A joint convention of Government Employees and teachers was held on 8th July 2008 at New Delhi. The gist of the deliberations held in the meeting is given below. As decided in the meeting. I request all the Circle/ Branch Secretaries to organize the following two programmes.

Massive demonstration/mobilization/dharna in all the head quarters and important offices on 30th July, 2008.
Serving of strike notice through demonstration on 4th August, 2008.

AND TEACHERS FIRMLY RESOLVE TO MAKE
THE 20 AUGUST 2008 GENERAL STRIKE A GRAND SUCCESS

About 800 delegates representing the Confederation of Central Government employees and workers, All India State Government Employees' Federation, All India Federation of University and College Teachers Union, School Teachers Federation of India attended the National Convention today at MPCU Shah Auditorium, Civil Lines, Delhi. The Convention was presided by a presidium consisting of S K Vyas, R G Karnik and Kartik Mondal.

The Convention was inaugurated by Com. M K Pandhe, President CITU and was addressed by Com Tapan Sen, MP, Secretary CITU, Com S K Bose, Assistant Secretary, NRMU, Com. Sailo Bhattacharya, General Secretary, All India Defence Employees Federation, Com. Baidyanath Mukherjee of School Teachers Federation of India, Com. B S Hota, President, All India University Employees Confederation, Com. James William, National Secretary AIFUCTO, Com. Rajesh Menon, General Secretary of Confederation of Central Govt Officers Organisations.

The Declaration, later approved by the Convention was presented by Com. Sukomal Sen, General Secretary AISGEF, and seconded by Com. S K Vyas President Confederation of Central Govt Employees and Workers. The speakers suggested several amendments. The version adopted at the convention after taking into account these suggestions and the Press Statement issued immediately thereafter is enclosed. The convention while endorsing the decision of the sponsoring committee of Central Trade Unions and Federations has called upon the Central and State Govt. employees, and teachers to organize a series of programmes of actions culminating in one day strike on 20th August, 2008.The affiliates were requested and to take necessary steps required along with the COC for the successful conduct of the one day strike on 20th August, 2008.
Com. KKN Kutty, Secretary General of Confederation of Central Employees summed up the discussion in which about 30 delegates participated. The final text of the declaration as approved by the Convention is enclosed. The Convention endorsed the decision of the Sponsoring Committee of Trade Unions to organize a day's strike on 20 August 2008 and made a firm resolve to make the strike a grand success and carry out the following programmes of action.
1. Joint Conventions at States/District/Industrial centers to be completed by 15th July, 2008.
2. Massive demonstration/mobilization/dharna in all the states and Industrial centers on 30th July, 2008.
3. Serving of strike notice through demonstration on 4th August, 2008.
This convention recognized the fact that the Govt's attempt for withdrawal of the Statutory Pension Scheme of Govt. Employees to replace it with a contributory system is conceived to transfer funds from poor to rich and to finance the stock market operations. The mass scale outsourcing of regular jobs, contractorization, privatization have become the modern instruments of exploitation. This is being applied in all Govt sectors including the teaching community and the teaching institutions. In all sectors; be it private, public or Government; denial of legitimate wages to the workers are encouraged blatantly by the Govt. Basic and hard earned labour welfare legislative enactments are sought to be replaced by reactionary ones to provide room for unhindered exploitation of workers and to appease the Trans-national Corporations.
Right to Strike for the Govt. employees has not yet been formally granted. This year is the 60th year of Declaration of Human Rights by the ILO. Govt. of India is a member State of the ILO. However, for the last 60 years Govt. of India has been consistently refusing to ratify the ILO convention 87,98 in regard to TU rights and 151 concerning such rights to workers in public services. This convention demands of the Government to ratify the convention 87, 98 and 151 and afford the right to strike to the Government employees.
This convention viewed the recommendations of the 6th Central Pay Commission as yet another manifestation of the intent of the ruling class to intensify the neo-liberal economic policies. The 6th CPC has discarded all the established norms and principles of wage determination and has advanced untenable arguments to deny the employees the minimum wage. It has openly advocated Corporatisation and even privatization of major departments of the Govt. of India, Railways and Defence in particular. This convention asks the Government to deist from the practice of Corporatisation and privatization of Government departments. In consonance with the practices prevailing in the western world, the commission has suggested hefty pay packets and benefits for the top echelons in the bureaucracy denying in the process even the legitimate and genuine demands of the employees. The commission's recommendation to dispense with the existing Bonus scheme and introduce a system of performance related wage structure being bereft of any logic or merit has been rejected by all the organizations of Central Govt. employees unanimously. The convention condemns the suggestion made by the 6th CPC to abolish Group D Cadre and to stop recruitment of Group D employees as being superfluous in the Govt. departments and permit contractorization of these functions henceforth. This direction of the 6th CPC, if implemented by the Central Govt, will play havoc in the States, where the number of Group-D employees is in colossal numbers. This convention therefore demands the Govt. to enter into a meaningful discussion with the employees' organizations and bring about a satisfactory settlement on the recommendations made by the 6th CPC and ensure that the retrograde recommendation on stoppage of Group D recruitment is rejected.

The 6th CPC has not recommended to extend the existing defined benefit Pension Scheme for new recruits, which the Govt has stopped without any statutory sanction This is unacceptable and the Convention demands that the proposed new Contributory Pension Scheme which is yet to receive the assent of Parliament should be scrapped and all Govt. employees (including those recruited after 1.1.2004) brought within the ambit of the statutory defined pension scheme.
In addition to the above demands of the Govt sector in particular, the Convention fully adopts the Charter of Demands and endorses the programme of actions chalked out by the Sponsoring Committee in its national Convention held at New Delhi on 13th May, 2008 and calls upon the central and State Govt. employees, University, College and School Teachers to organize a day's countrywide strike on 20th August, 2008 in unison with the other sections of the working class in the country
The Convention concluded at 6 P.M. with the presidential address by R G Karnik on behalf of the presidium.
From our Association three (3) delegates inclusive of the Secretary General In charge had participated in the meeting.
We would like to submit our notice on 4th of August as per the call given by the joint convention.

6th CPC related issues.

As has been intimated in our last circular letter on the subject, a satisfactory settlement on core financial issues is the need of the hour. The discrimination in the fitment formula between the officers who are placed in PB3 and PB4 vis- a – vis others is without any logic and principle and brings about a vast amount of difference in emoluments, apart from providing varied percentage of benefit to even similarly placed employees. The irrational computation of minimum wage, if not addressed, will have an everlasting impact on the wage structure of Central Govt. employees. The process of negotiation that is presently on the anvil in the case of Public Sector employees, once come to fruition will widen the existing disparity in the wages of the Central Govt. employees and workers of the Public Sector workers. The future of further recruitment in Government department for carrying out the existing Group D functions is bound to be stopped. Since no organizations can do away with these functions, the only alternative will be contractual employment. The National Executive of the Confederation, which met on 8th July 08 has, therefore, decided to meet immediately on knowing the Government's decision on the 6th CPC related issues. The emergent meeting will be notified to take place within a few days'

Information received from the D.O.P & M is that the Board has appointed a Committee to see the feasibility of a combined Recruitment Rules for all the Group B Gazetted and non-Gazetted Executive Officers under the Board. This proposal has to be discussed within our organization in detail before giving any feedback to the committee.
A full-fledged E.C. meeting is long overdue. This is hampering the smooth functioning of the organization. Many of the new developments have to be discussed in detail. I request the Circle/Branch Secretaries to come forward to host a meeting.
We are doing our best to take up the resolutions adopted in the Pune Convention and subsequent meetings with the concerned authorities. The letters addressed to Board regarding anomaly on pay fixation on grant of ACP 1992 batch inspectors and unified G.P.F account is attached with this circular.
The Board has principally agreed to hold Departmental Council Meeting under the JCM. The Board has also directed all the Chief Commissioners to finalize the Transfer Policy after discussion with the recognized Association. Units are requested to contact their respective Chief Commissioners to hold Office Council Meeting.
During our visit to Delhi the All India Association collectively persuaded different pending matters lying with the Board; met Chairman and Member (P&V) and specifically mentioned about promotion and notional fixation of revised payscale from 01.01.1996.

Sub: Anomalies in fixation of pay of Inspectors on grant of ACP prior to and subsequent to 21.04.2004 - Reg
Your kind attention is invited to our letter ref. AIF/Pay/2006/64 dated 15.11.2006 & AIF/Pay/2006/11 on the above subject and Board’s letters dated 06/01/2006 and 04/01/2008 in this regard.

The facts relevant to the issue that were highlighted by our earlier correspondences are reiterated here.
1. The pay scale of Inspectors of Central Excise was revised from RS. 5500-175-9000 to 6500-200-10500 w.e.f. 21/4/2004 vides Order No.6/37/98…dated 21/4/2004, issued by the Department of Expenditure.
2. By the same Order, the pay scale of Superintendent of Central Excise, the immediate hierarchical post of Inspector was revised from Rs. 6500-200-10500 to Rs. 7500-250-12500 w.e.f. 21/4/2004.
3. A large number of Inspectors have received 1st /2nd financial up gradation under the ACP scheme on completion of 12/24 years of service in the year 2004.
4. The upward revision of pay scales with effect from 21/04/2004 has given rise to anomalies in fixation pay of Inspectors getting their ACP before and after 21/4/2004.
5. In respect of Inspectors who were granted ACP before 21/4/2004, the pay was fixed in the pre – revised scale of the Superintendents viz. 6500-200-10500 and on 21/4/2004 their pay was fixed at Rs. 7500/-.
6. In respect of Inspectors who were granted ACP after 21/4/2004, the pay was fixed in the revised scale of. Superintendents viz. Rs. 7500-250-12000 at Rs. 7750/-.
7. Owing to the above, a large number of Inspectors all over the country are drawing lesser pay that their juniors
8. Almost in all cases, deprived Inspectors have represented to the competent authority, but to no result.
9. The CBEC vide letter ………dated 06/01/2006 and 04/01/2008 has clarified
“that no anomaly is recognized where pay is fixed under ACP scheme which is purely personal to the employee and has no relation to seniority of the employees. Despite ther being existence of specific Government Instructions, the senior Inspectors are not provided the pay safeguard. Further the seniority has no relevance in ACP Scheme.”

10. We are constrained to say that the above clarification is not legally or factually correct for the following reasons;
(a)The anomaly in pay highlighted by the Association has not been caused by ACP but due to the up-gradation of pay scale of Inspectors and Superintendent.
(b)The same problem could have arisen in the case of promotion also.
(c) The situation highlighted is a unique one and is not covered by any of the clarifications issued by the DOPT with regard to the ACP scheme. As stated above the problem does not pertain to the implementation of ACP scheme and hence the remedy lies elsewhere.
(d)In this regard, attention is invited to Note 9 to Rule 7 of CCS (Revised Pay) Rules, 1997. The note contemplates stepping up of pay on par with that of the junior in a case where the senior is getting promotion before revision of pay-scales and junior after revision of pay-scales if the following conditions are satisfied
· Both the senior and the junior employees should belong to the same cadre and the posts in which they have been promoted should be identical in the same cadre,
· Pre-revised and revised scales of pay of the lower and higher posts in which they are entitled to draw their pay should be identical,
· The senior should draw at time of promotion pay equal to or higher than that of the junior,
· The anomaly should be directly due to application of FR 22 or any other Rule regulating pay-fixation on promotion in the revised scale,
· In cases, where junior draws more pay in pre-revised scales by virtue of advance increments granted to him the anomaly will not arise.
11. It is submitted that Note 9 to Rule 7 referred to above covers the instant case.
12. In terms of the above provisions we find that the Inspectors getting ACP benefit before 21/4/2004 and senior to Inspectors getting ACP benefit after 21/4/2004, are eligible to get the pay safeguard.
With reference to the above, affected officers from various Commissionerate have represented for “Removal of anomaly in pay of senior Inspectors upon grant of ACP to junior officers in upgraded pay scale w.e.f. 21/4/2004.”
One such sample representation is enclosed for perusal.

We request for an early settlement of the issue through a specific (and duly amended) instruction / clarification.

Kindly refer to your letter F.No. A-26017/50/2008-Ad.IIA dated 29th May 2008. We would like to mention that what we have demanded is to create unique account number within a seniority Zone. In reply to your queries we would like to furnish the following points:
In the present G.P.F account numbering system all the officers had to apply for change of G.P.F account number after every 2-4 years under one seniority Zone. So, in transit a good no. of officers are loosing their balance and interest every year and also suffering from inordinate delay in getting their most urgently required GPF advances/withdrawals.
Under one seniority Zone (which is likely to be most feasible parameter) a single G.P.F. Account No. should be allotted to every employee. All the Pay and Accounts Offices under the said seniority zone should operate under one Deputy Controller of Accounts. In this way frequent change of Account Number can be stopped and loosing of balance and interest will go away perpetually. This will also do away with the inordinate delay in transferring G.P.F balance and the harassment faced by the officers at the time of G.P.F. withdrawal.

Another option would be allotment of 10 digit unique GPF account number which can be loaded on a server maintained by the Pay and Accounts Offices like the SAP system, adopted by our Department for the registration of the Assessees, wherein the first three digits would be for the Department code, the next two digit would be for the Seniority Zone code, the next one digit would be for the Commissionerate code( this may be optional), next four digit would be for unique serial number or existing account number of officer within the Seniority Zone.

The necessity of secured online transfer of GPF Account Balance from one PAO Office to other like the banking industry is the need of the day. This is doable as the PAO Offices in our Department are fully Computerised and are equipped with internet facility.

Circular-4/08

In our last Circular we have mentioned that after great effort we were able to convince the all India leadership of Revenue C-O-C to hold an emergency meeting on 11th May,2008 at ITEF HQ AT 2.00 p.m and I, on behalf of our Association and on behalf of C-O-C revenue, fixed the joint meeting with the Revenue Secretary at 3 ‘o’ clock in the afternoon on 13th of May,2008 at ‘KALPABRIKHA’, North Block, New Delhi. Now I would like to furnish a brief account of our last Delhi Visit:

7th of May
Visited North Block, New Delhi, to pursue the issues already represented in relation to VIth C.P.C recommendation to The Cabinet Secretary, Expenditure Secretary, Revenue secretary and Chairman C.B.E.C. Discussed, at length with one Deputy Secretary, North Block and one Under Secretary, North Block, who initially dealt with our representation.

The feedback from the discussion is that though we have demanded for 7500-12000 scale, none of the other organizations had demanded the scale, hence Board was constrained to recommend 7450-11000 scale only, i.e pay parity with the Inspectors of C.B.I

The silver lining is that we have pulled out ‘the notional fixation of inspectors w.e.f 01.01.1996’ from the necropolis. As you all know, the 6th Pay Commission had rejected our legitimate demand in its recommendation and after that we had represented for the same on 25th of April to the different officials of Government of India as well as of our Board. Board had acted very positively and for the first time it had recommended strongly for notional fixation for inspectors w.e.f 01.01.1996.
In the afternoon met Confederation leadership at the Head quarters of Postal Union, New Delhi and we were briefed on the detailed discussion held with the standing Committee on that date. For details kindly visit the web-site

Followed up with the Revenue Secretary’s office for a meeting with C.O.C in the Department of Revenue on 12th of May, 2008 with regard to the pay scale issue and the issue related to notional fixation w.e.f 01.01.1996.

8th of May
Visited North Block, New Delhi and sought for a joint meeting with the Chairman C.B.E.C on 12th or in the morning of 13th of May, 2008. We were demanding this type of meeting since long as we were trying to bring Superintendent organization in a platform where both these organization could work jointly. Most important part is that we demanded a minuted meeting in this regard It is to be noted that in some vibrant organization like Income Tax, Audit and Postal Department they brought all the organization up to the level of Group ‘B’ under a single umbrella through this type of operation.
An appointment had been granted for C.O.C revenue to meet with the Revenue Secretary on 13th of May, 2008 at 3.00 ‘O’ clock in the afternoon at the Hall, Room No. 158 of North Block.
We were also given to understand that Board had recommended higher replacement scale to Secretary (Revenue) and the issue of notional fixation w.e.f 01.01.1996 to Secretary (Expenditure). The Commissioner (D.O.P&M) had strongly backed our case while formulating the recommendations.
Visited Commissioner (D.O.P&M)’s office met with the officials and it is to be appreciated that both the issues we are pursuing are moving in the right path. Got a letter related to next restructuring placed below, all the unit secretaries are hereby requested to send their report by 15th of June, 2008 to the Association mail box.

This Directorate vide its earlier letters dated 12.06.2007 & 21.08.2007 had requested all the Central Excise & Customs Zones and Directorates under CBEC to provide following proposal/ information/ statistical data to this Directorate:
(i) Proposals for reorganization of the formations falling within the jurisdictions of respective Zones along with complete functional justification for the same.
(ii) Commissionerate-wise Statistical with data regard to revenue collection, assessee base, pendency of Appeals cases with Commissioners (Appeals), information about seizures of non-traditional items such as Narcotics, Wild Life products etc.
(iii) Tentative assessment of the requirement of additional staff strength in various Groups ‘A’. ‘B’, ‘C’ & ‘D’ grades etc.
The Statistical Data was required to be provided in the Proforma enclosed with this Directorate’s letter dated 12.06.2007. The Field formations were requested to send their proposals/ data to this Directorate latest by 31st July 2007. However, even after expiry of the prescribed time limit, no information / proposal in respect of the formations under your charge has been received in this Directorate.
2.0 It would kindly be appreciated that the task of preparation of the proposal for cadre restructuring / reorganization for a big and important organization like the CBEC is massive and, cannot be performed without timely receipt of the reorganization proposals / information from the field formations and considered views on the matter of the senior officers of the Department. It is, therefore, requested that the requisite proposal / information in respect of the formations under your charge may kindly be sent to this Directorate without any further delay.

9th of May :

The problem in A.C.P. faced by the 1992 batch Inspectors was further pursued in the Section AD-IIA at North Block. In this connection it was pointed out that the issue had been solved provisionally in Ranchi.

Visited, Ad-IVA at Bikaji Kama place to enquire about the next round of recruitment.
Visited, Ad-IIIA to pursue the representation on the counting of regular service for the purpose of ACP/ promotion. It was assured by the Under Secretary AD-IIIA that the issue will not remain torpid for long and this file will be moved by the first week of June, 2008. We hope by this time the file may have moved to the next higher Official.


10th of May
Met different members, Office bearers of Jaipur and Delhi, Discussed certain organizational points and the issues pertaining to the 6th Pay Commission and got very positive support for the work we are doing in Delhi.

11th of May
President and Liaison Secretary came to Delhi to attend the C.O.C meeting as well as the meetings with Chairman and Revenue Secretary; After C.O.C Revenue’s meeting Secretary General had to leave Delhi as he was infected with Chicken Pox.
The meeting of Revenue C.O.C decided to pursue the issue of notional fixation w.e.f. 01.01.1996 and the pay scale issue,

12th of May
Representation from Revenue C.O.C was prepared. In addition separate Representations were prepared by the Superintendent Association as well as Inspectors Association for submission to Chairman CBEC. The separate representations were prepared in spite of the fact that we are to make a united effort. The copies have not been forwarded to me despite repeated efforts and hence I am unable to place them here.
Meeting with the Chairman C.B.E.C was fixed at 12 noon on 13th of May, ’08 and accordingly Secretary General informed the available office Bearers and President about the said meeting and once again highlighted the purpose of arranging a joint meeting with the Board.

13th of May

Meeting with the Chairman C.B.E.C held at 12 noon both the Superintendent Association as well as Inspectors Association submitted their representations separately, no minutes of the meeting had yet been intimated.
Meeting of the C.O.C revenue with the Revenue Secretary started at 3.15 P.M. at the Kalpabrikhkha, Room No. 158 of North Block and it went for about 45 minutes. The Revenue Secretary was very positive on the issues discussed by the Revenue C.O.C. Revenue Secretary expressed his concern for non consideration of the Notional fixation from 01.01.1996 and asked the two Boards C.B.E.C and C.B.D.T to submit their report to the Revenue Secretary within a week. Revenue secretary at the time of discussion of our pay scale issue also asked for similar report from both the Boards and gave optimistic response regarding the Pay Scale of the Inspectors.

In addition to this it is once again requested that the entire Branch, Circle and State Committees to follow the web-site of the Confederation and follow the programmes furnished therein through the state Committee of the Confederation i.e. Co-Ordination Committee of Central government Employees. A Convention in every state is likely to come up within 15th to 20th of June followed by an Industrial Action against the demoralizing recommendations of the 6th Pay Commission.

Time to prepare for the forthcoming Struggle

You are aware of the fact that we went to Delhi in the first half of May and tried to knock at the right moment, however , as I was infected with Chicken pox I was not able to communicate with you for quite some time. I am furnishing in detail what we have done in Delhi and like to request you to follow the developments that has been furnished in the Circular. All the Individual organisations are prepairing themselves for a strong protest, perhaps after third pay Commission Government is likely to face an Industrial action against the demoralising recomendation of the 6th Pay Commission. Government is trying to give a lightning effect of these recommendation and likely to complete all the formalities within a time frame and trying to give effect of the Pay Commission's recommendations within a short while. So, at this moment it is our duty to strengthen our own organisation and to prepare our comrades in every Unit, Branch and Circles for the forthcoming struggle. It should always be kept in our mind that we are one of the most deprived cadre working under the Government of India.

CIRCULAR-3/08
As you are aware, an emergency meeting of the office bearers and available EC members of AICEIA was convened at New Delhi on 24th April, 2008. I reached New Delhi on 23rd April. I am giving below, brief on the action taken during this visit to New Delhi.

23rd April
Visited Directorate Of Logistics, and followed up certain pending issues regarding sanction of amounts from welfare fund.
Visited Under Secretary AD-IIIA to pursue the representation on the counting of regular service for the purpose of ACP/ promotion. The action pursuant to the sae is pending for want of data from Chief Commissioners of Lucknow, Meerut,Mumbai, Pune, Bhubaneswar, Ranchi and Vishakhapatnam Board has issued a D.O. letter F.No, a-32011/52/2006-Ad.III-A to these Chief Commissioner’s for expediting the required information. All the Circle/Branch Secretaries of the above mentioned Zones are requested to take special initiative to ensure that the required data are forwarded Ad-III-A immediately. Please send a copy to my postal address also by 09.05.2008. Kindly bear it in mind that if we act promptly, the problem in A.C.P. faced by the 1992 batch Inspectors could be solved easily.
Board is in the process of finalizing our Recruitment Rules. AD III – B the nodal section in this matter was visited and the officials were apprised as to the need for providing framework for inter-commissionerate transfer and other related affairs. We are closely monitoring the developments in this regard.

24th April
The meeting of our available office bearers/EC Members was convened at Maharashtra Sadan and our representation on pay commission related issued were finalized. I would be circulating the minutes of the meeting shortly.

25th April
On 25th we have met the Chairman and Member (P&V) submitted our representation.

27th & 28th April.
On 27th attended the National Executive Committee meeting of the Confederation and on 28th the extended meeting of the Confederation at Hindi Bhawan, New Delhi. For detail please go through the confederation web site: : confederationhq.blogspot.com

The decisions taken in the meeting are given below.
a) To organize demonstration/mass meetings in front of all offices from 13 to 15th May, 2008
b) To organize a massive Mass Dharna programme at a central place at all stations unitedly by all organizations on 16th May, 2008 and adopt the following resolutions and forward the same to the Prime Minister with copy to the Secretary Staff Side, JCM, National Council, 13-C, Ferozeshah Road, New Delhi.

This meeting of the ___________hereby resolves to urge upon the Hon'ble Prime Minister to kindly direct the concerned to negotiate and settle the demands of the employees appended hereunder:

I request all Circle and branch committees to organize this programme along with other Central Government organizations in your locality. These programmes may be observed along with the State level Central Government Employees Co-ordination Committees. For this we would like to request our leaders to keep contact with the local Co-ordination committee wherever it exists
Submitted our representation to Revenue Secretary, Expenditure Secretary and Cabinet Secretary. We also met D.O.P.M officials in this regard. Copy of the representation submitted is enclosed.

ADDENDUM
With great efforts we are able to convince the all India leadership of Revenue C-O-C to hold an emergency meeting also to seek a joint meeting with the Revenue Secretary. The C-O-C meeting would be held on 11th May,2008 at ITEF HQ AT 2.00 p.m. and the joint meeting with the revenue secretary is scheduled on 12th of May,2008.

I request all the Circle and Branch secretaries and office bearers to organize meetings as a part of our awareness campaign, and the message is to be understood that if discussion between staff-side and the Government fails, we may have to go into industrial action.

Comrades,
The following is the submission of the Association against the recomendations made by the 6th C.P.C. these are a few points which specifically relates to our cadre.
This Association wishes to place on record our serious objections to recommendations made by the 6th Central Pay Commission that would have a bearing on the cadre of Inspectors of Central Excise. This is in addition to the objections on the recommendations that would affect the entire community of Central Government employees. This Association would be pursuing the common points through the Confederation of Central Government Employees.

Different ministries have already highlighted the general discontentment of their personnel with regard to the recommendations of the commission with the Ministry of Finance requesting corrective action. We would like to mention specifically the efforts made by the Chief of Armed Forces and the Minister for Defence in respect of the Armed Forces Personnel and that of Railway Ministry in respect of their employees. It is our sincere hope that the CBEC and the Department of Revenue would also rise to the occasion and take immediate action to alleviate the grievances of its employees.

It may please be appreciated that to provide the best security to the nation better revenue augmentation is a necessity, which can be solely achieved through its personnel.
1. OBJECTIONS ON THE RECOMMENDED PAY SCALE OF INSPECTOR

The CPC in para 7.15.13 vide dealing with the matter of the pay of officers of Central Excise has made the following observations “The posts of Inspector and equivalent exist in CBDT as well as CBEC. The Fifth CPC had recommended the scale of Rs.5500-9000 for these posts. The pay scale of these posts was, however,upgraded to Rs.6500-10500. Demands have been received from other posts existing in the scale of Rs.5500-9000 in these two Boards seeking similar dispensation. The Commission has recommended merger of the pay scales of RS. 5000-8000/-, Rs.5500-9000/- and Rs.6500-10500/- which will automatically meet this demand. Hence, no specific recommendation on demands seeking such upgradation is being made."

This recommendation would in effect place the Inspector of Central Excise on par with a Senior Tax Assistant in the Department. It may be appreciated that Senior Tax Assistant constitutes one of the feeder cadre for promotion to the Post of Inspector of Central Excise. 2/3rd posts in the cadre of Inspector is filled up by direct recruitment and rest by promotion. In this regard, it may also be noted that the cadre of Inspector is not a regular promotional post for the cadre of Senior Tax Assistants. Only those Senior Tax Assistants who possess the required physical standards, who qualify the prescribed physical endurance test, written examination and interview are selected and promoted as Inspector. Neither these posts are comparable not their functions the same. While Senior Tax Assistants is a ministerial post, that of an Inspector is a field post and is the chief constituent of the executive arm of the Department. For these reasons, the recommendations of VIth CPC at para 2.2.19 to the effect-" since the length of a pay scale is not very relevant in the revised scheme of running Pay Bands, no rationale existed for retaining the scale of Rs.6500-6900/-as a distinct scale" does not hold good for the Department of Central Excise. The above recommendation is higly demoralizing to the cadre of Inspector of Central Excise.

In this regard attention is invited to the recommendation of the commission in para 2.2.21 (V)as to the action to be taken in situations when one of the merged cadre constitute the feeder cadre for promotion to the other cadre.

“On account of the proposed merger of pre-revised pay scales of 5000-8000, Rs.5500-9000 and Rs.6500 – 10500, some posts which presently constitute feeder and promotion grades shall come to lie in an identical grade. The commission has given specific recommendations about some categories of these posts in the report. As regards other posts, it should first be seen if the posts in these three scales can be merged without any functional disturbance. If possible, this should be done. In case it is not feasible to merge the posts in these pay scales on functional considerations, the post in the scale of Rs.5000-8000 and Rs.5500-9000 should be merged with the post in the scale of Rs.6500-10500 being upgraded to the next high grade in Pay band PB-2 with grade pay of Rs.4600 corresponding to the pre-revised scale of Rs.7450-11500. “

Enclosed herewith is a list of cadres in other Govt. Dept.s who are in the pay scale of Rs. 6500-10500 as on date, on par with that of the Inspectors of Central Excise, but who have been recommended for the higher pre-revised pay scale of Rs. 7450 – 11500 by the Sixth Central Pay Commission.

Hence in order to maintain the vertical and horizontal relativities and to put promotional posts based on their functional identity in a hierarchial structure, it is of utmost necessity that Inspector of CE are placed on par with the pre-revised scale of Rs.7450-11500 at the time of implementation of the recommendations of the VIth CPC.

It is also submitted that above request is without prejudice to the right of this association to demand a higher replacement scale of 7500-12000 for the reasons stated in the memorandum submitted by this Association to the 6th CPC.

2. OBJECTIONS FOR DENYING GRANT OF PAY SCALE 6500-10500 WITH EFFECT FROM 01.01.1996.

The VI CPC has vide its recommendation in para No:7.15.16 under the chapter of Ministry of Finance, given its observation regarding granting of Scale of 6500-10500 for Inspectors/ Equivalent retrospectively from 1-1-1996. The pay commission has stated that unless a clear-cut and manifest anomaly that cannot be corrected other than through such retrospective revision is made out, it cannot be considered. In this regard a comparative chart is enclosed giving an insight into the pay scale that would be drawn by the Inspector of CBI and the Inspector of Central Excise as on 1-1-2008 (as per the recommendations of the VI CPC). The worksheet doesn’t incorporate the recommendations of the VI CPC for a higher scale of Rs. 7450-11500 for the Inspectors of CBI. Nor does the worksheet take into account the scales of Inspectors of CBI were revised from 1986 itself. Thus even on a very moderate calculation, there would be a difference of about Rs. 2,200/- between the Basic pay of an Inspector of CBI and an Inspector of Central Excise, if both the persons had joined the respective cadres on 1-1-1996 on the same basic pay of 6500-10500. This work sheet holds good in respect of a comparison of basic pay between Inspectors of Central Excise and its comparable cadre in the IA & AD also.
From the above it is evident that the above anomaly is clear-cut and manifest and cannot be corrected other than through a retrospective revision of the scale of Inspectors of Central Excise w.e.f. 1-1-1996. Hence it is requested that the Govt. may be urgently urged upon to grant this retrospective effect w.e.f. 1-1-1996 and set right the anomaly.

Hence it is requested that the Govt. Of India may urgently be addressed to place the Inspectors of Central Excise also in the scale of Rs.7450-11500 (Pre-revised) and ensure that justice is done to this cadre in CBEC.
3. OBJECTIONS ON THE NON RECCOMENDATION OF UNIFORM ALLOWANCE

Further in the matter of Uniform the VIth CPC at para 4.2.70 has identified certain categories of posts in Customs and Central Excise Dept. as being paid with uniform allowance. However while recommending the rates of allowance for different Govt. Depts. They have totally totally neglected the Revenue Department. it is therefore requested in accordance with the recommendations the Departmental officers should also be given - I) Initial Equipment allowance @ Rs.14000. ii) Renewal grant @ Rs.3000/-.




Since the Sixth Central Pay Commission has not prescribed the higher scale for the Inspectors of Central Excise, the horizontal and vertical relativities stand disturbed, more so when the pay scales of Rs. 5000-8000 onwards upto Rs. 6500-10500 stand merged as per the recommendations of the Sixth CPC itself.

It is a hardtime for the cadre as a whole, to run this organisation without my predecessor, Sri R. Manimohan is very difficult, Pay Commission had shown its awesome face to our cadre once again. We have to start from the begining , at this point of time I pray to all our executive members as well as other leaders and general members of this All India Association to rise to the occassion and as my predecessor adviced we have to hold our hands tightly to strive together. I am enclosing herewith the attachments sent by Sri R. Manimohon along with his letter dated 08.04.2008 for your ready reference. In this connection I would like to ask all of you to send suggestions regarding correcting Anomalies noticed in the submission of the Pay Commission with specific emphashis on our cadre.

LETTER NO.- 1

To

Dear Comrades,

As I stand promoted as Superintendent and am to assume charge in a couple of days, I hereby intent to lay down the office of Secretary General of this Association and hand over charge to Com. Kousik Roy as per our Constitution.

I take this opportunity to thank every one of you for having stood stead fast with the organization through out my career in this cadre and Federation/Association. I have tried to contribute my mite in various capacities the organization has offered me, from time to time. There have been areas where I feel we could have done better, if only the unity of the cadre could have been achieved. In the context of the adverse recommendations of the CPC against the cadre and department, it is indeed a painful thing for me to leave at this juncture. In this regard I have consulted almost every one of you as to whether I should defer the promotion. The predominant feeling was that, if I did not take the promotion, it would send a very wrong signal, since stagnation is one of the items top most in our agenda and promotion is one thing very hard to get. Hence I have decided to take up the promotion.

It is needless to emphasis that the strength of our Association lies in the Constitutional and transparent method of our working. There might have been a few, here and there, for whom democracy and transparency were mere technicalities. But our experience has shown that without these fundamental elements, the organization becomes the fiefdom of certain individuals or coterie. Nothing tangible could be earned for the cadre by such a set up. An organization running only on paper and being used only for getting a few postings here and there, is more detrimental to the interests of the cadre than any thing else. It need not be pointed out that during some stray instances of weakness, a few amongst us also think, perhaps desperately, that such methods of so-called laisoning would help the cadre. But nothing is a substitute for an intelligent, committed and dedicated cadre. Towards that, the constant work of the Office bearers lies in mobilizing them and sensitizing them to the dangers around.

The two main factors that came up during the last CEC at Kozhikode, were the concept of All India Office Bearers not continuing as local office bearers and the necessity for financial accountability in the Association as a whole. Recent developments/events point towards an urgent resolution on these issues. To start with, at least the top two Office Bearers at the All India level could give up their local office bearership. Otherwise, the Association will be ridden with regionalism. Similarly the constant chanting that financial accountability of the All India Association is limited only to the proportion of the subscription given to the All India Association, also will spell doom to the organization. Though we came very near to the implementation of the one-man-one-post at the last CEC, with a clear majority in the house favouring it, I have deliberately left it to seep into the minds of the members, due to our changing from the Federal set up to the Association mode, as required by the Recognition rules.

The points regarding the pay alone have been sent to the CBEC in the form of separate letters copies of which are enclosed herewith. The other issues in the CPC recommendations have to be taken up through the COC /Confederation. I am sure that the case would be projected effectively and with our long experience now, we will be able to achieve our demands from the Government.

Assuring my everlasting support for the cause of the association and cadre, I once again thank one and all and hereby hand over the charge to the ASG. The accounts, records and balance amount are being sent to him.

Sub: - Disturbance of the vertical and horizontal relativities in respect of pay scales prescribed for the Inspectors of Central Excise – anomaly requiring urgent intervention- reg.


Kind reference is invited to the recommendations of the Sixth Central Pay Commission in respect of the scales of the Inspectors of Central Excise.

Please find enclosed a list of Officers in other Government departments who are on the pay scale of Rs. 6500-10500 as on date, on par with that of the Inspectors of Central Excise, but who have been recommended for the higher pre-revised pay scale of Rs. 7450 – 11500 by the Sixth Central Pay Commission.

Since the Sixth Central Pay Commission has not prescribed the higher scale for the Inspectors of Central Excise, the horizontal and vertical relativities stand disturbed, more so when the pay scales of Rs. 5000-8000 onwards upto Rs. 6500-10500 stand merged as per the recommendations of the Sixth CPC itself.

In the context of the relativities with the pay scales of Inspectors of CBI and ACIOs in the I.B, the Sixth CPC has based its conclusions on a wrong premise that the Fifth CPC had specifically noted that no relativity could be established between executive posts in Income Tax and Customs vis-à-vis those existing in CBI. (para 7.15.17 of the recommendations.) This is quite contrary to the findings of the Fifth Central Pay Commission, which could be seen from the paras 66.107, 66.119 & 70.64 whereby it was held that there was no justification to take the Inspectors of CBI and IB to a higher scale and that the parity between the scale of pay of IB, CBI and Delhi Police is mis-placed. Only against this back ground the V CPC had concluded that the Inspectors of IT and Central Excise are not comparable with Police Organisations just like the officers of CBI & IB are also not comparable with the Police Organisations. It was only on realization of these facts, that the Govt. had upgraded the scale of pay of Inspectors of Central Excise & IT to Rs.6500-10500 vide F.No:VI/37/98-IC dt.21-4-2004. While the V CPC gave its recommendations after a clear analysis of the work performed and the level of responsibility of the above said categories of officers, the observations of the VI CPC are without any basis. This could be very well observed from paras 7.19.60 and 7.19.61. In the said paras, the VI CPC has, while accepting that the Govt. has not disturbed any relativity in respect of ACIOs of IB, without any rhyme or reason, have recommended a higher scale of 7450-11500 (PB-2 with grade pay of Rs.4600) for ACIO-I. By this recommendation, VI CPC has brought about parity between CBI, IB and Police Organisations.

In the above context, since the V CPC has clearly held after a detailed study of the work performed and the level of responsibility of the above said categories of officers, as required by the Hon’ble CAT, Jabalpur, that the Inspectors of CBI, IB were on par with the Inspectors of Central Excise & IT, and none of these categories of officers are on par with the Inspectors of Police Organisations, the VI CPC ought to have applied the same yard stick and recommended the same pay scales for the Inspectors of Central Excise & IT also. It could be seen from the recommendations of the VI CPC, that the Inspectors of CBI are also drawing a risk allowance of Rs.25% of their Basic Pay as of now. The Inspectors of Central Excise are therefore put to a severe dis-advantage.

Hence it is requested that the Govt. Of India may urgently be addressed to place the Inspectors of Central Excise also in the scale of Rs.7450-11500 (Pre-revised) and ensure that justice is done to this cadre in CBEC.

Sub: - Identity of the Cadre of Inspectors of Central Excise – the threat posed by the Sixth Central Pay Commission recommendations- urgent intervention sought - reg.


Kind reference is invited to the recommendations of the Sixth Central Pay Commission in respect of the scales of the Inspectors of Central Excise.

As per the recommendations in para 2.2.18, the scales of 5000-8000, 5500-9000, 6500-6900 and 6500-10500 have been merged and placed in the Pay Band 2 with basic pay of 8700 and Grade pay as 4200. By this recommendation, the Inspectors of Central Excise who are on the pay scale of 6500-10500 as on date have been merged along with the cadres of Tax Assistants and Senior Tax Assistants.

The pay commission has given the conditions for clubbing of the scales under para 1.2.20 (a – e). none of the conditions support the merger propounded in Para 2.2.18, inrespect of Central Excise cadres. The pay commission itself has vide para 2.2.21 (v) stated as below:

“On account of the proposed merger of pre-revised pay scales of 5000-8000, Rs.5500-9000 and Rs.6500 – 10500, some posts which presently constitute feeder and promotion grades shall come to lie in an identical grade. The commission has given specific recommendations about some categories of these posts in the report. As regards other posts, it should first be seen if the posts in these three scales can be merged without any functional disturbance. If possible, this should be done. The Board is aware that the posts of TA and STAs are feeder posts to the Promotional posts of Inspectors of Central Excise, in the CBEC. As per the above yardstick prescribed by the pay commission, the scale of pay of Inspectors ought to have been upgraded to that of Rs.7450-11500 in the pre-revised scale. However, the pay commission has not made any specific recommendations regarding upgrading the scale of pay of Inspectors of Central Excise. A list of all other cadres in the Government of India’s Service where such an upgradation has been specifically recommended is enclosed herewith for ready reference.

When the TAs and Inspectors get recruited in the same scale/PB, the motivation that is required out of a Direct recruit Inspector as a field level cutting edge officer and as an executive officer, would be missing. This will pose a grave threat to the very functioning of the department. On promotion as Inspector, the TA /STA would be placed on a higher pay scale than that of an Inspector who got recruited on the same date as that of the TA /STA. This fact coupled with the existing stagnation in the cadre of Inspectors will serve only to further dampen the spirits of the Inspectors. Thus from the functional point of view, it would not be advisable to have all these cadres in the same scale / Pay band.

Hence, in order to maintain the vertical and horizontal relativities, to put the promotional posts on a higher pedestal than the feeder posts, and to maintain the identity of the cadre of Inspector of Central Excise as that of an Executive cadre, it is requested that the Board may urgently urge upon the Govt. of India to place the Inspectors of Central Excise on par with the pre-revised scale of Rs.7450-11500 when the recommendations of the Sixth Pay Commission are taken up for consideration for implementation.

Sub: - Disturbance of the vertical and horizontal relativities in respect of pay scales prescribed for the Inspectors of Central Excise – anomaly requiring urgent intervention- reg.


Kind reference is invited to the recommendations of the Sixth Central Pay Commission in respect of the scales of the Inspectors of Central Excise.

The VI CPC has vide its recommendation in para No:7.15.16 under the chapter of Ministry of Finance, given its observation regarding granting of Scale of 6500-10500 for Inspectors/ Equivalent retrospectively from 1-1-1996. The pay commission has stated that unless a clearcut and manifest anomaly that cannot be corrected other than through such retrospective revision is made out, it cannot be considered. In this regard a comparative chart is enclosed giving an insight into the pay scale that would be drawn by the Inspector of CBI and the Inspector of Central Excise as on 1-1-2008 ( as per the recommendations of the VI CPC). The worksheet doesn’t incorporate the recommendations of the VI CPC for a higher scale of Rs.7450-11500 for the Inspectors of CBI. Nor does the worksheet take into account the scales of Inspectors of CBI were revised from 1986 itself. Thus even on a very moderate calculation, there would be a difference of about Rs.2,200/- between the Basic pay of an Inspector of CBI and an Inspector of Central Excise, if both the persons had joined the respective cadres on 1-1-1996 on the same basic pay of 6500-10500. this work sheet holds good in respect of a comparison of basic pay between Inspectors of Central Excise and its comparable cadre in the IA & AD also.

From the above it is evident that the above anomaly is clearcut and manifest and cannot be corrected other than through a retrospective revision of the scale of Inspectors of Central Excise w.e.f. 1-1-1996. Hence it is requested that the Govt. may be urgently urged upon to grant this retrospective effect w.e.f. 1-1-1996 and set right the anomaly.
