionerate against 80 Superintendent, then this ratio should be maintained right from the very beginning. Even as inspector, if I can visualize that there will be 40 Inspectors against the sanctioned strength of 120, then how come the IRS people who are responsible for the administration cann't visualise this.
Mr. Arun you belong to the land of Great Ayappan and Mr. Koushik you belong to the land of Vivekanand who is my adolescent age Hero, so come on lead the Cadre in a more fitting way.

At the outset I would like to say that with great struggle the copy of Cadre restructuring proposal was obtained only at the instance of our Sec. Gen. along with other Assns. Criticizing is good to some extent. But do not make it a practice. You should also give little encouragement to our leaders so that they can give their best. Give good suggestions, do not demoralise them by harsh language, after all they are human beings.Chandigarh Assn has very good reputation kindly maintain it.

Dear Shri. PV Raju,
Undoubtedly, you are a dynamic worker for the cause of Inspectors. There cannot be any second opinion, even amongst your worst critics.

But, what is the strategy adopted to win the honour for our cadre? Are you aware of the fact that Board was atrociously making the plea before the Apex court to give one year time for revising the ratio? This work will take a maximum of 10 minutes but the Board wants one year time besides loss of time in the past. How we had reacted to this situation?

Please give a call that Inspectors will not attend the Excise Day celebrations.Let similar call be given by the Federation of Supdts. We will also release a full page advt in the media when the Board celebrates Excise day.

Why should we be silent? Let the stand of the Association be pronounced.

With due regards and respect for the efficiency of Shri. PV Raju, I would like to state that my dear Raju should understand that the cadre will continue to ventilate their feelings (sometimes, it may be harsh, inevitably), if the Association leadership does not pronounce its stand categorically in a bold manner.

@Manoj: Well said. It is best to be frank and open rather than shower false praise. The report card of the present Assn Bearers is RED. A total let down for the entire cadre. So your views are justified.

If P.V.Raju and Co want encouragement and good words from the cadre, they should understand that the cadre in turn is looking for results. This entire year has been a very disappointing one. What have we gained?
Even the GP of 4600 was a sham. We should have demanded and got 4800 as the start GP for Inspectors, something that we in the West Zone were demanding. Then 5400 would have come in the first ACP and so on. With 4600, the first ACP gets GP of 4800 which is a gain of only 200. So much for the vision of the AICEIA!!

Cadre restructuring will be the biggest sham for the AICEIA. Mark my words! We will get nothing because we command no respect in the board. That is why we had to struggle to get a copy of the Cadre restructuring proposal as stated by Mr PV Raju himself above. An association commanding respect and fear would not have had to stoop so low. This was bound to happen with the present mentality of the AICEIA. Our leaders are in a virtual comatose. We do not know what is happening and the leadership prefers keeping quite in the name of maintaining dignity. But at what cost?

Things will change only if the AICEIA becomes pro-active. If we are able to think five steps ahead, we can deal a mighty blow to the Board who are anti Group B officers. It is time to start an open campaign so that the manipulators in the Board are exposed. Please start print media and press campaigns, even if it involves cost. It will be worth the effort rather than spending money on useless conventions. Highlight the injustice being done to the cadre. Cant the AICEIA leaders, most of whom are from W.B, get something on the ears of the FM who is also from the same state?

I hope the new year will bring something positive for the Inspectors of Central Excise. I also hope that after completing 18 years as an Inspr, I get to see a promotion soon and others in the cadre do not have to wait so long!

Long live HOPE! It is what keeps us going!

The Finance Minister has given you a lolly pop to effect restructuring by Dec 2010. Whether he has guts to sack the entire Board having failed to implement his directons or pass strictures against associated departments. What agenda has our Association.

It appears that we have spent all energies in getting the restructuring proposal. So now we are tired and rest till the restructuring actually happens. If it was so difficult to get the copy of proposal, then please explain what are we going to with it. In the words of Sec Gen. the Inspectors are CUTTING EDGE, at present they are being cut. Please understand that no body wants to criticise the other individual but if u can throw some light on the next course of action of the association, have we accepted the restructuring proposal, what is association doing on GP 5400 front, or is there any other agenda in the hands of association. I am also an active member of the association and when my fellow colleagues ask me about the course of action being adopted, I am speechless.This criticism is not by an individual who is aggressive and assertive but by a humble member who is tired and feels let down by his leaders. To sing song in praise of something which you feel has not been achieved is nothing but sycophancy. If u have any idea about the achievements of the association, kindly let everyone know about it but it should not be that draft restructuring proposal has been received. If u can give me details of any achievements other that GP 4600/- I promise on behalf of Chd. Zone that we will felicitate the top leadership of AICEIA.

In the end please keep in mind that üneasy lies the head that bears the crown. and one should keep this in mind before bearing the crown.

AT THIS JUNCTURE, THE LEADERSHIP SHOULD SPELL OUT THE ACTION PLAN.
THE ENTIRE FORCE OF INSPECTORS AND SUPERINTENDENTS SHOULD BOYCOTT EXCISE DAY FUNCTION AND RESIGN FROM ALL THE HONORARY POSITIONS INCLUDING PROTOCOL ACTIVITIES.

THE CADRE WILL DO THAT AND CREATE AN INDELIBLE IMPACT, IF THE LEADERSHIP MAKE A CALL TO THAT EFFECT. BESIDES, THE IMMEDIATE NECESSITY IS TO RELEASE A FULL PAGE ADVT IN THE PRESS TO POINT OUT THE INEFFICIENCY OF CBEC WITH REGARD TO CADRE MANAGEMENT.

While claiming credit for GP 4600/- let us not forget the Income Tax Federation who are the leaders. The income tax federation is very much part of their restructuring process while our association is struggling to even receive a copy of the restructuring proposal. The income tax federation is not going to help us in our restructuring. So, we must not expect something big unless we take care of ourselves.

IT APPEARS THAT THE OFFICE BEARERS OF AICEIA ARE EITHER UNDER UNDUE COERCION OR HAVE STRUCK A DEAL WITH THE CBEC WHICH THEY DO NOT INTEND TO COMMUNICATE AT THE MOMENT

Dear all,

The eagerness of the cadre to know about the cadre review is quite understandable. However, like all Government Departments, it takes a while for things to move in the right direction. So is the case here too.. Nothing has been finalised as yet.

As per the blog of the Ministerial Association, the News is that the Office bearers of all Associations had met the Chairman on 16.12.2010 wherein basically the issue of cadre restructuring and other issues came up for discussion.

In the said meeting the chairman has given an assurance to the Associations that the points raised in their respective submissions/ representations will be looked into, and another opportunity will be given to the Associations i.e., a meeting will be called by the Board before finalising the cadre restructuring proposal.

Patience is a virtue, and hence i would only state that let us be patient but at the same time be watchful as well..

WISH YOU ALL A VERY HAPPY AND WONDERFUL NEW YEAR 2011...

One thing is sure. The curse of the cadre of Inspector and Superintendent is the policy making IRS Officers. So Why there should be an IRS body at the apex to make decisions. SO......

(1)Demand for the demolition of CBEC manned by IRS and ask for a BOARD manned by IAS. (Take the help of IAS loby).
(2)Reject, outrightly, all the proposals of re-structuring.
(3)Issue a circular, at AICEA level, for boycot of all protocols and Official functions, including Excise day celebrations.
(4)Inform above issues through a letter to Finanance Minister.

Dear Mr.Balu,

When you are quoting the some other blogs for updated information on cadre restructure, is it wrong on the part of Rajaguru, Nair and others to expect some updated information in their own blog, supposedly maintained by their leaders?

See that AICCEMOF.BLOGSPOT. They had uploaded all the matters pertaining to their cadre. The so called leaders of aiceia or their Propoganda secretaries that we can not maintain the blog like the news channels.

Yes. It is agreed. But AICEIA is not like a union or political parties in which Mayas, Jayas, kadkaris can not be questioned. It is not like that here. we are all minimum graduates and there is no concept leaders and their cadres. The SG is th erepresentative of the cadre and can not act as a leader.

It is mandatory on his part to update all the relevant information affecting the cadre to all. He can not withhold the information.

It is a fact every year we are shouting to boycott the excise day. What is happening? nothing. In the Income Tax day, it was not celebarted but their staff were made to celebrate by extending lot of facilities like providing mobile connection etc.

But here the department is celebrating at the cost of its staffs.

What steps was taken by the Association.

Whether leaders (so called) took any initiative to get facilities at least on par with their counterparts in Income Tax?

Answer: NO.

But balus and rajus are shouting not to criticise the SG & others.

There is no eligibel officer is waiting for promotion in the cadres of Examiner, Appraiser, AC,DC, JC,ADC, STA and TA. Only Inspectors and Superintendents are waiting for a long ago for their due promotion. The CBEC and IRS Officers never help us. AICEIA should approach the Revenue Secretary, FM and the Public. The pight of our Group Officers is becoming worst day by day. Do some thing for the welfare of our comrades please.

Thanks. Let us make it very clear in the context of the CBEC's refusal to give us a copy of the cadre restructuring report and CBEC's requirement of one year before the Hon'ble Apex Court to finalise the ratio for promotion to Group A cadre.

It is an Appeal to all the persons having self respect.
1.We will boycott Excise day celebrations in our individual capacity and we will intimate our decision to the Administration accordingly. No action can be taken against us by the Department as Excise Day function is not part of our official duty.
2.Let us resign from the Honorary posts such as Recreation club, canteen, welfare society etc.No action can be taken against us by the Department as such honorary positions are not part of our official duty.
3.Let us stop wearing the uniform. No action can be taken against us by the Department as Uniform cannot be insisted upon in the absence of guidelines to that effect as ruled by the Central Information Commissioner.
4.Let us stop all the protocol functions. Customs Examiners/Appraisers are able to achieve a lot than us without performing any protocol functions.
5.Let us claim all the benefits available for us and also avail all kinds of leave, to which we are entitled to.

The association should consider the sentiments of the cadre. May be the hesitation on their part to take a call as above is due to its repercussions which in any case can not be worse than what the cadre is already going through. Why the association is not taking the support of the print and electronic media to highlight the issues? Whether there is any restriction due to any clause in any rule to do so?

My dear Sudhir,
Please see my post dated 30.12.2010 wherein I had emphatically pointed out that no action can be taken by the Association, if we adopt certain permissible methods for agitation. The method, which is prone to risk is strike, including mass casual leave.

(i)Boycott of Excise day celebrations, (ii)Resignation from the Honorary posts such as Recreation club, canteen, welfare society etc, (iii) Refusal to wear the uniform (in view of the order of the Central Information Commissioner to the effect that there are no official instructions available in the Department to insist on Uniform), (iv) Refusal to attend the protocol functions (this decision requires only self respect.

It will be better if the Association leadership guides the cadre in the above path of agitation so as to have uniformity in the agitation. It seems Association does not want to displease the Administration as Mr. PV.Raju does not want to displease the Association leadership.

If Association does not give the call for agitation, why the officers with self respect cannot do the above in their individual capacity atleast.
