Sub: Stay on promotions ordered by Calcutta High Court – Reg
A kind reference is invited to our letter dated 23.07.2010 wherein we had requested inter alia to direct all cadre controlling authorities to conduct the DPCs and keep the panel ready for issuance of promotion order immediately on vacation of the stay.
Now that the stay order issued by the Honourable High Court of Calcutta in WP (CT) No. 261/2008 has been modified on 27.08.2010 we request your good self to issue immediate instructions to the cadre controlling authorities to convene the DPC in their zone and to keep the panel ready. It may also be instructed that the promotion orders issued as a result of the DPC should be given effect from 01.07.2010 as the delay in issue of the order is only on account of the stay order. This stipulation is essential as the date of promotion would have a bearing in the matter of next promotion as well in the matter fixation of pay and also to ensure uniformity among the zones.
As you are well aware, the officers who are in the line of promotion have already put in more than 17 years of service and the delay in getting the promotions have caused deep sense of resentment and frustration among the officers. I request you that the agony may not be compounded further and necessary orders be issued.

Please refer to this Circle communication Ref. No. AICEIA Chd. Circle/41/2010 dated 21.06.2010, addressed to the Hon’ble Member (CX), CBEC New Delhi with a copy to your good office.
The Chandigarh Circle feels its pleasure while informing that after the kind intervention of the Hon’ble Member as well as our All India Leadership, the Administration at Chandigarh Zone has given an opportunity to this Circle to discuss the issues raised. On coming to know that the issues raised have not been presented properly, the Chief Commissioner has passed directions to the Commissioners under his charge to give a serious look to the deviations from the agreed upon norms, inclusive of those deviations where relaxations were obtained, and take immediate corrective steps to ensure a transparent administration. On 10.08.2010, the Chief Commissioner has given a patient hearing assuring all the grievances of the Association to be resolved within 15 days. Thereafter, a Committee of Commissioners/Additional Commissioners was formed and we were given a hearing again on 19.08.2010 in which the issues raised were discussed in detail. The Committee of Commissioners/Additional Commissioners has assured immediate remedial action in respect of the deviations from the agreed upon norms and strict implementation of government directives. In the entire process of attending to the issues raised, the Chief Commissioner as well as the Committee of Commissioners/Additional Commissioners has gone beyond the call of the Association and we feel highly obliged while welcoming steps taken in this regard. However, much remains in action to maintain the spirits.
This all has been possible due to the futuristic approach of the Hon’ble Member (CX) as well as the Secretary General who have come to the rescue of saving honours as well as identity of the Zones/Circles under their charge. This Circle especially acknowledges the efforts put in by you as Secretary General, All India Central Excise Inspector’s Association, Kolkata, who stood by this Circle in this hour of crisis when the matters were presented to the Hon’ble Member (CX), CBEC, New Delhi. Your actions, surely, administrate the propriety of All India Leadership and the suggestion over discussions with the administration at Chandigarh Zone has supplemented your farsightedness. It has been a matter of pride for us as Chandigarh Circle is enjoying the blessings of All India body under the able leadership of Sh. Arun Zacharia, the President and Sh. Ajay Kundu, the Working President.
In view of the recent developments at the level of Administration at Chandigarh Zone, we request your goodself to put on hold the implementation of resolution arrived at the Central Executive Committee Meeting of AICEIA, Kolkata, held at Indore (M.P.). We are re-assured that all the administrative decisions taken against the Government policies shall be reversed. We shall be submitting the outcome of actions taken by the Administration, very shortly. In the meantime, you may like to inform the Hon’ble Member (CX), CBEC, New Delhi, appropriately.

Interim Order passed by Kolkata High Court
Initially the case No. WPCT 261/2008 was placed as item no. 07 before the Honourable Judge of Bench No. 14 of Kolkata High Court. At the outset A.S.G. pleaded for hearing of the case as item no. 01 as agreed by the Honourable Judge in the last hearing. So the longest hearing started and after hearing the case an interim Judgement passed by the Hon’ble High Court. It was understood that the review DPC held on Setember- 2005 in Kolkata Zone ( giving effect of post based roaster from July 2002)is to be reviewed immediately and the effect of post based roaster is to be effected from 2nd July-1997, it appears that right after rectification of this review D.P.C. in the Kolkata Zone promotion order in different zones will be effected. Print copy of the judgment is yet to reach our hand.

Notice of the agitation was served on the Chairman, Central Board of Excise & Customs on 9th August 2010. The agitation is being organized due to the apathy of the authorities in addressing grievances of the cadre like 1. lack of promotional avenues, Inspectors’ should get at least three functional promotion in service life while they are getting only one promotion. 2. Notional fixation of pay of Inspectors of Central Excise in the pre-revised scale of Rs. 6500-10500 should be provided with effect from 01.01.1996. 3. Fixation of minimum pay corresponding to pre-revised scale of Rs. 7450-11500 consequent to revision of grade-pay ordered on 13.11.2009. 4. Anomaly in pay of 1992 batch Inspectors who received ACP prior to 21.04.2004. 5. Inspectors’ next promotional Grade Pay should be Rs. 5400/- 6. Lifting of ban on ICT 7. JCM s should be conducted at the Board level and at local level at regular intervals. 8. abolition of control room duties that causes unnecessary drain on manpower 9. The 1% incentive on incremental revenue should be utilized for providing facilities and infrastructure for lower level staffs also. The agitation would commence with lunch hour demonstrations on 25.08.2010 followed by black badge wearing from 30.08.2010 to 03.09.2010, lunch hour dharna on 03.09.2010 and whole day dharna before all Chief Commissioner’s office on 15.09.2010. The Association informs that in case the authorities do not heed to the requests even after these programs, the second phase of agitation would be launched culminating in strike of work. Agitation programme & Strike Notice
Charter of demand
1. Price rise of essential commodities to be contained through appropriate corrective and distributive measures like universal PDS and containing speculation in commodity market.
2. Concrete proactive measures to be taken for linkage of employment protection in the recession stricken sectors with the stimulate package being offered to the concerned entrepreneurs and for augmenting public investment in infrastructure.
3. Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.
4. Steps to be taken for removal of all restrictive provisions based on poverty line in respect of eligibility of converge of the schemes under the Unorganized Workers Social Security Act 2008 and creation of National Fund for the Unorganized Sector to provide for a National Floor Level Social Security to all unorganized Sector workers including the contract/casual workers in line with the recommendation of National Commission on Enterprises in Unorganized Sector and Parliamentary Standing Committee on Labour.
5. Disinvestment of shares of Central Public Sector Enterprises (CPSEs) is not resorted to for meeting budgetary deficit and instead their growing reserve and surplus is used for expansion and modernization purpose and also for revival of sick Public Sector Undertakings.
6. Fill up all vacant posts and lift the ban on recruitment.
7 Stop outsourcing/contractorisation of Governmental functions
8. Regularise all daily rated workers/employees/;Grameen Dak Sewaks and remove the ceiling on compassionate appointments; end the discrimination in the bonus ceiling of GDS employees.
9. Withdraw PFRDA bill and extend the statutory defined benefit pension scheme to all Government employees
10. Guarantee right to strike as a fundamental right of employees.

Dear Comrades,
The National Executive of the Confederation met today as scheduled; discussed the steps to be taken to ensure large participation of Central Government employees in the impending strike action of 7thSeptember, 2010 organised by the joint platform of Central Trade Unions and Federations of employees and took the following decisions.
(1) To organise joint conventions at all State Capitals and other important places under the auspices of the State Units of Confederation, AISGEF and AIDEF. The tentative dates on which the conventions will take place at different places are indicated in the joint communication, copy of which is enclosed;
(2) The charter of demands on which the Strike will be organised is enclosed. (The suggestions made by the participants and accepted at the meeting arte incorporated)
(3) The Confederation will serve the strike notice on 12th inst. And all affiliates and their units are requested to serve the strike notices on their respective of Heads of Department/Office by 20th inst. (Copy of the strike notice will be placed at the Website on 13th.)
(4) The affiliates may add as an annexure described as Part II demands which are department specific and which are pending settlement for a long time.
(5) The State Committees and affiliates will chalk out campaign programme to cover the districts and other regions.
(6) The Confederation CHQ will prepare campaign material in the form of brief note on each of the demands in the charter and place the same on its website.
(7) Demonstrations will be organised at all State Capitals and other regional centres jointly by all participating affiliates on 6th September, 2010 and the members advised to participate in the joint rally organised on the same day by the Central Trade Unions.
(8) The Confederation and its affiliates will participate in the March to Parliament programmes organised by the Central Trade Unions after the strike in pursuance of the acceptance of the demands by the Government.
(9) Confederation will take independent initiative in organising campaign and action programmes in pursuance of the common issues of the Central Government employees after the strike action.
(10)The Confederation CHQ will ensure that the Dharna programme decided upon earlier to protest against the vindictive actions in the IA & AD Department is staged in those State Capitals, which could not be organised on 5th. The National leaders will go over to such State Capitals along with the National leaders of the All India audit and Accounts Association.
(11)The affiliates will make the subscription dues pertaining to the F.Y. 2009-10 immediately.
(12)The Nationals Council of the Confederation will be held at Mumbai in December, 2010.

We have narrated in our ATR the reasons as to why we were unable to implead ourselves in the case. In fact Authorities in CEC decided to go for combined movement with the other Cadre Associations in the Revenue Department and to form a Joint Action Committee along with the Superintendent Association in our department. CEC applauded the efforts of Sri Hemant Kumar Ghoshal and Sri Ajit Kumar K.G. and As decided in the meeting we shall write letters to the general secretary’s of different branches and Circles to submit their dues DDO certificates within August 31st and if the time is too short they can be given another months time on request; after this we shall write to Chief Commissioner of that particular zone about the status of the Association running there and for the non-responsive units it will be intimated to the concerned authority that they have no connection with the only recognized Association i.e. AICEIA. Our Ex President wrote a letter to chairman to derecognize our Association and simultaneously applied for recognition of another Association. He asked Board to give the original name of AICEIA to his Association in case Board derecognizes our Association; this off-putting activity of some of our members is to be stopped immediately because this type of anti Association activities destroys the unity and good name of the Association. It was decided in the Indore CEC meeting that the members who are indulging in this type of conduct should be expelled from the Association after serving a show cause notice within a week of issuance of this circular. The office bearers shall discuss the reply (may be over phone, e-media etc) and after discussion final expulsion from the Association should be effected within not more than one month from the date of this CEC. From 25th August 2010 we shall start our agitation Programme. On that date we would organize a lunch hour demonstration programme followed by black badge wearing from 30th Aug 2010 to 3rd September 2010, and a lunch hour Dharna Programme on 3rd September in front of Every Chief Commissioner’s office. Massive campaign programme in every Branch / Circle should be conducted from 3rd to 14th of September, a whole day Dharna Programme is to be organized in every Chief Commissioner’s office on 15th of September. Mean while we shall participate in the Strike Programme convened by National JCA & Confederation of Central Government Employees and in those Branches/ circles. Where Strike is not possible a sit –in demonstration can be organized. |
