Entire cadre is looking up to you for valuable information like upgrading the C.Ex. inspector scale to 7450 etc. you are all sitting like dumb creatures. wake up man... Mr. prabhakar Rao what is happening.

Grant of Grade Pay of Rs. 5400/- in PB-2 to Group B officers of the Department of Revenue on non-functional basis after 4 years of regular service in the Grade Pay of Rs. 4800/- in PB-2 as indicated in Point No. 1(x)d of the Resolution of the Government of India dated 29.08.08 in respect of the recommendations of the sixth CPC:

Point No. 1 – Whether 4 years should be calculated from 1.1.06 i.e. the effective date of the CCS (Revised Pay) Rules, 2008:

As per Note 2A of the CCS (Revised Pay) Rules, 2008, where a post has been upgraded as a result of the recommendations of the sixth CPC as indicated in Part B or C of the First Schedule to the said Rules, the grade pay corresponding to the upgraded scale as indicated in Col. 6 of Part B or C will be payable in addition to the pay fixed in accordance with Clause A (i) and (ii) of Rule 7 of the said Rules. The scale of pay of Superintendents of Central Excise has been revised in Section II of Part C of the First Schedule to the said Rules in the following manner:

Thus from the above it is absolutely clear that a Superintendent of Central Excise who has completed 4 years of regular service in the scale of 7500-12000 (attributed with grade pay of Rs. 4800/-) as on 1.1.06 should be granted grade pay of Rs. 5400/- from 1.1.06 in addition to his pay fixed in accordance with Clause A (i) and (ii) of Rule 7 of the said Rules. However, those who had completed 4 years of regular service in the scale of 7500-12000 on any date prior to 1.1.06 would get the higher grade pay of Rs. 5400/-from 1.1.06 only. Further, those who complete 4 years of regular service in the scale of 7500-12000 on any date subsequent to 1.1.06, should be granted the higher grade pay of Rs. 5400/- from that date only.

In this regard the example of granting ACP can be cited in support of the above argument to the extent that although the scheme became operational from 9.8.99 on the recommendations of the fifth CPC, the period of regular service of 12 years and 24 years was not calculated from that date. In fact any person who completed 12 or 24 years of service before 9.08.99 was granted ACP from 9.8.99 and those completing the same on any date after 9.8.99 were granted ACP from that date.




Point No. 2 – Whether Inspectors of Central Excise who were granted the scale of 7500-12000 (attributed with grade pay of Rs. 4800/-) on getting ACP are eligible for getting the higher grade pay of Rs. 5400/- on completion of 4 years in the scale of 7500-12000:

The criteria for getting the benefit of grade pay Rs 5400/- are:

i) The incumbent should be a Group B officer
ii) He should have completed 4 years of regular service in the scale of 7500-12000 (attributed with a grade pay of Rs. 4800/-)

In terms of Board’s Order F.No. O-8013/100/2003-IHB dated 11.12.03 & 24.10.07 read with DOP&T’s Instructions/Notification SO.No. 332 dated 20.04.98, the post of Inspector, Central Excise under CBEC was reclassified as Group B (Non Gazetted) w.e.f 11.12.03. Therefore, since in Point No. 1(x)d of the Resolution of the Government of India dated 29.08.08 in respect of the recommendations of the sixth CPC only the term ‘Group B officer’ has been mentioned, an Inspector of Central Excise who is a Group B officer and has been granted the scale of 7500-12000 by virtue of ACP should be eligible for getting the higher grade pay of Rs. 5400/- if he completes 4 years of regular service in the scale of 7500-12000 (attributed with a grade pay of Rs. 4800/-) in the same manner as that of a Superintendent of Central Excise. Although confusion is being raised on the use of the term non-functional basis, it may be mentioned that an Inspector of Central Excise gets the scale of 7500-12000 also on a non-functional basis by virtue of ACP (As is clear from a plain reading of the text of the ACP scheme). So there should not be any bar in getting the revised benefit granted to that scale on a non-functional basis.

The mention of the post of Superintendents of Central Excise etc. in Section II of Part C of the First Schedule to the CCS (Revised Pay) Rules, 2008 is being interpreted as a benefit available only to the Superintendents of Central Excise etc. In this regard it may be mentioned that the scale of 7500-12000 which has been revised belongs to Superintendents of Central Excise etc. and it is quite natural to mention the same in the relevant column of the table. The same was done when the scale of Superintendents of Central Excise etc. was upgraded from 6500-10500 to 7500-12000 w.e.f 21.04.04 vide CBEC F.No. A-26017/65/2003-AdII-A(Pt.) dated 11.05.04 (There also the name of the post was mentioned as Superintendents of Central Excise etc. in the relevant column of the table). However that did not cause any hindrance to Inspectors getting the scale of 7500-12000 on being granted ACP. Now in terms of Section II of Part C of the First Schedule to the CCS (Revised Pay) Rules, 2008 the scale of Superintendents of Central Excise etc. has been upgraded from 7500-12000 to 7500-12000/ 8000-13500 (after 4years) and there should be no bar in granting the same to Inspectors on ACP. It has been mentioned in the text of the ACP scheme that “the ACP scheme envisages placement in the higher pay scale/grant of financial benefits (point no. i)” and “financial upgradation under the scheme will be given to the next higher grade in accordance with the existing hierarchy in a cadre (point no. vii)”. Therefore the benefit of getting higher grade pay of Rs. 5400/- should certainly be available to Inspectors who complete or have completed 4 years of regular service in the scale of 7500-12000 (attributed with grade pay of Rs 4800/-) from such date. Also, nowhere in the Resolution or the Revised Pay Rules has it been mentioned that the Revised scale of Superintendents of Central Excise etc. is meant only for Group B Gazetted officers or it will not available to officers on being granted ACP.

In this regard it may further be mentioned that the scale of Superintendents of Central Excise etc. after revision of the same is 7500-12000/ 8000-13500 (after 4years) and not 7500-12000. Therefore just as the scale of pay of a newly promoted or recruited Superintendent of Central Excise has to be 7500-12000/ 8000-13500 (after 4years), the same has to be the case with Inspectors getting ACP and the question of importing a redundant pay scale of 7500-12000 only for Inspectors getting ACP is absurd.

Grant of Grade Pay of Rs. 4600/- to Inspectors of Central Excise and Administrative Officers in the scale of 6500-10500:

In Section I (ii) of Part C of the First Schedule to the CCS (Revised Pay) Rules, 2008 it has been mentioned that:

However, no specific recommendation has been made about Inspectors of Central Excise and Administrative Officers in the scale of 6500-10500 in Section II of Part C. Also, the posts of Tax Assistants, D.O.S. etc in the scale of 5000-8000 & 5500-9000 constitute the feeder grade who get promoted to the grade of Inspector or Administrative Officer in the scale of 6500-10500 and the said posts in the scale of 5000-8000 & 5500-9000 have not been merged with those in the scale of 6500-10500 on functional considerations. Further, there is no post in the scale of 7450-11500 in the Central Excise Department so the posts in the scale of 6500-10500 cannot be merged with that in the scale of 7450-11500. Therefore till such time the scale of Inspectors of Central Excise and Administrative Officers is upgraded to the scale of 7450-11500, these posts should be granted higher grade pay of Rs. 4600/- in PB-2 corresponding to the scale of 7450-11500.

I have something more to add regarding the date from which the upgraded scale would be available as well as eligibilty of Inspectors to get the revised scale after completing 4 years in the scale of 7500-1200 which is given below:

For clarification regarding both the above points O.M. No. 22011/10/84-Estt.(D) dated 4.2.92 issued by the Director, Ministry of Personnel, P.G. & Pensions (DoP&T) on the subject of “Revision of pay scale/upgradation of the posts – Date of regular appointment of the incumbents to the upgraded post” should be referred to. Therein in Point No. 2(2) it has been stated that:

“Where the upgradation involves a higher replacement scale without higher responsibilities or higher qualifications but with a higher eligibility service, the incumbent need not be assessed for their suitability but it should be ensured that they have completed the requisite qualifying service for appointments to the upgraded post. In case they had completed the qualifying service on or before the date notified by the Government, they may be appointed to the upgraded post from that date. In the case of others who fulfill the qualifying service on a later date, they should be appointed to the upgraded post from the date on which they complete the qualifying service. This would be subject to the condition that irrespective of the date of appointment, the original seniority of the incumbent in the grade prior to upgradation will be maintained for appointment to the upgraded post.”

Thus the above clarifies the date from which the revised pay scale should be available and also makes it clear that the same should be available to Inspectors who complete 4 years of regular service in the scale of 7500-12000.

Are the comrades reading this? Are we taking up the issue of granting Rs.5400 grade pay for those of us who have been working in Rs.7500-12000 scale of pay in ACP for more than 4 years? Would be grateful if some of the leaders answer on this issue in this thread.

Are we Inspectors eligible for travel to North Eastern Region by Air from our place of posting as we are also group B officers as per the DOP&T's OM dated 2nd May, 2008.

Can someone clarify please?

Will the Officers who have got their ACP between 01.01.2006 and the date of issue of notification be eligible for ten year cretaria for the purpose of refixing their date of ACP i.e. will their ACP be effective from 01.01.2006 ? Please do throw light on this aspect as well.

The explanation given by shri Sarkar is more plausible with regard to grant of grade pay of Rs 5400 to Inspector/Superintendent who have completed 4 year service in the pay scale of 7500-12000 (prerevised). This is based on earlier DOPT instruction dated 4-2-92. However in spite of this clarification how come the administration is resorting to give grade pay of Rs 4800 only. Can any body answer this question
