CEC Jaipur a brief note.

With the active Co-operation of the members of Rajasthan Circle under the able leadership of Sri Vinay Awasthi (President ) and Sri Sudhir Tiwari ( General Secretary ) The 2nd Central Executive Committee recently held its meeting on 23rd & 24th of January 2010 in the Pink City (Jaipur).

Commissioner Central Excise, Jaipur Sri R.K.Singh inaugurated the open session. At the closed session the issues discussed are depicted underneath:

1. RESTORATION OF GRADE PAY OF INSPECTORS TO RS. 4600/- and Fixation of pay on promotion or by direct recruit who have joined before 01.01.2006.

2. ANOMALY IN FIXATION OF PAY OF 1992 BATCH INSPECTORS:

It was decided that Association shall represent on the issues in the sl. No. 01 to 09 and after exhausting persuasive action V.V.I.P references wil be taken care of.

20 branches and circles attended the meeting. Patna, Allahabad and Luknow expressed their inability to attend the meeting due to inordinate late running of various trains.

New units like Nasik from Maharastra, Indore and Bhopal from Madhya Pradesh attended the meeting. Nasik joined the Association right before the CEC, Indore and Bhopal joined the Association in the CEC.

CEC applauded the efforts of Sri Virender Singh Thakur and his Chandigarh circle for considerable contribution and special effort for the work done by the Association within the last one year, Sri Thakur and his Chandigarh circle has been awarded with a memento by the President of the All India Association. CEC decided to recompense at least one unit for its good contribution towards all India activities.

CEC decided to go for combined movement with the other units in the revenue department and to form a Joint Action Committee along with the newly elected Superintendent Association in our department. The Rajasthan Circle took the responsibility to initiate discussion with the President of the Superintendent Association. Action programme on the pending issues shall be decided in consultation with the Superintendent Association.

Detailed circular in this regard will be issued shortly.

“DGHRD is working on preparing the cadre restructuring proposals based inter-alia on the reports of the three study groups headed by respectively Shri Vithaldass,Bhargava and Ms Jasdeep Singh to look into integrated commissionerates of Central excise and Service tax,customs,LTU's and exclusive commissionerates of Service Tax and Central excise.The high powered committee recommendations are on a different footing since it's recommendations are regarding merger of cadres.The three study groups have made presentations to the full board in december and since then the board has directed that the first draft should be prepared by the end of february,towards which end we are working now.the reports being very bulky cannot be posted here but if any officer wants to have a look he or she is welcome.The impact of GST will be lloked into once the act rules are in place.In the meantime we are pressing ahead with the proposals.hope this sheds some light on the subject”

Whatever is going on at DOPT level for upgradation of GPs or at Board level for cadre review on 2011 and also happenning for CBEC staff that is all self-propelled action.No association recieved High Power Committee's report because they(CBEC) never circulated it or it was discussed by any association on the forum.It is the high time for IRS(C&CE) because they are only interested to take major share of upgradation in the name of launching of GST or say it as cader review.The cake will be theirs as usual and we have to enjoy brickbats only.

What about the 5400/- grade pay to ACP Inspectors?

Don't count the chicks before they are hatched. The problem is that like usual we are expecting a lot but will get nothing. Senior supdts are dreaming of becoming AC's and I believe have suggested to the board to increase post of AC by reducing similar number of Supdt post. So senior inspectors ESP in the west zone where there is terrible stagnation (1989 batch of inspectors has now started getting in the promotion queue) will stagnate more. So a point has come where even the Supdt association cannot be trusted since they now have their own selfish agenda and are least bothered about the inspectors stagnation. In the end the IRS will get all the benefits and as usual we will be left to pick up the crumbs.

Respected Office bearers,

May I would draw your attention to the matter related with Pay Fixation with Up-graded pay in PB-2 with Grade Pay of Rs. 4600/- of Inspectors (C&CE), who have joined the department on or before 31.12.2005. The procedure for fixation of pay is completely based on Sixth CPC’s recommendations and further orders related to it.

Our discussion originates from the Office Memorandum dated 13th November, 2009 issued from Implementation Cell, Department of Expenditure, Ministry of Finance communicated vide F.No.1/1/2008-IC dated 13th November, 2009.

Para 4 of the OM dated 13th November, 2009 stipulates that:-

“4. Accordingly, in terms of Rule 6 of CCS(RP) Rules, 2008, revised pay of Government servants in the pre-revised scale of Rs. 6500-10500 who were earlier granted grade pay of Rs. 4200 and who have already exercised their option for drawal of pay in the revised pay structure in the format prescribed in the Second Schedule to the Rules, will be fixed again in accordance with illustration 4A annexed to CCS (RP), Rules, 2008.”

Further, a copy of “illustration 4A” is enclosed along with Sixth pay commission’s O.M. dated 30th August, 2008 communicated vide F.No.1/1/2008-IC dated 30th August, 2008 for your kind perusal. "Illustration 4A" stipulates the procedure for pay fixation in cases where posts have been upgraded, as in the case under reference. Here

Sixth CPC’s report stipulates in Section II the “Entry Pay in the revised pay structure for direct recruits appointed on or after 1.1.2006”, which solely relates to the appointees who have joined the Government service on or after 1.1.2006 hence, in cases, when the Officer (Inspector) have joined the Department on or before 31.12.2005 as Inspector, the pay fixation could not be governed as per Section II of the Sixth CPC (referred above). In such cases, after up-gradation the minimum pay should be Rs. 13860/- , as on 1.1.2006, as per Sixth CPC’s report.

Therefore, on the basis of above discussion the fixation of pay should be done as per “illustration 4A”, which clearly explains the procedure for pay fixation with upgraded pay structure, which is categorically re-produced below in respect of Inspector. Customs & Central Excise, who have joined the department on or before 31.12.2005:-


Pay fixation in cases where posts have been upgraded in pre-revised pay scale of Rs. 6500-200-4590 to Rs. 7450-225-11500 scale, as per “illustration 4A”.

1. Existing Scale of Pay
= Rs. 6500-10500
(Corresponding Grade Pay Rs. 4200)
2. Pay Band applicable
= PB-2 Rs. 9300-34800
3. Upgraded to the Scale of pay
= Rs. 7450-11500
(Corresponding Grade Pay Rs. 4600)
4. Exisging basic pay as on 1.1.2006
= Rs. 6500
5. Pay after multiplication by a factor of 1.86
= Rs. 12090
(Rounded off to Rs. 12090)
6. Pay in the Pay Band PB-2
= Rs. 12090
7. Pay in the pay band after including benefit of bunching in the pre-revised scale of
Rs. 6500-10500
= Rs. 13860


8. Grade Pay attached to the scale of Rs. 7450-11500
= Rs. 4600

9. Revised Basic Pay – total of pay in the Pay band and Grade pay = Rs. 18460
(as on 01.01.2006)
10. Date of next Increment = 1.7.2007
DOI PAI
Pay + Grade Pay = Total
1.7.2006= 14420 + 4600 = 19020
1.7.2007= 14990 + 4600 = 19590

The Office bearers of our association may take-up the matter at appropriate level, in the above explained line, if they find it fit, for sorting out the problems related to pay fixation raised due to up-gradation to the Grade Pay of Rs. 4600/-.

Respected Office bearers,

In continuation my earlier views dated 1.2.2010 (at 05.30pm) I would like to add here that the fixation as per OM dated 13.11.2009 should be done as per "illustration 4A", which relates to pay fixation in case of "upgradation", as in our case, and not on the basis of "illustration 4B", which relates to pay fixation in case of "merger" of posts. This is the hair-line gap which should be taken care of at the time of fixation in case of officers joined the department on or before 31.12.2005.

Our office bearers may like to take-up the matter at appropriate level for in above line, if they find it fit for discussion.

An early guideline in the matter will favour a lot more officers in our department.

Some attention should be given to Inter commissionerate Transfer. Recently (apr 09)CBEC issued an Order implementing ICT with seniority whenever the spouse is employed in Centre/State/Public Sector. As there are lot of young officers from outside states/region, an ICT with or without seniority early in their career will surely help them. It may be remembered that in CBDT they have this Inter-Charge Transfer going on for very long time.

As per the Order of the Hon,ble CAT, Cuttack Government is bound to issue a speaking order on pay revision within 60 days of the Order, which had already lapsed. We should take appropriate action on this issue, which is favourable for us. We should not accept anything less. There is a rumour that the Association is having the plans to go for compromise in the form of acceptance of the package with effect from 1.1.1996. or notional fixation from 1.1.1996.We should aim to get actual fixation from 1.1.1986.

Dear Shri Ramamoorthy,

I wud like to address to your point of ICT with seniority. Whether it wud not be prudent to first bring the promotion status at par across the country as it would then make the 'ICT with seniority' of some real sense. As of now an inspector of 92 batch at mumbai/raipur/indore can get ICT to Ahmedabad and get promoted immediately as Supdt. if he doesn't loose seniority. Similarly an officer of 92 batch at gujrat, who is already promoted gets ICT to Mumbai/raipur/nagpur, he would be working as Supdt while his seniors are still inspectors. I think this aspect needs some serious thought.

In the case of officers who joined after 01-07-2005 are governed by All India Seniority. Go to CBEC site

check para 08-11 onwards. Having posted the same on their web site for more than one year, it would be very difficult for the Board to backtrack on the all India seniority in future..
Most of the newly recruited officers in the last two years are from outside their home states. In case of allowing ICT for them, there should not be any harm.

I think the comments of Mr.Dipak Kumar, Inspector, Patna dated February 1, 2010 5:30 PM, deserves attention that is required to be addressed immediately. His point of argument is well supported as per the instructions in the RP rules itself.. Hope the Association takes up this matter with the Board/Ministry on priority to settle the anomaly.

Dear friends, the issue of pay fixation of 1992 batch inspectors has been decided by the Hyderabad CAT vide order dt. 13.06.2008 in case of Sh. G. Chalapathi Rao, Inspectors of central Excise & Others Vs. the CBEC, New Delhi and others (OA No. 31/07).Order may be obtained from net.
