Updates from Delhi:-
Com. Anupam Neeraj,
President and the undersigned were in Delhi from 6th January to 10th January
2015 for meetings with the officers of CBEC, DGHRD and others. Many issues were
discussed in details and letters were submitted to them during the
meeting. During meeting with the Member
(P&V), we raised the issue of non-conducting of DPC for promotion to the
grade of the Superintendent (CE) against consequential vacancies in Chennai
Zone and Mumbai Zone. We explained this situation,
in which Inspectors of stagnated zones are repeatedly forced under sufferings. We also told her that the cadre is agitated and
this situation will hamper the smooth work of these zones, if problem is not addressed on time. The Member (P&V) assured us that she will
enquire into the matter and give suitable direction to the concerned authorities
soon.
Further,
we also discussed the matter related to All India Seniority, stagnation, regional
disparity, time bound completion of vigilance proceedings and compassionate appointments.
We strongly opposed any move to reduce the
residency period and suggested to fill the vacant posts of Superintendent (CE) at
well placed zones by calling the options from the officers of the stagnated zones who
have rendered sufficient length of services in the department and are still
awaiting promotion. The
Member (P&V) assured us that the residency period will not be decreased.

Subject: - Critical issues related to the Cadre of
Inspectors of Central Excise, which require immediate attention of CBEC - Reg.
Sir,
Please refer to our letters dated 05.08.2014, 20.08.2014, 28.10.2014,
07.11.2014 and 18.11.2014 on various subjects.
The following
issues related to our cadre need immediate attention of yourself:-
1. Acute stagnation in the grade of Inspector of Central Excise and
regional disparity in promotion to the grade of the Superintendent of Central
Excise: - The cadre of Inspector of
Central Excise is the most stagnated cadre in Central Government Departments. There are various reasons behind this acute
stagnation. Despite the recent Cadre
Restructuring, the stagnation continues to haunt the cadre. If this problem is not addressed on time, it
will be disastrous for the cadre in coming years. Second most demoralizing fact
is that the cadre is suffering from discriminating regional disparity in
promotion to the grade of Superintendents in different cadre controlling zones
of Central Excise. Though, the department constituted one Study Group on this
issue but we are sorry to submit that no way out has been achieved till date
and the cadre is forced to believe that it is nothing else but one coolant to
cool down the agitation and aspirations of the cadre.

Delay in conducting DPC for promotion to the grade of the Superintendent
against the vacancies arising out of the cascading effect of the Cadre
Restructuring in some of the Cadre Controlling Zones of the Central Excise and
fixation of single unified date for reckoning of seniority in the grade of
Superintendent:- The DPC has not
been conducted in Central Excise Zone, Chennai and Mumbai. The DPC for the promotion of Inspector to the
grade of the Superintendent has already been conducted in almost all the zones
of Central Excise. It is, therefore, requested to order:-
i. the respective Cadre Controlling Authorities to
conduct the DPC on priority basis and without further delay.
ii. to protect the seniority in the grade of the
Superintendents, of those Inspectors, who have been badly affected due to these
inordinate delays.
3. Redressal of cases of
Compassionate Appointment as one time measure: - As part of welfare measure it is submitted that long pending cases of
compassionate appointments are still pending in want of vacancies. At this juncture when there are sufficient vacancies
due to cadre restructuring, the department can impart some relief to the plight
of the families sailing through the tough time because of death of their bread
earner.
4. Time bound completion of Disciplinary/Vigilance Proceedings:- From time to time, the Government of India has
issued executive instructions to further
streamline the procedure
for Disciplinary/Vigilance Inquiries in conformity
with judgments of the High/Supreme Court.
Nevertheless, there continue to be instances
of inordinate delay in the disposal
of such disciplinary inquiries. At present, hundreds of
Disciplinary/Vigilance Inquiries are lying pending in different Cadre Controlling
Zones of Central Excise, which needs urgent disposal in accordance with the
guidelines/norms/rules framed by CBEC, DoPT and CVC. Time norms specified by CVC for conclusion of
disciplinary proceedings should be followed in letter and spirit. It is, once again, requested to order all the
Cadre Controlling Authorities in Central Excise to complete the
Disciplinary/Vigilance proceedings in time bound manner in accordance with
various guidelines issued by the Government of India.
The Association, once again request, not to give any relaxation in qualifying
service for promotion to the grade of the Superintendent to fill the vacant
posts of the Superintendents in various well placed zones. The Inspectors joined through same
examination in previous years are still waiting their first promotion in
stagnated zones whereas the Inspectors joined up to the year 2005 have been
promoted in well placed zones. So, if
any relaxation in qualifying service is given, it will further aggravate the
Regional Disparity and hamper the genuine prospects of the Inspectors posted in
stagnated zones who are already facing the discriminating regional
disparity. Hence, the still vacant posts
of the Superintendent, Central Excise may be filled by the officers of the stagnated
zones who have rendered sufficient length of services in the department and are
still awaiting promotion due to no fault of theirs.

Visit of Ghaziabad and
Meerut:-
With
a view to strengthen Organization at all India level and to facilitate the
interaction with the members at grass root level, meetings with the members were
organized at Ghaziabad and Meerut on 09.01.2015 by Com. A.
I. Abbasi, Vice President representing North Zone. Com.
Anupam Neeraj, President and the undersigned were interacted with the members
of the Ghaziabad and Meerut. During the
meeting, members were of the view that the members/office bearers from Meerut
must represent their Circle in CEC/Convention in order to get their voice heard
at national level, which they are lacking.
They were of the view that the national body of the Association should
support the legal battle in order to bring parity in promotion across all Cadre
Controlling Zones. We
reiterated the fact that we support morally, legally and financially all the
endeavours to bring All India Seniority and parity in promotion across all
Cadre Controlling Zones of Central Excise.
During his interaction with the members, Com. A I Abbasi called the
young blood to participate in Association-activities. Com. Anupam Neeraj apprised the members about
the activities/initiative of AICEIA. During our visit, we were happy to see and
interact with the members posted at Ghaziabad and Meerut. We are looking forward for a robust
Association at Meerut.
We were also wanted to
organize meetings at Chandigarh and Jaipur Units, in which many office bearers
have been promoted. The meetings could
not be organized on short notice as the existing office bearers are posted out
of headquarters. We are looking forward to organize similar interaction
programs at these places in near future.
