Non-Functional Financial Upgradation is ACP-DOPT clarifies

As per Part B and C of CCS Revised Pay Rules, 2008, Employees of certain Group B posts in various departments were fixed with the grade pay of ` 4800 and after completion of 4 years of service in the those posts, they are eligible for Non-Functional financial upgradation to the Grade pay of `5400/-

There is no confusion in this Upgradation but its effect on MACPS is the issue on hand now.

What will be the benefit under MACPS for an employee, who has been granted the grade pay of ` 5400 after completion of 4 years of service as per Part B and C of CCS Revised Pay Rules, 2008, as mentioned above?

Whether the Non-functional upgradation of grade pay from ` 4800 to ` 5400 after 4 years should be accounted as a promotion or ACP as far as MACPS is concerned? If this upgradation of grade pay is accounted as a promotion, obviously one of the three assured upgradations eligible under MACPS will be curtailed. We may think logically and say upgradation of grade pay from ` 4800 to ` 5400 under Part B and C of CCS Revised Pay Rules, 2008 is not a promotion. But, sources say DOPT has decided otherwise.

When Office of the Prinicpal Chief Controller of Accounts requested DOPT to clarify as to whether the grant of grade pay of ` 5400 in PB-2 alongwith the benefit of one increment of @3% may be treated as ACP or not, it has been clarified by DOPT to Principal Chief Controller of Accounts that the benefit of non-functional grade granted to the Superintendent (Group-B) officers after completion of 4 years would betreated as upgradation in terms of para 8.1 of Annexure-I of OM dated 19.05.2009 and the same would be off set against one financial upgradation under MACPS.

This decision is expected to result in reversal of MACP Orders issued to many of the employees who have been granted upgradation under MACPS recently.

Dear All

It looks like this is the DOPT's gift for the festive season to Government Employees.

If as per the ACP the upgradation has to be the next higher grade pay, this clarification goes against that particular provision particularly in the case of para8.1 which is contradictory. How can the GP of 5400 in PB-2 and PB-3 be treated different.. Only the pay band is different and the GP is same. Hence this is an anomaly, which has to be rectified..

The Associatio has to act fast to address this issue to the anomaly committee on MACP set up by DOPT, for resolving this contradictory stand..

Injustice is the gift that is showered on the Govt. servants (at lower level, especially in CBEC) always.

Comrade balu, the clarification given by the dopt as hierical is w.r.t. the acp granted between 1-1-06 and 31-8-08. and the way most staginating cadre cheated by macp is well known.

Para 8.1 of MACP says:
Consequent upon the implementation of Sixth CPC’s recommendations, grade pay of Rs. 5400 is now in two pay bands viz., PB-2 and PB-3. The grade pay of Rs. 5400 in PB-2 and Rs.5400 in PB-3 shall be treated as separate grade pays for the purpose of grant of upgradations under MACP Scheme.

It implies that since Para 8.1 confirmed that PB-2 grade pay of Rs.5400 and PB-3 grade pay of Rs.5400 is different, upgradation from PB-2 Rs.5400 to PB-3 Rs.5400 has to be granted in case of an officer is eligible to receive MACP when he is in PB-2 Rs.5400 and non-functional upgradation from the grade pay of Rs.4800 to the grade pay of Rs.5400 after 4 years of service in the grade of Superintendents should not be counted as promotion.

Dear Friends,

My initial comment was one of frustration and sarcastic, which is why i had termed the clarification as a Gift. Really it is the final nail in the coffin, as regards the issue of getting the 6600 Grade Pay, clarified by DOPT for proper implementation.

Para 8.1 is itself contradictory- Firstly the ACP is granted only when there is stagnation in the same grade and hence there has to be a change in the status which has to be realistic and not symbolic. Hence, the non-functional upgradation granted in PB-2 has to be changed to PB-3 for Maintaining the hirearchial structure.

The second point is this. If a DR Inspector is completing 20 Years of service with or without one promotion he will become eligible for 2nd ACP on completion of 20 Years on which day his pay will be as under:-

He would cross the minimum of PB-3 which is 15600 and therefore there will be a mere increase of Rs.600 in GP and one increment in addition to that, which is miniscule and is going against the very concept of upgradation. Even the superintendents who have completed four years are also crossing the 15600 level and it is of no use. When this is the case the clarification which says that the 3rd upgradation would be in 5400-PB3- as per para 8.1 is absurd, as there will be literally no change in pay. There will be one additional increment and that's it.

Last but not the least.
A superintendent has got his 2nd ACP from October - 2007 on completion of 24 years. He had also completed 4 years of service as on 01.01.06 in the grade of Supdt., Now how can his pay be fixed. There is only confusion after the present clarification. If non-functional upgradation of 5400 in PB-2 is given for completion of 4 years, and he gets his 2nd ACP in October -2007 how is his 3rd ACP to be calculated as and when it comes as he would have got 3 upgradations at that time..?

There is a lot to ponder over..Can some-one say something on this...?

The entire chaos is due to incapable and indifferent bigwigs in CBEC, who are unwilling to take on the ever offensive and jealous Central Sectt. Service official manning the key positions every where, be it CBEC or Deptt. of Expenditure, Ministry of Finance or for that matter the DOPT.

The best way out is to create posts of Inspectors/Superintendents in Board/DOR as well as the ministry to take care of personnel matters.

What a rubbish thought. How can one grant NFSG of 5400/- in PB 3 to Section Officers with 4 years service and at the same time ignore the Superintendents/Appraisers of Customs & C. Excise according the NFSG in PB 2 itself.

The entire game plan is evident now in view of the DOPT clarification dated 11.9.10.
