Updates from Delhi

Dear Comrades,

The Office Bearers of this Association were in Delhi between 06.12.2015 to 14.12.2015 for various organizational issues.  During the visit, a meeting was held in the chamber of the Member (P&V).  From the Administration side, the Member (P&V), Jt. Secretary (Admin.), Jt. Director (DGHRD) and officers from the Ad. II.A and CCO Delhi Zone were present and the AICEIA was represented by Com. Anupam Neeraj, President, Com. Devender Kumar, Liaison Secretary and the undersigned.   During the meeting, the main agenda of discussion was the resolutions passed in the Ahmedabad CEC.  All the resolutions were discussed in detail.  The details of the meeting will be informed soon. 

Further, we submitted our comments on the recommendations of the 7th CPC to the Revenue Secretary, CBEC, Confederation of Central Government Employees & Workers and NJCA.  We also met Sh. A. K. Qasim, Dy. Secretary on 10.12.2015 and discussed our grievances on the recommendations of the 7th CPC.  Further, a meeting was held in the chamber of the Jt. Secretary (Admin.) on 14.12.2015 and we apprised him about  the grievances and expectations of the cadre from the 7th CPC.  We assured very positive results from the            Jt. Secretary (Admin.).  This Association made it clear that if the grievances of the cadre regarding 7th CPC is not addressed by 1st week of the February this largest cadre of the CBEC will be forced to go on strike.   Our Comments and letters submitted on the issue, are attached below:-

Notice for Black Day & Demonstration on 27.11.2015

Dear Comrades,

It is to inform that the NJCA has issued a press note regarding observance of BLACK DAY by all Central Government employees on 27.11.15.  Being affiliated  to the Confederation of Central Government Employees and Workers, the AICEIA will also observe the black day and stage demonstration by wearing black badges on duty on 27.11.2015 to protest against the retrograde recommendations of the 7th Central Pay Commission. All the Circles/Branches/Units of the AICEIA are requested to observe the programme and make it a grand success. The General Secretaries of all Circles/Branches/Units of the AICEIA are requested to serve the due notice to the concerned CCA immediately.   Further, all the regional leaderships of the AICEIA are requested to communicate and motivate the members in person/telephonically/through sms/emails/whatsapps or by all other possible means.

Further, it is also to inform that an urgent meeting of the National Secretariat of the Confederation of Central Government Employees & Workers (CHQ) will be held at Confederation Headquarters on 27.11.2015 to discuss the Future Course of action on the recommendation of the 7th CPC.  Therefore, we appeal all regional leaderships of the AICEIA to be in ready state to go to any extent for our rights.

MOST DISAPPPOINTING AND WORST RECOMMENDATION BY THE 7TH CPC

Many leading economists of our country were of the views that India needs government employees more than the existing with decent pay packages for effective governance and they were expecting that the 7th CPC will recommend better pay prospects to central government employees to ensure better governance. The 7th Central Pay Commission headed by Justice Sh. A K Mathur submitted its report to the Finance Minister Sh. Arun Jaitley on 19.11.2015.  All sections of Indian media started propagating it as a big bonanza for central government employees and analyzing its effect on the Indian economy but in their analysis they forgot to analyze the Commission's failure in granting justified pay scale, better career prospects, addressing genuine grievances of the employees etc.  Despite many positive assurances by the Commission in the meeting with AICEIA, the Commission did not address our genuine demands.  Thus, the All India Central Excise Inspectors' Association marks this recommendation as DISAPPOINTING and WORST RECOMMENDATIONS EVER. 
   
Comrades,  the Central Pay Commission failed to address the genuine grievances of the our cadre but we should keep in our mind that this recommendation of the 7th CPC is not final and it is subject to modification based on the impact and objections and responses of both sides i.e. Central Government and Staff Associations/Unions/Federations.  So, it is high time and we should keep our self ready for any type of Agitations/Strikes/Demonstrations etc. to address the insensitiveness of the Commission towards our cadre and get justice from the government. 

In the backdrop of these events, all the Branches/Circles of AICEIA are requested to be prepared for any type of Agitations/Strikes/Demonstrations etc. on very short notice.

Details of Central Executive Committee Meeting, held at Ahmedabad

The Central Executive Committee Meeting  of the AICEIA was convened at Ahmedabad on 25th and 26th September 2015. The meeting was inaugurated by the Chief Guest Justice S. G. Shah, Sitting Judge of Ahmadabad High Court and Sri Uma Shankar, Commissioner (Appeals) was the Guest of Honour. The open session was addressed by the guests.

Closed Session of  the meeting was started with the opening speech by the President followed by the presentation of Minutes of Kolkata CEC, Action Taken Report of the Secretary General and Audited Accounts. The delegates presented their views on the ATR submitted by the Secretary General and the same was reported back by the Secretary General. The house accepted the minutes of the Kolkata CEC along with the ATR and Accounts. The President announced closure of business session on 25th September and asked the House to resume on 26th of September for further discussions and resolutions.

The business session of the second day i.e., 26th of September started with sponsoring of resolutions by the Circle/ Branches and thereafter acceptance of the resolutions by the House.

All the important issues related to cadre were discussed and resolutions were adopted in the meeting.  The important issues which dominated the meeting were Stagnation, Regional Disparities in promotions of Group-B Central Excise executive officers, All India Seniority for Inspectors, Non-reduction of Residency Period  of Inspectors for promotion to  the grade of Superintendent, ICT, futility of Control Room duties and redundancy of Uniform in the service etc.  After discussion and detailed deliberations, the following resolutions were passed by the House:-

1.    All India Seniority List of Inspector of Central Excise should be framed as      demanded  
    by the Association.
2.    Non-reduction of Residency Period for promotion to the grade of Superintendent until       the All India Seniority List has been prepared for Inspectors of Central Excise .
3.    Most of the zones are now headed by the Officers of Special Secretary Rank, the      centralized welfare fund at DGHRD needs to be decentralized to CCAs for easy & fast      reimbursement from Welfare Fund.
4.    Implementation of N.R. Parmar case's Supreme Court Judgement in all the Zones and        review of old DPCs. 
5.    Limited departmental Examination for promotion 
6.    Multi Tasking Staffs for Ranges and Divisions' office and H.Q. 
7.    There should be sufficient Residential Government accommodation & Guest    House/Transit Hostels 
8.    Non-implementation of Biometric Attendance System.  
9.    There should only one year tenure for Inspectors at Airports
10. Consideration of pending ICT applications and there should be clearly defined policy        of ICT.
11. Annual Health Checkups for Inspectors in line of the guidelines of same for Group-A Officers
12. Provisions of Crèches at Office building
13. Special recruitment drive to fill the vacant posts of Inspectors in SC/ST categories
14. Parliamentary Committee on Grievances  to  be approached by the National Body of AICEIA for redressal of long pending demands
15. Abolishment of Uniforms, Protocol and Control Room duty 
16. Proper training for Inspectors
17. Pay parity of Promotee Inspectors with Direct recruit Inspectors 
18. Proper Infrastructure for Official work 
19. Various demands including leave encashment facility on yearly basis,  at least five    MACPs in the entire service period based on pay in promotional hierarchy, Children's education Allowance may be given upto the Graduation etc. and proper follow up with  7th CPC 
20. Timely follow up model calendar for DPC and fixation of responsibilities in case of    delay 
21. Proposal to define the duties & responsibilities of Inspectors' post GST
22. Creation of one Service Tax Commissionerate & one Customs Commissionerate under        Shillong Zone with separate full working and sanctioned strength
23. Pay parity from 01.01.1986 
24. Health Insurance scheme from Welfare Fund of CBEC 
25. Modification in ACES for reduction of manual reports 
26. Vigorous persuasion of legal cases 
27. Speedy disposal of long pending vigilance cases 
28. Participation  in the indefinite strike slated from 23.11.2015, called by the National JCA
29. Physical Control on Cigarette  units should be replaced with the Compounded levy   system

          Apart from the above, the following organizational issues were discussed and decisions were taken:-

1.     Clearance of dues by Branches/Circles on priority basis
2.     Submission of DDO certificates by the Branches/Circles (who have not submitted yet), to the national body for the year 2014-15 & 2015-16
3.     Anti-organization activities by the Joint Secretary (West Zone).  The House decided to seek the explanation from him.
4.     Co-opting the Office Bearer:- The post of the Joint Secretary (North Zone) was vacant due to the promotion of the office bearer.  During the meeting,  a proposal was  submitted to the House for co-opting Com. Alok Kumar Shukla of Meerut Branch for the vacant post. Further, Com. Rakesh Kumar Mishra of Bhubaneshwar Branch proposed the name of Com. Bhoopindra Singh,  GS, Delhi Branch for the vacant post of J.S. (NZ) and sought election.  However, there was no provision of election but for the purpose of clarity it was decided to conduct direct election for the post.  Com. Alok Kumar Shukla won the election with a huge margin and elected as  the J.S. (NZ) for the remaining period of the present body.
5.     Com. S. K. Gangte put the proposal for organizing next CEC Meeting at Shillong Branch of AICEIA, which was unanimously accepted and welcomed by all.


The CEC meeting concluded with the Vote of Thanks by the Host Unit.

The National JCA has decided to defer the Indefinite Strike slated from 23rd November, 2015 to a date during budget session of the parliament.  Further, the NJCA decided to call a massive protest demonstration in front of all offices on November 19th 2015 by wearing black badges.

We, being the part of NJCA, also took the resolution in the Central Executive Committee Meeting of AICEIA at Ahmedabad to participate in the indefinite strike slated from 23.11.2015.  Since, the NJCA has deferred the Indefinite Strike and called for a massive protest deomonstration on 19.11.2015, we should also prepare for the demonstration.  All the Branches/Circles are requested to prepare for this demonstration and co-ordinate with the sister Associations/Federations for making this a grand success.

Dear Comrades,

Please refer to our mail dated 06.08.2015, vide which the notice for
Ahmedabad CEC was circulated.

In the notice, it was also requested to send various information for
incorporation in minutes/action taken report along with resolutions
(to be sponsored) and the details of arrival/departure at Ahmedabad
CEC by 31.08.2015.

After lapse of around ten days, very few Circles/Branches sent the
desired information.  Comrades, it is your prime duty to send it for
successful CEC.  It is, therefore, once again requested to send the
desired information by 15.09.2015, so that the necessary arrangements
can be made by the Host Unit.

Observance of Black Badge Protest on 2nd September

As decided in the Co-Ordination Meeting held on 26.07.2015 in New Delhi, a notice has been served yesterday to the Chairman, CBEC by the AICEIA regarding observance of Black Badge Protest by its members, in support of the Confederation's call of a day strike on 02.09.2015.


The Confederation of Central Government Employees and Workers has given this Strike call on 02.09.2015 for its 11 points Charter of Demands.  The Charter of Demands is as under:-

 1.  Urgent measures for containing price-rise through universalisation of public distribution system and banning speculative trade in commodity market.

2.  (a) Containing unemployment through concrete measures for employment generation.

    (b) No ban on creation of new posts. Fill up all vacant posts.

3. (a) Strict enforcement of all basic labour laws without any exception or

    exemption and stringent punitive measure for violation for labour laws.

     Withdraw the anti-worker Labour Law Amendments

    (b) No labour reforms which are inimical to the interest of the workers.

4. (a) Universal social security cover for all workers

    (b) Scrap PFRDA Act and re-introduce the defined benefit statutory pension scheme.
5.  (a) Fix minimum wage with provisions of indexation.

    (b) Effect wage revision of the Central Government Employees from 01.01.2014 accepting memorandum of the staff side JCM; ensure 5-year wage revision in future; grant interim relief and merger of 100% of DA; Include Gramin Dak Sevaks within the ambit of 7th CPC. Settle all anomalies of 6th CPC.

6. (a) Stoppage of disinvestment in Central/State PSUs. Stoppage of contractrization in permanent perennial work and payment of same wage and benefits for contract workers as regular workers for same and similar work.

     (b) No outsourcing, contractrization, privatization of governmental functions; withdraw the proposed move to close down the printing presses, the publications, form stores and stationery departments and medical stores Depots; regularize the existing daily-rated/casual and contract workers and absorption of trained apprentices.

7. Removal of all ceilings on payment and eligibility of bonus, provident fund; increase the quantum of gratuity.

8. (a) Compulsory registration of trade unions within a period of 45 days from the date of submitting applications; and immediate ratification of ILO Convention C 87 and C 98.

(b) Revive the JCM functioning at all level as an effective negotiating forum for settlement of the demands of the Central Government Employees.

9. (a) Against FDI in Railways, Insurance and Defence.

    (b) No Privatization, PPP or FDI in Railways, Defence Establishment and no corporatization of Postal services.

10. Remove arbitrary ceiling on compassionate appointment.

11. Ensure five promotions in the serve career.



All AICEIA Branch and Circle General Secretaries are required to immediately serve Notice to respective Chief Commissioners or Commissioners, and start campaigning forthwith for making this  Black Badge Wearing Program a grand success.

Meerut Cirlce: Newly recognized Circle of AICEIA

Inspectors' Association of Meerut Zone has been registered as a new Circle of AICEIA under Article 17 of the Constitution of the AICEIA.  The new committee has been formed purely on temporary basis, which has to start membership and complete it within one month.  After the copeletion of membership drive, fresh convention has to be called to elect the representatives of the circle.
