GAZETTE NOTIFICATION RELEASED

GOVERNMENT RELEASED GAZETTE NOTIFICATION IN NIGHT

Dear Comrades - The Gazette Notification by the Government of India has been published yesterday night in the website of Ministry of Finance. However comrades who want to verify the original Notification of Gazette can visit the Finance Ministry website http://www.finmin.nic.in - Both Hindi and English version of Notification is available in the above Finance Ministry website. Since the official Notification has been published by the Government, A.I.C.E.I.A is giving out its priliminary comments and observations on the common issues hereunder:

A.I.C.E.I.A REACTION


NEGATIVE:

1. As already analysed by the National Executive of Confederation of Central Government Employees the denial of Need Based Minimum Wage as per 15th ILC norms Rs.10,000 for Group 'D' but only granting of Rs.7,000 as Minimum wage to Group 'C' is most disappointing.

2. The fitment formula of 1.86 times of basic pay as on 1.1.2006 do not ensure even minimum wage rise of 40% to employees while the Group A officers

3. Group D employees without Matriculation qualification would only get the fitment in 1S scale with 1300/- grade pay and not PB-1 scale with 1800/- pay now until they are retrained suitably. The Non-Matriculate Group D officials who retired between 1.1.2006 and now would not be eligible for the PB-1 at all and thus deprived even this minimum wage of 7,000/- level and therefore their pension benefit would go down. A major disappointment.

4. Recommendation of pay commission to not to allow Merger of Dearness Allowance with Basic Pay at any stage is accepted. This is going to make a big difference and negative impact on our wages in future.

5. Special Duty Allowance [SDA] is accepted by the Government as recommended by pay commission only and without any modification sought for by the Staff Side to ensure the Allowance paid without any condition for all employees working in the NE Region. Notification says that employees without any all India transfer liability condition but transferred within the Region from one area to another are made available with the SDA. This will however cause denial to large number of employees who are not transferred from their area of recruitment to another area.

6. Government's acceptance of Non-selection grade for Superintendents of C.Ex. and I.T.O’s have less/no effect on the Superintendents of Central Excise, as most of the inspectors’ get their promotion after completion of 16 to 24 years of service so after completion of 20 years they will automatically get the benefit of next A.C.P.
7. The revised pay scale of Inspectors from 01.01.1996 had not been given .
8. Flexi-time for women employees and flexi-week recommended for physically challenged are rejected by the Government.


POSITIVE:


1. Transport Allowance for those employees in the basic pay of 4000/- in revised pay scales also will be on par with those who are in grade pay level of 4200/- to 4800/-. These employees will get 1600/- + DA on it in Metro Cities and 800/- + DA on it in all other places.
2. Though nothing specific had been written as regards pay scale of Inspectors of Central Excise, Customs and Income-tax, yet, as par Part-‘B’ REVISED PAY SCALES FOR CERTAIN COMMON CATEGORIES OF STAFF section-I clause(ii) it appears that the initial grade-pay may change at the time of fixation.
2. Campus restriction for Transport Allowance is removed by the Government so that all employees who occupy campus attached quarters [like SPM Quarters] will also be eligible for Transport Allowance.

3. The modification by the Government for granting two uniform dates of annual increments to facilitate drawal of increment either on 1st January or on 1st July is an improvement.

4. Benefit of one increment is given to avoid bunching of more than two stages in the revised running pay bands [But @ 3% of basic pay in pay band without including Grade Pay].

5. Rejection of the recommendation for reducing the Holidays only to National Holidays and allowing the status-quo is welcome.



CONCLUSION:

The National Executive of the Confederation’s decision to go for an indefinite strike is the only alternative for opposing the retrograde stand of the Government on many issues like Need Based Minimum wage, Denial of Minimum 40% fitment benefit to all, Denial of Transport Allowance minimum 1200/-+DA on it for Metro and 800/-+DA on it for other places, Denial of Minimum 10% fixation benefit on promotion, Non-acceptance of SDA for all employees in NE Region etc. Let us concentrate to build a powerful movement by forging unity with all possible organisations outside the Confederation and let lose a powerful campaign and agitational programme to culminate in indefinite strike. Acceptance without further increase would result in huge loss.

secveral classes of Officers originally at parity with the Inspector of Central excise in the pay scale of 6500-10500 have been placed in the payscale 0f 7450. this is similar to us being placed in scale of 5500 earlier as agaINST A PAY SCALE OF 6500 FOR WHICH WE HAD TO FIGHT A LONG BATTLE AND THE gOVERNMENT HAD GRANTED THE SAME , WITHOUT THE BENEFIT OF ARREARS. tHIS IS INDEED SAD FOR US.

There are two points requiring some clarification.
1. The Commissione recommended for merger of pre-revised pay scales of Rs.5000-8000, Rs.
5500-9000 and Rs.6500-10500. and if some posts which presently constitute feeder and promotion grades if come to lie in an identical grade, and in case it is not feasible to merge the posts in these pay scales on functional
considerations, the posts in the scale of Rs.5000-8000 and Rs.5500-9000 (T.A. & S.T.A. ?)should be merged, and the post in the scale of Rs.6500-10500 (Inspectors)should be upgraded to the next higher grade in pay band PB-2 i.e. to the grade pay of Rs.4600 corresponding to the pre-revised pay scale of Rs.7450-11500.

Does this mean that Inspectors scale is going to be upgraded to Rs. 7450-11500 (Pre-revised)?

2. It has been recommended by the commission and accepted by the Govt. that Supdts. / Appraisers who have put in 4 years of service shall be given new Scale of Rs. 8000-13500 (Pre-revised) with the corresponding revised scale with a grade pay of Rs. 5400. Does this apply to Inspectors who got their ACP and are getting same scale as that of the Supdts.?

At para 2.2.19-Salient Features-Page No.45 of the Sixth CPC Report, in the table showing merger of posts having pay scales of Rs.5000-8000 to 6500-10500, it has been stated that "large number of anomalies were created due to placement of inspectors/equivalent posts in CBDT/CBEC in the scale of 6500-10500" and therefore the anomalies have been rectified by placing all the scales from Rs.5000-8000 to 6500-10500, under the same pay band.
In the Revised CCS Rules 2008, many posts carrying the pre-revised pay scale of Rs.6500-10500 have been upgraded to 7450-11500 barring the Inspectors of CBEC/CBDT.
Does this mean that Inspectors have been pushed back to the same earlier pay scale of 5500-9000 to rectify the supposed anomaly created due to our pay being fixed in 6500-10500 during the year 2004? And all our efforts to get our scales on par with pre-revised scale of 6500-10500 have been futile?
The other issue is if Supdts/Appraisers who have put in 4 years of service shall be given the new scale of Rs.8000-13500(Pay Band PB-3; Grade Pay-5400) after 4 years, then will they get the benefit of ACP after 20,30 years if such benefit after 4 years is extended?
Further for an inspector who has joined in 1996 gets his ACP in 2008 after 12 years as per 5th CPC, what is his ACP status as per the 6th CPC. Will it be effective from 2006, ie., after completion of 10 years?

In all probability, the scale of Inspectors will be upgraded to 7450-11500 on par witht he CBI Inspectors.

But the most unfortunate thing is that they will get only a paltry difference of Rs 200 (in grade pay) on being granted ACP. So little after waiting 10 years.

I have two points to make.
One is, that the merger of the three grades or two grades as we wish is only an eye wash as the order says that the pay be fixed on the actual multiplied by 1.86 and allow the grade pay.. In the present scenario, the grade pay is Rs.4,200/- and in case it is upgraded to the 7450 scale it will be Rs.4,600/- and hence not much difference even if upgraded..

The second one is that either on promotion or ACP you are going to get one increment in the present pay and only the difference of the grade pays from the present grade to the promoted grade.. In most cases this difference is only Rs.200/- to Rs.400/-.. There appear to be no basis for arriving at this grade pay. If any one could only find out the logic behind such grade pay...

can anyone clarify whether an inspector who got his ACP (to 7500-1200)scale will be eligible for the new scale i.e 8000-13500 after completing 4 years from date of ACP. As per the resolution (page 31), the officer has to be a Group B officer and should have completed 4 years regular service in the '7500' scale.

Inspectors getting ACP will not be upgraded to the 8000-13500 scale.. The reason is that the upgradation is the officers who are in that grade/post of that scale, who will get upgraded to the next scale i.e., 8000-13500 and not the officers who are drawing pay in that particular scale.

I hope this happens. Otherwise the Direct Recruit Inspectors (Scale 6500-10500) appointed after 1.1.2006 will be the worst affected by the VI Pay Commission.

Because of the merger of pay scales 5000-8000, 5500-9000, and 6500-10500, even the Senior TA (scale of pay 5000-8000) who was getting Rs. 5000/- as basic pay as on 31.12.2005 will be getting more than the Direct Recruit Inspector appointed after 1.1.2006.

Here is the illustration;

For Direct Recruit who joined on or after 01.01.2006 the pay as per VI pay Commission will be fixed to Rs. 13500/- . With increments on 1.7.2007 and 1.7.2008, his pay will become Rs.14330/- which amounts to Gross salary of Rs. 20417/-

For a Senior TA who was receiving Rs. 5000 in the pay sacle 5000-8000, as per the VI pay commission his pay Rs. 5000 will be multiplied by the factor 1.86 and Rs. 4200/- will be added as a Grade pay which amounts to Rs. 13500/- With increments on 1.7.2006, 1.7.2007 and 1.7.2008 his pay will become Rs. 15070/- which amounts to Gross salary of Rs. 21423/-. That means he
will be receiving Rs. 1006/- more than a Direct Recruit Inspector joined on or after 01.01.2006.

For an Inspector who joined before 01.01.2006 and receiving Rs. 6500/- as pay in the pay scale of Rs. 6500-10500), as per the VI pay commission his pay Rs. 6500/- will be mulitplied by factor 1.86 and Rs. 4200/- Grade pay will be added to this which amounts to Rs. 15070/- . With increments on 1.7.2006, 1. 7.2007and 1.7.2008 his pay will become 17810/- which amounts to a Gross Salary of Rs. 25150/-. That means he will be receiving Rs. 4733/- more than a Direct Recruit Inspector joined on or after 01.01.2006.

Is this Justice?

Does it not amount to the Govt. cheating Direct Recruits?

The govt. just degraded the Direct Recruits from 6500-10500 to Rs. 5000-8000 scale?

Does it mean Govt. does not want any new talents?

Think of the difference in pay between a Direct Recruit joined on 31.12.005 and 01.01.2006 is Rs. 4733/-. Is it justice?

Think of the persons who were already working in Rs.5500 scale and resigned their job and joined as Inspectors just because of better pay.

Will it be addressed to Govt.?

Can any one answer these queries?

Already Direct recruits are having problems like Inter Commissionerate transfer, Contributory pension, Seniority anamoly. Now another feather in the Cap.

The above anomaly has a simple answer in the pay commission notification itself. That is regarding the merger and upgradation of the three scales (5000, 5500 and 6500 scales). When it is not possible to have the three merged then the 6500 scale has to be upgraded to the next higher grade of 4600 and the initial pay for that grade is higher at 12540 -basic plus 4600 grade pay which is Rs.17140/- at entry level.

Do not worry it will not definitely be what u were getting all these days.. It is a matter of time and and the government will be settling it in the above manner sooner than later..

I don't think the government is taking any steps regarding the persons newly recruited in the scale of 6500 and it had cheated them by ofering 5000 grade after two years of service.

This is nothing but a case of cheating.
