Recent Communication with the Board

Today we have submitted a letter to Chairman CBEC , wherein we have requested CBEC's intervention for an early date of hearing. it is narrated that interim stay ordered by the Honourable High Court of Calcutta in WPCT 261/2008. The continuance of this stay order is causing deep resentment and frustration among the cadres, especially so because most of the people standing in line for promotion have put in more than 20 years of service in the cadre. The fact that promotions has already been issued with effect from 01.07.2010 to other cadres has compounded the agony. I would also like to highlight the cases of some of our members, due for promotion in this calendar DPC and due to retire in this month and the coming months are going to loose out permanently in their pension as they are not beneficiaries of ACP/MACP.

The gross delay in filing reply in the case has resulted in the slapping of the stay order by the Court in March 2010. Now, though the reply is filed, the case is getting postponed hearing after hearing without any hope of respite in the near future.

Hence we requested C.B.E.C to take the following immediate actions.

1. In the unfortunate event of delay in vacation of the stay order beyond the month of July 2010, we would like to request your good-self to approach the Chief Justice of Kolkata High Court for an early date and save the cadre from further harassment.

2. If necessary, action may kindly be initiated to move the Apex Court for vacation of the stay order.

3. Direct all cadre controlling authorities to conduct the DPCs and keep the panel ready for issuance of promotion order immediately on vacation of the stay.

4. Declare that in respect of vacancies that existed as on 01.07.2010, the promotions shall be given effect from that day, irrespective of the actual date of promotion.

5. In any occasion if the stay order continues beyond the month of July 2010, direct all cadre controlling authorities to give notional promotion to all officers who would have figured in the panel has the DPC been held in time but had retired in the month of July or subsequently, so that their pension would be fixed on the basis of the revised pay.

A news is going around in Chennai since today evening that Board has directed to promote 119 inspectors to supdt before 1.9.10 in chennai zone. Can anyone clarify on this and authenticate it

what nkumar suggested may be correct" why cant our chief commissioner, kolkota meet the chief justice to apprise the issue and ask whether the department should be closed ?". lot of frustration among inspectors.

administration at different places also harassing with a threat of vigilance cases with the 20 years service supdts, 20 years service inspectors. a supdt with 35 years service is being insulted BY 35 days experienced newly joined AC. RAVI MALIK supdt's secretary is seem to be very dynamic now. let us take his advice also.

Recently, when I talked to an important person with accusations on CBEC for acute stagnation of the cadre, that person posed a valid question: "YOUR ASSOCIATIONS HAVE NEVER SUGGESTED OR ACCEPTED VIABLE SOLUTIONS. IN 2002, THERE WAS A CHAIRMAN WHO WAS PREPARED TO GIVE YOU 1500 posts of ACs, BUT YOU SAID YOU WILL NOT ACCEPT ANYTHING LESS THAN 3000 - AND YOU GOT NOTHING. HAD YOU ACCEPTED THE 1500 POSTS, SOME OF THOSE OFFICERS WOULD HAVE BEEN JCs BY THIS TIME". The adament attitude of the associations and lack of vision are to be blamed for the sad state of affairs.

what rangaraju has stated is absolutely correct. instead of grabbing whatever is being given and then fighting for what was not given, the association heads remain intransigent with the result that we have to stagnate for 20 years in the same cadre. god known when some sense will dawn upon the association heads

There is no provision for considering retired govt.servants in the Zone of consideration itself under the present rules( refer persmin website).As such, irrepairable damage has been caused to the insprs who have retired. Also, the Dept is expected to conduct prepare a model calender for DPC and conduct the same once in every year. Additional DPC is expected to be conducted to fill up the posts that arose out of unforeseen circumstances. Promotions are effective from the date of promotion order and not from the date of DPC. As such, it appears that promotion from a previous date is impossible. The repair has been done. The only thing is to save the spilt milk.

The dept. follow the rules scrupulously for the disciplinary cases. When it comes to promotions/welfare activities no importance is given. This must be taken-up in the forth coming meeting a strong letter should be written to Board.

When the promotions of Group 'A' Officers are done on time, why is it that the other cadres are not given the same benefit.. It is really amazing that the department turns a blind eye on this particular issue.. As per DOPT instructions, the appointing authority, i.e., the Cadre controlling authority is responsible for formulating a model calendar and follow it without fail.. When it is stopped then why is it that notional promotions should not be allowed??

A valid point indeed, needs to be taken up without any further delay..

so many persons are writing about their displeasure about not getting clearance from calcutta high court, having put in service of almost 20 years in inspr cadre...it is heard that every friday the case is coming up... but nothing is happening on fridays...why cant v think of another day... madhu
