Dear friends,
Our Association got an appointment with the MOS(REVENUE) , we congratulate Coimbatore branch and Com. Anil Kumar Sundaram for constant persuation in this regard. We would like to request all of you to send your stagnation report forthwith. As of now we have received detailed report of Maharastra and Tamilnadu, we request other Branch and circle secretaries to send us the required report immediately.

Do ask for time-bound promotion/upgradation from Inspector to Supdt and from Supdt to AC. Do insist on doing this cadre review of Inspectors, Supdts as well as Group A together. Dont let the group A get away with their own cadre review while Inspectors and Supdts rot.

we should insist on time bound promotions. Any one time measure will not only give perpetual benefits. Creation of vacancies so that promotion can be obtained by 12 -15 years can only lead to stagnation in the next cadre and can accentuate regional disparity. Time bound promotion is the only answer. Let us not win the battle and lose the war.

The appointment with MOS (Revenue) is the golden opportunity for the cadre of Inspectors and Superintendents. Let us effectively putforth our point with convincing arguments. Let us also highlight how the central excise officers were victims in the hands of the customs invaders and how Board has been unduly in favour of the Customs invaders.

just want to congratulate and add that there are many ways we can be befooled. just BEWARE and dont stop till we get our legitimate rights... we are the force who carry all works of this department and we get inhuman treatment in service matters...

Every staff association is behaving like an Osritch because now it is their time to fight for the justice which was never done by them.Closing of eyes by the Pigeon is not the way to get rid of paws of the Cat.The Jinn of Cadre review is came out and IRS would certainly eat Cake of GST which accelerated the process of cadre review.In the name of cadre review for the launching of GST, some ice candies are thrown in front of Insp&Supdt staff by giving lollypop of promotion of Insp in 15 years and promotion of Supdt after 25-30 years where IRS takes four promotions in 25 years from AC to Commissioner. One must keep some points in his mind before to leaps & bounds of merry-go-round on the outcome of court case(s) which sometimes takes more than one generation.
(i) GOI gave GP4600 to a pay scale,i.e., 6500-10500 but not to any rank or designation.That is why only 400 added to pay without getting fixation under Rule7(earlier FR22).For fixation/upgradation, everybody is silent.
(i) Vth Pay Report recommended ACP for Gr D in 12-24 years, Gr C in 10-20 years and Gr B in 8-16 years but GOI launched ACP for Gr B,C & D in 12-24 years.That makes clear that there is no difference in the eyes of GOI between Gr B,C & D.But we are separating ourselves in the name Gr BCD, Non-gazetted and Gazetted which is now an extinct species. One old saying is that Baarah saal baad to ghoora bhi khaad ban jata hai(waste turns into manure after twelve years).

Getting promotion after 12 years is good. But it should be followed by fixing All India seniority as Superintendent retrospectively as and when an Inspector has completed 12 years in the cadre. It will also serve many purposes.

1. Inspectors promoted notionally from back date on completion of 12 years service will get 5400 grade pay after total 16 years of service (without much litigation).

2. It will undo regional imbalances in promotions.

3. Many court cases for fixation of seniority will become infructuous after this single order.

4. Senior Inspectors promoted retrospectively can legitimately ask for next promotion after completion of stipulated service.

Dear KPS. In one of your comments you have requested to publish the written submissions given by AICEIA to the ADG HRM so that the members can know what is happening. But the same has not been published so far. We don't know the stand of AICEIA. Whether
AICEIA agree to the HPC recommendations intoto? Whether there is any time frame for implementation of cadre restructuring?

let us stop bickering among ourself. united we win, divided we fall. We should demand time bound promotion from Inspector to Supdt in 10-12 years and from Supdt to DC in 9 to 12 years. (AC post loses functional relevance when JC heads a division). Let us not stop here, we should also press for Non Functional Scale, when an Income Tax Inspector (junior by 2 batches) gets his promotion to a
particular level. Remember direct ITI has already reached the level of Commisioner. Such Non functional Scale is already implemented in case of All India Service officers including IRS benchmarking against IAS. So this should apply to SSC candidates in same ministry also

Whether it is correct that DOPT has issued an order granting one time increment for those employees having increment date in February to June to remove pay anomalies as agreed upon in the pay anomaly meeting.

If anybody has copy of DOPT order, please publish details.

Could not find the details of W.P.C.T. No. 261/2008 filed by Shri Samiran Roy and others Vs. UOI & ors. before the Kolkata High Court in the web site of Calcutta High Court.

Can any body tell the status of the case. i.e. Next Date??? Any interim order??? Jurisdiction of the order???

Future of large number of Inspectors at stake in the scheduled DPC of June 2010.

The AICEIA appears to be headed for right direction and pursue the matter vigorously. Stagnation is the root cause of problems faced by the cadres of Inspectors and Superintendents. Time bound promotions are the only effective remedy. Inspectors are also citizens of democratic India and hence are entitled to equality in all matters including pay and promotion, and this needs to be stressed before the Hon'ble MOS. We should demand time bound promotions like IRS and Income Tax Officers. Some will argue that IRS and Income Tax Officers are not equal with our cadre; agreed, but we know that absolute equality is neither possible nor we demand it; we do not lay our claim to be promoted as CC, what we want is only time bound promotions at par with Group A Officers.

Let this be the only demand in cadre restructuring exercise underway in the CBEC; other things will be automatically taken care of if the stagnation issue is resolved.

Along with the other demands, also do take up the issue of grant of ACP's to the promotees Inspectors who joined as UDC's.These Inpectors are also stagnating for nearly 20 years in one post without the benefit of ACP. Let there be no discrimination in the stagnation point for differnt types of Inspectors. Let the those who are stagnating in one grade get the benifit of ACP. The AICEIA should include this aspect in the meeting and do justice for the Inspectors

Let stagnation be done away with. The powers that be know that the Inspectors are placated with ACP. ACP is no alternate to actual promotion. ACP is only alternate remedy for lack of promotional avenues. Even HPC Report has reiterated that ACP SCheme does not absolve Govt. of making efforts to create sufficient promotional avenues, as was acknowledged by the VIth pay Commission. So let there be no need for ACPs and there are time bound promotions.

LET THE HON'BLE MOS BE APPRISED;

1) THAT THERE ARE INSPECTORS HAVING 22 YEARS SERVICE IN SOME ZONES STILL AWAITING 1ST PROMOTION;
2) THAT INSPECTORS HAVING 20 YEARS OF SERVICE HAVE BEEN GRANTED 2ND NON FUNCTIONAL PROMITION (ACP) IN THE SCALE OF ASSISTANT COMMISSIONER. HENCE, THESE INPSECTORS ARE QUALIFIFIED TO BE ASSISTANT COMMISSIONERS, BUT STILL DOING WORK OF INSPECTORS;
3) THAT THIS IS SHEER UNDERUTILIZATION OF THE MANPOWER AND WASTAGE/MISUTILIZATION OF THE GOVT. RESOURCES;
4) THERE IS GREAT DEMORALIZATION IN THE CADRE. THIS MAY FURTHER DETERIORATE AND AFFECT THE TAX ADMINITRATION;
5) THAT THE CADRE RESTRUCTURING EXERCISES IN THE PAST HAVE TAKEN CARE OF ONLY GROUP A OFFICERS; LET THIS IS NOT REPEATED;
6) THAT THE HIGHER POWERS ARE LOSING THE CONFIDENCE AND TRUST OF THE CADRE DUE TO SHORT-SIGHTEDNESS AND BLURRED VISION.

Dear Comrades, What have stated by Shri Bhagwan Singh in Point No. 5 & 6 herein above having graet significance. Our Association be extra cautious in dealing the matters related to point no. 5 & 6 herein above extra vigourously and potentially so the ripen fruits may not be hatched by any other cadre except the most deprived one of Inspectors and Superintendents of C.Ex. Why there is no parity in promotion in Group-B with Group-A. Group-A are having 4-5 promotions in 22-25 yrs. of service whereas Group-B still waiting for their first promotion even after 20-22 yrs. of service. It is not democratic in a country who is great democratic country of the world. Are you agree? if yes? what steps you taking to resolve this.

THE DEPARTMENT IS HANDICAPPED WITHOUT THE SUPPORT OF INSPECTORS AND SUPERINTENDENTS.

THE UNITED FRONT OF BOTH CADRES CAN ONLY BE THE SOLUTION.

Without efforts of Inspectors and Superintendents not even a single file can move. For each and every action Inspectors and Superintendents are being held responsible if any adverse happens. Poor Inspectors and Superintedents are backbone of our taxation regime but dear comrades now this trunk has been infected by turmite of inightings, selfishness and submissiveness for known reasons. If this continues VAT VRIKSH will die soon. So, please wake, stand united without infightings, selfishness, submissiveness and win the race. "Labours is yours but fruits are mine" this is policy being adopted by some cadres. It will be more corrct if I say England is still residing in minds of some people till now. There is a need for one more Gandhiji who must agitate for AGREJON BHARTIYA DIMAG CHHODO OR it will be more appropriate if I say BHARTIYON AGREHI MANSIKTA CHODO. Our cadre must stand united for our rights will spirit of DO OR DIE what Gandhi has told us for our rights. and what Swami Vivekanad told Wake up do not rest till the goal is achieved. Will we be united? Will we keep that spirit? if yes NO ONE can deprive of our legitimate rights. It is only academic discussion. Thoughts always welcomed.

Inspectors and Superintendents are taking efforts for improving the performance of the Department. Now, there is a need that we should work for our career prospects also. There is no point in writing letters. We should approach the Court for (i) revised pay from 1986 (ii) time bound promotions (iii) abolition of uniform and (iv) better working conditions. Firstly, the two Associations for Inspectors should be merged by a compromise formula and secondly, we should create a body to fight for the common interests as indicated above. A COMMON FORUM IS THE NEED OF THE HOUR.

thnx rajguru.. i have gone thru the recommendations of the HPC.. it has proposed the following-- Inspector to Superintendent then to Sr. Superintendent (JTS) and then to Sr. Superintendent (STS).. wow.. wat a nice idea.. why dnt we beleive that any committee comprising our masters will do the same thing...

(iii) What happened to Supreme Court’s 93 order, nobody knows. A special cell was created in CBEC to monitor the implications of resultant effect of that order under the pressure of contempt of court. But a relevant party, i.e. , IRS was made custodian of this special cell. As usual, they managed it according to their wishes based on the American culture which does not give permission to share anything with Red Indians. What happened to surplus IRSs and what relief got the staff due to this special cell, nobody is interested to discuss these facts before going to take decision on furure of its cadre.
(iv) HPC report is out and placed in the website of DG HRD CBEC. HPC report is nothing but ‘Andhaa bante rewari apne-apne ko diye jaye’(blind man gives only to himself). None has courage to discuss this in their agenda or in any forum of any association. Because it is based on a perpetual action that takes place on its own without any effort/force which, in plain words, means that ‘jo milna hai mil kar rahega’( whatever you get, you will get by your luck).
(v) HPC report is the best example of making development policy of villages by sitting in air conditioned room. HPC never surveyed the field of CBEC and also never got interaction with the field (lower) staff of CBEC before submitting the so-called analytical report which gives very pink picture of future of this department in their blue print. The field staff is struggling with shortage of Office space, collapse of pyramid of working culture, weak infrastructure and terrors of RTI & CVC including real terrorist etc. which were totally ignored by these HPCs.

(vi) Very old saying is that whenever a dog sees guest , he becomes happy by feeling smell of food of special menu for the guest but a cat sees a guest, she becomes unhappy by thinking of sharing of food with the guest. At present, Pressure Cooker of Cadre review is whistling very loud and nobody can stop the volcano of GST. Situation is like if you can not resist the rape, please enjoy it at least momentarorily. So that all associations have an eye on the boiling temperature of cadre review and are expecting its share in it which will be only left out ones but later portrayed by association as bringing out Amrit from Samudra Manthan. At least, IRSs never/ever want to share the fruit of cadre review which became possible due to imposition of GST. If it is Coconut, they don’t want to give any waste fibres(outer waste) by thinking that we can use them as clothing. If it is Pine Apple, they don’t want to give waste peals(chikkal) by thinking that we can use them in house making. If it is Mango, they don’t want to give any nut(guthli) by thinking that we can make a new plant from it. You can easily guess who’s who as per the old saying.
(vii) CBEC website was already hacked by IRS and now DG HRD website is also serving the interest of IRS only. There is no word in DG HRD website for GR B, C & D staff whether it is official work or welfare measure. It appears that DG HRD has no agenda for lower staff and only interested to deal with elite class.
Before going to this Harakiri, the suicidal note must contain these issues.
(a) An independent agency/committee was to be appointed for the exercise of cadre review in the name & style of launching of GST.
(b) Terms & conditions should be prepared with the consultation of all staff and should be made public before a debate on it.
(c) If you accepted the fact that ‘beggars are not choosers’ then please beg before a person who is having heart but not before a tyrant.
(d) Neither court cases nor associations brought any path breaking results but it is an appropriate time for turning the peanuts into pearls as the launching of GST is going to be supervised by IAS only. Stakes are very high and time is right for approach of Karo yaa Maro(do or die).
