Dear Comrades,
We congratulate all our comrades, who took strenuous efforts in making the organizational action programme a grand success. We would like to request all the units to post the actual depiction of the action programmes so that an overall picture of the participation in various States could be ascertained, it is necessary that we should review our performance state and region-wise. Unless we identify our weak areas, it may not be possible for us to take any corrective steps so that we will be able to acquit ourselves creditably in future programmes.
In all likelihood, the Central Trade Unions will step up the resistance movement against the economic policies in the days to come as 7th September, has demonstrated unambiguously the growing discontent of the workers.
In the mean time Government of India was compelled to rectify child care leave Circular and made necessary changes which is welcomed by most of the Central Government employee’s oerganisation.
Despite our efforts taken right after Indore CEC meeting in consultation with the All India circles and branches, the campaign programme could not be mounted effectively. We are aware of the importance of the need and efficacy of the campaign programme, the absence of which must have affected adversely our participation in some places. This apart, it has also come to the fore that the Association must now without further loss time initiate some programmatic action in pursuance of the issues of the Inspector Central Excise as without JCM forum meetings with the Ministers and Authorities resulting the consultations/meetings into procrastinated dialogue without reaching any tangible settlement on any issue. The basic issues of anomalies are yet to be settled and there is no indication that it would be done in the near future.
Hence, all the Branch and Circle Secretaries are hereby requested to take concerted and farm effort to make the programme on 15th a grand success.
The interim order of Calcutta High Court issued on 27.08.2010 has now been published in our blog.
In terms of the interim order, the only condition precedent for issuing the regular promotion order is the issuance of order consequent to the review of DPC held on 09.09.2004 in Kolkata Commissionerate. We submit that the most important part is complete now and Kolkata CC issued the order in relation to the review D.P.C. on 10th instant as requested by the Association; we requested Chairman C.B.E.C to fix a date for all CC s to issue orders in the zones, rather than waiting for a compliance report from Calcutta to issue directions to other CCA s. and the date of effect of the promotion orders should at least be from 01.07.2010. Unfortunately, Board has not yet found any time to reply to our plea hence we are issuing another letter now and including this point as a fresh point in our charter of demand.
In the mean time Chairman expressed that CBEC is open for any dialogue and most of the issues which we have raised that are being taken care of.
We once again place our Charter of Demand:
- Notional fixation of pay of Inspectors of Central Excise in the pre-revised scale of Rs. 6500-10500 with effect from 01.01.1996.
- The ongoing cadre restructuring exercise to cater to the aspirations of Group B executive cadres and to be finalized after formal and recorded consultation with the Association. Restructuring should be completed within December 2010.
- Inspectors next promotional grade pay should be Rs. 5400/- .
- Abolish Control Room duty and Uniform in Central Excise and Service Tax.
- Fixation of minimum pay corresponding to pre-revised scale of Rs. 7450-11500 consequent to up-gradation ordered on 13.11.2009.
- Anomaly in pay of 1992 batch Inspectors who received ACP prior to 20.04.2004.
- The 1% incentive on incremental revenue should be utilized for providing facilities and infrastructure for lower level staff also.
- Lift the ban on ICT
- J.C.M should be conducted in Board and at local level regularly at periodic intervals.
Now, we would like to include the issue of unique and effective date of D.P.C. through out

Cadre-restructuring by CBDT, CBEC: Focus is to mitigate stagnation at cutting-edge levels; Principal CC-posts proposed by CBEC

Here are the highlights of the proposals for both the Revenue Boards:
++ CBEC has proposed a jump in the total number of personnel from 66808 to 95168 after surrendering about 6906 posts; CBDT has asked for about 38000 additional posts;
++ CBEC has gone back to the Principal Chief Commissioner system. It has proposed 18 posts of Principal Chief Commissioners - nine zonal heads for NINE proposed zones plus nine Directorates are to be upgraded to be headed by Principal Chief Commissioners. Besides, 77 more posts of Chief Commissioners are proposed to be created. For the CBDT, an additional 116 posts of CCITs have been proposed. Out of these, 40 posts are demanded to be upgraded to the level of highest pay bracket i.e. Rs 80,000/-.
++ At the Commissioner level, the CBEC has proposed a graded rank - Commissioner, Grade I and Commissioner, Grade II. For the former category, the proposal is to create 100 new posts and the latter to have 363 posts, including 295 existing ones. CBDT has gone by the operational index theory and has proposed higher status for administrative CIT in comparison to CIT(A). The number of administrative CITs for assessment charges is proposed to be increased by 250.
++ At the Addl / JC-level, the CBEC has proposed a sharp leapfrogging from 593 posts to 1550 posts. The CBDT has also proposed an increase commensurate with the rationale devised for the restructuring.
++ The CBEC has proposed a Hanuman-jump at the cutting-edge level by proposing an increase from 1550 posts AC/DCs to 4900 posts. This is to take care of stagnation in the various feeder cadres.
++ The CBDT has proposed creation of 20,000 additional posts at the ITO-level;
++ The number of Commissionerates will jump from existing 93 Central Excise Commissionerates and 7 Service Tax Commissionerates to 119 Central Excise Commissionerates and 22 exclusive Service Tax Commissionerates;
++ For the Customs, it will be up from 35 to 60 Commissionerates;
++ In addition, 45 new Audit Commissionerates have been proposed by the CBEC;
++ Directorate of Safeguard and Directorate of Export Promotion are proposed to be merged;
++ Directorate General of Service Tax is proposed to be shifted to Delhi;
++ A new Directorate of International Customs is proposed to be created to deal with WCO, WTO and WIPO.
Criteria adopted by Revenue Boards
++ Revenue Norms: Rs. 1750 Crore Central Excise Annual Revenue {(PLA + CENVAT) - Each Commissionerate of Central Excise shall have 5 Divisions and 25 Ranges. The Commissionerates located in an area, which is not covered by an exclusive Service Tax Commissionerate, would be given manpower equivalent to the staff allocated to one Division exclusively for Service Tax. Commissionerates having Oil Refinery within their jurisdiction would be provided additional staff equivalent to one Range for One Refinery;
++ For a Service Tax Commissionerate, Rs 3000 Cr annual revenue or more than 17500 assessees has been taken as a benchmark. Each Commissionerate of Service Tax shall have 5 Divisions and 25 Ranges.
++ For a new Customs Commissionerate, the benchmarks adopted are 125000 Bills of Entry for Customs (Imports) and 200000 Shipping Bills for Export Commissionerate. 150000 BEs & SBs for integrated Customs Commissionerate.
These are broadly the major proposals of the CBEC and CBDT cadre reviews and restructuring of various Commissionerates and Directorates. Less information has been provided for CBDT proposals as the CBDT continues to look confused and also secretive about some of its proposals. The Directorate of HRD which is being saddled with multifarious roles and powers, needs quality personnel if CBDT wants it to play an active role in overall designing of the roadmap for the Department.
There is silence about TIME BOUND PROMOTIONS to Inspectors and Superintendents.
IT IS STRANGE THAT A PRIVATE BODY LIKE TAXINDIAONLINE HAS EACH AND EVERY DETAIL REGARDING CADRE RESTRUCTURING WHEREAS AUTHORISED SERVICE ASSOCIATION IS BLANK ON THIS ISSUE. SUCH INFORMATION SHOULD COME FROM THE SIDE OF SERVICE ASSOCIATIONS AS IT IS NOT A SECRET DOCUMENT.

CBEC proposes to surrender 6906 posts in exchange for the proposed restructuring.
Any prizes for guessing where those 6906 posts are going to come from.
Obviously it is going to be from the Group B cadre.
The only way to end injustice is to end those who feel that injustice is being done. i.e the Group B cadre. That seems to be the agenda of the Board.
The demand of AICEIA for abolition of uniform is AMUSING. Long back, the Central Information Commissioner (CIC), while disposing off a RTI query, had ruled that there are no written guidelines or instructions to insist on uniform. That being the case, why should the Association beg or fight with the Department for abolition of Uniform. Superintendents Association, Karnataka issued a letter to the Administration informing that uniform should in be insisted upon in the light of the ruling of CIC.
Similarly, instead of fighting for actual fixation of higher pay scale from 1986, the Association has down scaled the demand for notional fixation from 1996. It is unfortunate.

We all are responsible for these type of situations. Just remember what we will do when there is a call for direct action like strike. We will make all sorts of excuses and abstain from it. We have too many service associations in CBEC. Take the case of CBDT. It is the ITEF which represents all cadres there and they can effectively negotiate things. As we are divided, our strength is depleted. More over, we don't have the trade union spirit in our blood. That is the reason why we are reluctant to join the confederation also. First prepare ourselves and show our willingness for direct action. Once we are united and show our strength, CBEC will come to our tunes. So rally behind the leadership rather than making comments and lamenting.

Pranab pulls up tax dept bosses

New Delhi: Normal work in the income tax department has resumed after its nongazetted employees called off their nationwide agitation following the intervention of finance minister Pranab Mukherjee who issued necessary instructions for their speedy promotion.
The “go slow” agitation of the I-T employees, which began on July 20, had paralysed functioning of the department, including I-T raids across the country.
The agitation also led to a large number of litigation in courts. When the agitating employees petitioned the FM after their plea before the Central Board of Direct Taxes (CBDT) failed to yield favourable action, the minister instructed the top bosses in the revenue department to immediately clear all pending files pertaining to promotions.
A senior finance ministry official said the FM had asked the chairmen of both the CBDT and the Central Board of Excise and Customs (CBEC) to ensure that nongazetted employees, who are the backbone of the two departments, should not be harassed and forced to engage in unnecessary litigation against the department.
The FM has asked the two revenue boards to set up a high-level committee to specially look into the promotion issues and ensure that litigations are brought down.
In another meeting held last week with all senior officials of the ministry, Mukherjee asked for the immediate implementation of the Mankad committee report that had recommended appointment of the senior-most member of the revenue boards as chairmen and to give them a fixed tenure of one year.
So far, in CBDT and CBEC only those members who had a one-year tenure left were eligible to be in the race for the chairman’s post.
Why are only selected members asked to participate in the Dharna. Is it not necessary that all members are persuaded to participitate. Such half measures will only be seen as our lack of strength and will not help us in any way. Every where, the assn seems to have lost its moral strength, its capacity to question injustice and its legitimacy as an indicator of self respect of the individual memebers. The meekness of the office bearers will result in an ineffective association.
The General Secretary of AICEICA should immediately meet Chairman - today itself and do the neddful for issue of promotions orders for Inspectors to Superintendents immediately. Let the Orders be issued by this week end. Because Writ Petition itself does not relate to promotions at all. Alot of time has been lost. Please do the needful atleast now.

No need for cheers. If 3500 inspectors are promoted, perhaps only 1992 and 1993 batches only will be cleared.
Stagnation is not going to be removed. It will be removed only if Inspectors with 10 year service are Superintendents and those with 20 year combined service (Insp.+ Supdt.) are atleast Assistant Commissioners at par with Direct Recruit Assistant Commissioners.
How many AC/DC posts are going to be created? Is it 3350 as has been projected by Tax India Online or 4250 as per the version of Cengokerala? Are these posts sharable with customs Superintendents/appraisers in the ratio of 6:1:2 or as per the modified ratio as has been demanded? Whether all the posts are meant for promotees or 50% will have to be given to UPSC for direct recruits?
Will there be any mechanism to conduct DPC during the first week of January to select the candidates for promotion in respect of all the cadres in tune with the requirement for a full calender year with 10% additional persons so that the officers need not wait for the DPC.
THIS IS THE TIME AICEIA WAKE UP AND KNOCKTHE CBEC DOORS CONTINOUSLY AND GET SOME RESULTS ALL THE INSPECTORS AD SUPS ARE WAITING EAGERLY FOR THE INFORMATIONS PLEASE UPDATE REGULARLY.
It is strange that there is no mention about consequential promotions in feeders cadres that is Inspectors and Supdt. As mentioned by Shri Rajaguru the modalities for feeder cadre also to be spelt out.For creation of 4250 AC/DC posts an equal number from Supt and Inspectors are to be cleared. Promotions can not be through Direct Recruits. But Inspectors, after promotion - vacancy can alone be filled by Direct recruits. If any other explanation is there please share it.
